PERIOD OF SENTENCES OF THE CONVICTS
A total of 1,28,592 convicts were
reported under various terms of sentences
in the country at the end of 2011 (The
details may be seen in Table-7.1). 477 of
these were awarded death penalty
accounting for 0.4% of the total convicts.
Uttar Pradesh (174) has reported the
highest number of such convicts, accounting
for 36.5% of the convicts given capital
punishment in the country followed by
Karnataka (61), Maharashtra (50), Bihar
(37), Delhi (24), Gujarat (20), Madhya
Pradesh, Tamil Nadu and West Bengal (13
each) and Kerala (10) (Table-7.1).
A large chunk of convicts (68,935)
were undergoing through sentence of life
imprisonment in various prisons in the
country accounting for 53.6% of the total
convicts. In 14 States and 2 UTs, the share
of convicts undergoing life imprisonment
was more than the national average of
53.6% . These States/UTs were Daman &
Diu (100.0%), Jharkhand (75.4%),
Puducherry (71.5%), Chhattisgarh (70.3%),
Madhya Pradesh (65.8%), Andhra Pradesh
(65.4%), Maharashtra (65.3%), Bihar
(63.7%), Manipur (62.5%), Karnataka
(62.0%), Rajasthan (61.0%), Assam
(59.7%), Tamil Nadu (57.6%), Jammu &
Kashmir (56.1%), Tripura (55.0%) and
Sikkim (54.3%) (Table 7.2).
A total of 15,053 convicts were
undergoing sentences between 10-13 +
years accounting for 11.7% of the total
convicts. The highest percentage of
convicts undergoing sentence of this period
to total convicts was reported from Goa
(29.2%) followed by Himachal Pradesh
(23.7%), Uttarakhand (21.6%), Haryana
(18.9%), Chandigarh (18.2%) and Gujarat
(17.7%).
A total of 12,661 convicts
accounting for 9.8% of total convicts
were undergoing sentences between 7-9 +
years. The highest percentage of such
convicts was reported from Arunachal
Pradesh (33.3%) followed by A&N Islands
(16.4%), Kerala and Delhi (16.3% each),
Gujarat (15.7%), Uttarakhand (15.5%),
Nagaland (15.4%) and Chandigarh (15.3%).
5.8% of the convicts (7,519 out of
1,28,592) were undergoing sentences for
the period 5-6 + years. The highest
percentage of such convicts was reported
from A & N Islands (44.3%) followed by
Chandigarh (13.6%) and Uttarakhand
(11.3%).
5.2% of the convicts (6,658 out of
1,28,592) were undergoing sentences for
the period 2-4 + years in various jails in the
country. Arunachal Pradesh has reported
50.0% of such convicts followed by A&N
Islands (28.0%), Nagaland (20.8%),
Puducherry (16.2%) and Meghalaya (13.8%).
4.4% of the convicts (5,594 out of
1,28,592) were undergoing sentences for
the period 1-2 + years. The highest
percentage of such convicts was reported
from Mizoram (20.9%) followed by Nagaland
(14.6%), Punjab (10.9%) and West Bengal
(10.7%).
3.4% of the convicts (4,396 out of
1,28,592) were undergoing sentences of
six months to one year. The percentage of
such convicts was relatively high in Mizoram
(15.7%), Punjab (10.2%), Odisha (7.8%) and
Sikkim (7.1%).
117 persons were awarded death
penalty during 2011 in the country. 47
persons were awarded such punishment in
Uttar Pradesh followed by Gujarat (14),
Jammu & Kashmir (9), Punjab and Delhi (8
each). The death sentence of 42 convicts
was commuted to life imprisonment during
the year 2011. Out of 42 convicts whose
death sentence was commuted to life
imprisonment, 13 were reported from West
Bengal followed by Bihar, Jharkhand,
Rajasthan and Uttar Pradesh (4 each). No
convict was executed during the year
