3.8.0 CONTRACTOR LICENSING REQUIREMENTS
3.8.1 The property owner or the property owner's immediate family member may
construct and install, to County specifications, said sanitary sewer
improvements on their property. If the property owner or an immediate
family member does not construct or install said sanitary sewer
improvements, a contractor holding a valid license with the Sanitary
Engineering Department shall be required.
3.8.2 An immediate family member shall be defined as a: current spouse, parent,
stepparent, child, stepchild, brother, sister, stepbrother, stepsister, motherin-law,
father-in-law, or grandparent.
3.8.3 Contractors are exempt from retaining a valid contractor's license with the
Sanitary Engineering Department when said contractor is installing,
repairing, or testing County owned sanitary sewers and appurtenances and
said contractor is acting under a legally executed contract with the Board of
Ottawa County Commissioners for County designed and executed projects.
Said legally executed contracts shall not include escrow accounts with
private developers or written agreements made with private developers.
Said contractor shall be required to abide by the Rules and Regulations and
Construction Specifications Manual of the wastewater treatment systems.
In the event of a problem with said contractor, retainage from said contract
shall be held by the County until all matters of conflict have been resolved.
3.8.4 Only persons, firms, companies, or corporations of proven liability and
approved by the Sanitary Engineer, shall be permitted to construct or repair
building sanitary sewers, private collection sewers, or sanitary sewer
improvements installed by private developers to be dedicated to the County
for ownership, operations, and maintenance. Persons, firms, companies, or
corporations constructing or repairing building sewers, private collection
systems, or sanitary sewer improvements installed by a private developer
shall obtain a yearly license and furnish a performance bond on forms
provided by the Sanitary Engineering Department.
Said contractor's license shall be approved and signed by the Sanitary
Engineer or his authorized agent and shall expire on the 31st day of
December in the year in which the license is issued. The expiration date of
the license shall be marked on said license when issued.
Contractors not possessing a valid license and not under contract with the
Board of County Commissioners shall not be permitted to install or repair
any public or private appurtenances connected to the wastewater treatment
systems. A valid license may be revoked at any time by the Sanitary
Engineer or his authorized agent for any violation of the Rules and
Regulations or Construction Specifications Manual.
