CHAPTER - 7<br />

PERIOD OF SENTENCES OF THE CONVICTS<br />

A total of 1,28,592 convicts were<br />

reported under various terms of sentences<br />

in the country at the end of <strong>2011</strong> (The<br />

details may be seen in Table-7.1). 477 of<br />

these were awarded death penalty<br />

accounting for 0.4% of the total convicts.<br />

Uttar Pradesh (174) has reported the<br />

highest number of such convicts, accounting<br />

for 36.5% of the convicts given capital<br />

punishment in the country followed by<br />

Karnataka (61), Maharashtra (50), Bihar<br />

(37), Delhi (24), Gujarat (20), Madhya<br />

Pradesh, Tamil Nadu and West Bengal (13<br />

each) and Kerala (10) (Table-7.1).<br />

A large chunk of convicts (68,935)<br />

were undergoing through sentence of life<br />

im<strong>prison</strong>ment in various <strong>prison</strong>s in the<br />

country accounting for 53.6% of the total<br />

convicts. In 14 States and 2 UTs, the share<br />

of convicts undergoing life im<strong>prison</strong>ment<br />

was more than the national average of<br />

53.6% . These States/UTs were Daman &<br />

Diu (100.0%), Jharkhand (75.4%),<br />

Puducherry (71.5%), Chhattisgarh (70.3%),<br />

Madhya Pradesh (65.8%), Andhra Pradesh<br />

(65.4%), Maharashtra (65.3%), Bihar<br />

(63.7%), Manipur (62.5%), Karnataka<br />

(62.0%), Rajasthan (61.0%), Assam<br />

(59.7%), Tamil Nadu (57.6%), Jammu &<br />

Kashmir (56.1%), Tripura (55.0%) and<br />

Sikkim (54.3%) (Table 7.2).<br />

A total of 15,053 convicts were<br />

undergoing sentences between 10-13 +<br />

years accounting for 11.7% of the total<br />

convicts. The highest percentage of<br />

convicts undergoing sentence of this period<br />

to total convicts was reported from Goa<br />

(29.2%) followed by Himachal Pradesh<br />

(23.7%), Uttarakhand (21.6%), Haryana<br />

(18.9%), Chandigarh (18.2%) and Gujarat<br />

(17.7%).<br />

A total of 12,661 convicts<br />

accounting for 9.8% of total convicts<br />

were undergoing sentences between 7-9 +<br />

years. The highest percentage of such<br />

convicts was reported from Arunachal<br />

Pradesh (33.3%) followed by A&N Islands<br />

(16.4%), Kerala and Delhi (16.3% each),<br />

Gujarat (15.7%), Uttarakhand (15.5%),<br />

Nagaland (15.4%) and Chandigarh (15.3%).<br />

5.8% of the convicts (7,519 out of<br />

1,28,592) were undergoing sentences for<br />

the period 5-6 + years. The highest<br />

percentage of such convicts was reported<br />

from A & N Islands (44.3%) followed by<br />

Chandigarh (13.6%) and Uttarakhand<br />

(11.3%).<br />

5.2% of the convicts (6,658 out of<br />

1,28,592) were undergoing sentences for<br />

the period 2-4 + years in various jails in the<br />

country. Arunachal Pradesh has reported<br />

50.0% of such convicts followed by A&N<br />

Islands (28.0%), Nagaland (20.8%),<br />

Puducherry (16.2%) and Meghalaya (13.8%).<br />

4.4% of the convicts (5,594 out of<br />

1,28,592) were undergoing sentences for<br />

the period 1-2 + years. The highest<br />

percentage of such convicts was reported<br />

from Mizoram (20.9%) followed by Nagaland<br />

(14.6%), Punjab (10.9%) and West Bengal<br />

(10.7%).<br />

3.4% of the convicts (4,396 out of<br />

1,28,592) were undergoing sentences of<br />

six months to one year. The percentage of<br />

such convicts was relatively high in Mizoram<br />

(15.7%), Punjab (10.2%), Odisha (7.8%) and<br />

Sikkim (7.1%).<br />

117 persons were awarded death<br />

penalty during <strong>2011</strong> in the country. 47<br />

persons were awarded such punishment in<br />

Uttar Pradesh followed by Gujarat (14),<br />

Jammu & Kashmir (9), Punjab and Delhi (8<br />

each). The death sentence of 42 convicts<br />

was commuted to life im<strong>prison</strong>ment during<br />

the year <strong>2011</strong>. Out of 42 convicts whose<br />

death sentence was commuted to life<br />

im<strong>prison</strong>ment, 13 were reported from West<br />

Bengal followed by Bihar, Jharkhand,<br />

Rajasthan and Uttar Pradesh (4 each). No<br />

convict was executed during the year<br />

<strong>2011</strong>. Details may be seen in (Table-7.3).<br />
