to 1,91,990 undertrial <strong>prison</strong>ers for<br />

committing IPC crimes. Thus the number of<br />

undertrial <strong>prison</strong>ers under SLL was 20.2%<br />

of total undertrial <strong>prison</strong>ers under IPC<br />

offences and SLL offences combined. The<br />

highest number of undertrial <strong>prison</strong>ers<br />

(11,779) was reported under NDPS Act<br />

which accounted for 24.2% of the total<br />

undertrial <strong>prison</strong>ers under SLL. This was<br />

followed by Arms Act (18.6%) and Excise<br />

Act (12.0%). Uttar Pradesh has reported<br />

the highest number of undertrials (3,596)<br />

under NDPS Act which accounted for<br />

30.5% of the total undertrial <strong>prison</strong>ers under<br />

NDPS Act in the country. The percentage<br />

share of undertrial <strong>prison</strong>ers reported<br />

under Protection of Civil Rights Act was<br />

the lowest (74) at 0.15%. The details may<br />

be seen in Table-4.4.<br />

Comparison of Convict and Undertrial<br />

<strong>prison</strong>ers of <strong>2011</strong> with that of previous<br />

year (2010)<br />

The convict <strong>prison</strong>ers have<br />

increased by 2.2% in <strong>2011</strong> over 2010 as<br />

the number of convicts (1,25,789) lodged<br />

in various jails of the country at the end<br />

of 2010 rose to 1,28,592 at the end of<br />

<strong>2011</strong>. Seven States out of 28 States having<br />

share of 5.0% crimes or more out of total<br />

IPC crimes in the country as per “<strong>Crime</strong><br />

in India <strong>2011</strong>” report, have reported<br />

decline in convict population during the year<br />

<strong>2011</strong>. These States were Bihar (13.1%),<br />

Kerala (12.3%), Andhra Pradesh (3.3%),<br />

Tamil Nadu (2.5%), Maharashtra (2.3%),<br />

West Bengal (2.0%) and Rajasthan (1.2%).<br />

Only four major States reported increase in<br />

convicted inmates population by 9.4%,<br />

7.6%, 5.7% and 3.0% in Madhya Pradesh,<br />

Karnataka, Uttar Pradesh and Gujarat<br />

respectively during <strong>2011</strong>. Delhi has<br />

reported 16.6% increase in convicted<br />

<strong>prison</strong>ers during same period among the<br />

UTs having considerable number of<br />

convicted <strong>prison</strong>ers. The number of<br />

undertrial <strong>prison</strong>ers has also increased<br />

marginally by 0.5% in <strong>2011</strong> (2,41,200)<br />

over 2010 (2,40,098). Tamil Nadu is the<br />

only State in the country which<br />

considered remand <strong>prison</strong>ers as a<br />

separate category from undertrial<br />

<strong>prison</strong>ers. They had supplied the data till<br />

2006 on these lines. However, from 2007,<br />

like other States, they included data of<br />

remand <strong>prison</strong>ers with that of undertrial<br />

<strong>prison</strong>ers. Hence, the number of<br />

undertrial <strong>prison</strong>ers from 2007 increased<br />

considerably. Seven States having share<br />

of 5.0% of total IPC crime in the country<br />

based on “<strong>Crime</strong> in India <strong>2011</strong>” report<br />

have reported decline in the undertrial<br />

inmate population. These States were West<br />

Bengal (18.2%), Karnataka (5.6%), Bihar<br />

(3.9%), Kerala and Uttar Pradesh (3.2%<br />

each), Gujarat (3.1%) and Tamil Nadu<br />

(0.2%). Three major States, namely<br />

Andhra Pradesh (11.7%), Rajasthan<br />

(8.9%) and Madhya Pradesh (1.1%) have<br />

reported increase in undertrial inmates<br />

population in the year <strong>2011</strong> over 2010.<br />

Maharashtra is the only major State where<br />

undertrials in 2010 (16,065) and <strong>2011</strong><br />

(16,064) remained almost same and<br />

showed no variation. Delhi has reported an<br />

increase of 11.1% in the undertrial<br />

<strong>prison</strong>ers in <strong>2011</strong> over 2010. The details<br />

may be seen in Table-4(A).<br />
