4.2.9.1 Procedure and authority
If an activity, for which an ‘All-in-one’ permit is required, also requires a waiver based on the Flora and
Fauna Act, the nature section becomes part of the ‘All-in-one’ permit for physical aspects (All-in-one
permit). The preparation of the decision is summarized in the section under Wabo, and where
applicable, to the section about the NCR.
This combination can be avoided if a waiver is applied for at an earlier stage. In this case, the Minister of
Economic Affairs, Agriculture and Innovation remains the authority, however the decision period is 16
weeks. Stakeholders protesting the decision on the Flora and Fauna waiver should first file an appeal
with the Department Administrative Law at the Council of State.
4.2.10 Excavations Act
The Excavations Act contains rules relating to all excavations; excavation without a permit is prohibited.
An excavation permit is necessary for the construction of a water basin and/or for the drilling of holes,
dependent on exact measurements.
