SANITARY SEWER MATERIAL REPLACEMENT AGREEMENT
THIS AGREEMENT made and entered into as of this _____ day of ___________________, 201___,
by and between the Board of County Commissioners of Ottawa County, Ohio (hereinafter referred to as
the “County”) and _______________________________ (hereinafter referred to as the “Property
Owner”)
WITNESSETH THAT:
WHEREAS, the County has established rules and regulations for enforcement of remediating excessive
infiltration and inflow; and
WHEREAS, the County wishes to assist property owners with eliminating excessive Infiltration/Inflow by
initiating a Material Replacement Program of sanitary sewer construction materials; and
WHEREAS, the Property Owner has submitted a Sewer System Evaluation Study and
Infiltration/Inflow Remediation Plan which has been approved by the County Sanitary Engineer; and
WHEREAS, the Infiltration/Inflow Remediation Plan calls for certain materials to be used by the
property owner to replace failed infrastructure causing excessive Infiltration/Inflow; and
WHEREAS, the County wishes to provide at no cost to the Property Owner certain materials to be
installed by the Property Owner to correct the excessive Infiltration/Inflow identified in the Sewer
System Evaluation Study and I/I Remediation Plan; and
WHEREAS, detailed sanitary sewer replacement plans have been prepared by a professional engineer
and approved by the Sanitary Engineer and Ohio EPA identifying the materials and costs to implement
the Remediation Plan;
NOW, THEREFORE, it is agreed by and between the parties hereto as follows:
