Food Safety Standards In Major Export Markets: A Readymade Guide For Agro Exporters<br />
(a) The CIF value at the time <strong>of</strong> importation <strong>of</strong> the products or when importation can be proven; or<br />
(b) The earliest ascertained price paid for the products <strong>of</strong> undetermined origin in the terri<strong>to</strong>ry <strong>of</strong> the<br />
Member State where the working or processing takes place.<br />
The formula for 40 percent ASEAN content is as follows:<br />
Value <strong>of</strong> Imported Non‐ASEAN Materials Origin Materials, Parts or Produce + Value <strong>of</strong> Undetermined<br />
Origin Materials, Parts or Produce ≤ 60% x 100 FOB Price<br />
DIRECT SHIPMENT PROVISIONS For CEPT<br />
The following shall be considered as consigned directly from the <strong>exporting</strong> Member State <strong>to</strong> the<br />
importing Member State:<br />
(a) If the products are transported passing through the terri<strong>to</strong>ry <strong>of</strong> any other ASEAN country;<br />
(b) If the products are transported without passing through the terri<strong>to</strong>ry <strong>of</strong> any other non‐ ASEAN<br />
country;<br />
(c) The products whose transport involves transit through one or more intermediate non‐ASEAN<br />
countries with or without transshipment or temporary s<strong>to</strong>rage in such countries provided that:<br />
(i) the transit entry is justified for geographical reasons or by consideration related exclusively<br />
<strong>to</strong> transport requirements;<br />
(ii) the products have not entered in<strong>to</strong> trade or consumption there; and<br />
(iii) the products have not undergone any operation there other than unloading and reloading<br />
or any operation required <strong>to</strong> keep them in good condition.<br />
LABELING REQUIREMENTS<br />
A. General Requirements<br />
Language <strong>to</strong> be used<br />
Where the food is produced, prepared or packaged in <strong>Malaysia</strong>, the language <strong>to</strong> be used is<br />
Bahasa <strong>Malaysia</strong> and in the case <strong>of</strong> imported food, the language may be in Bahasa <strong>Malaysia</strong> or<br />
English, and in either case may include translation there<strong>of</strong> in any other language.<br />
Particulars in labeling<br />
1. The appropriate designation <strong>of</strong> the food or a description <strong>of</strong> the food containing the common name<br />
<strong>of</strong> its principle ingredients. ʺAppropriate designationʺ means a name or description, being a<br />
specific, not generic name or description, which shall indicate <strong>to</strong> the prospective purchaser the true<br />
nature <strong>of</strong> the food <strong>to</strong> which it is applied. The lettering on the label shall be so prominent in height,<br />
visual emphasis, and position <strong>to</strong> be conspicuous by comparison with any other matter appearing<br />
on the label.<br />
2. In the case <strong>of</strong> mixed or blended food, words which indicate that the contents are mixed or<br />
blended, as the case may be, and such word shall be conjoined with the appropriate designation<br />
<strong>of</strong> the food, in the following form:<br />
