Reinstatement from Disability Separation: Reinstatement rights following disability separation extend for three (3) years from the date separation is granted. If an employee is given a disability leave of absence without pay and then placed on disability separation due to the same illness or injury, the total combined period of absence may not exceed three (3) years for purposes of reinstatement. An employee shall be reinstated to the same or similar position within thirty (30) days after applying to the Health Commissioner in writing for reinstatement, provided he or she passes a medical examination which establishes that he or she can resume the duties of his or her position. The medical examination shall be conducted, at agency=s cost, by a physician designated by the Health Commissioner. The Health Commissioner may, in lieu of such medical examination, accept the report of a medical examination conducted by a physician of employee=s choice, at employee=s cost. If a continuing disability precludes reinstatement, the employee may apply for disability retirement from the Public Employees= Retirement System. 3. Notice: The Health Commissioner shall deliver a written reminder to the employee at least two weeks prior to the expiration of his or her disability separation. An employee who does not return from disability separation, formally resign, or take disability retirement, shall be separated from service with the agency upon the expiration of the three year reinstatement period. 42
4.5 Military Leave All employees of the Lorain County General Health District who are members of the Ohio National Guard or members of other reserve components of the Armed Forces of the United States are entitled to leave of absence from their respective duties without loss of pay for such time as they are in military service on field training or active duty for periods not to exceed a total of thirty-one (31) working days in any one (1) calendar year. 43
