RESOLUTION NO. 05-95
RESOLUTION CREATING THE ERIE TOWNSHIP SANITARY SEWER SLIB-DISTRICT
OF THE OTTAWA COUNTY SEWER DISTRICT
The Board of Commissioners of the County of Ottawa, Ohio, met in regular session at the office of the
Board of County Commissioners, Ottawa County Courthouse, Port Clinton, Ohio on the 6th day of December
2005, at the regular place of meeting with the following members present:
John G. Papcun Steven M. Arndt Carl Koebel
Arndt;
Mr. Koebel offered the following resolution and moved its passage, which was duly seconded by Mr.
WHEREAS, .by Resolution No: 95-08 dated January 31, 1995, the Board of Ottawa County
Conimissioners established the Ottawa County Sewer District; and
WHEREAS, by ~esol'ution No. 95-05 dated January 17, 1995, the Board of Commissioners
established the Ottawa County Sanitary Sewer Sub-District No. 7 (Danbury Township), No. 13 (AllenIClay
Township),. PortagetCatawba Island and Salem; and
WHEREAS; by Resolution No. 04-95 dated December 30, 2004, the Board of Ottawa County
Commissioners entered into the Agreement for Provision of Wastewater Services in the contract service area
of Erie Township; and
WHEREAS; Section la. of said Agreement for Provision of Wastewater Services recognizes the
Ottawa County Sanitary Sewer District and calls for the Board of Ottawa County Commissioners to create the
Erie Township Sub-District; and
NOW, THEREFORE, BE IT RESOLVED by the Board of Ottawa County Commissioners of the
County of Ottawa, Ohio:
SECTION 1. For the purposes stated above, the Board of Commissioners hereby establish the
Erie Township Sub-District of the Ottawa County Sewer District consisting of the area within Erie Township;
and
SECTION 2. That it is found and determined that all formal actions of this Board of County
Commissioners concerning and relating ro the adoption of this resolution were adopted in an open meeting of
this Board; and that all deliberations of this Board and of any of its committees that resulted in such formal
action, were in meetings open to the public, in compliance with applicable legal requirements of the Ohio
Revised Code; -and
SECTION 3. That a copy of this resolution be certified to the Auditor by the Clerk of the Board
of Ottawa County Commissioners.
