Section 5.3 Criminal Offenses An employee may be immediately terminated by the agency for conviction of any felony or for conviction of any offense, whether a misdemeanor or felony, involving dishonesty or moral turpitude. The agency may, in its sole discretion, require any employee charged with a criminal offense to take a leave, with pay, pending the outcome of criminal proceedings against such employee. Nothing contained herein shall be construed to preclude the agency from immediately commencing disciplinary procedures and taking disciplinary action against an accused employee for violations of the personnel policy which are not dependent upon a criminal conviction. 58
Section 5.4 Absence Without Leave Any employee who is absent for three or more successive duty days, without leave and without notice to a supervisor of the reasons for such absence, may be summarily terminated, without a pre-disciplinary conference, from employment for neglect of duty. Such termination shall be effective upon delivery of notice by the agency to the employee=s last known address. 59
