EXPANDING GLOBAL REMOTE SENSING SERVICES 101supported by <strong>the</strong> General Assembly, and are binding ona very large number <strong>of</strong> States."25 <strong>Nations</strong> continue tocite <strong>the</strong> Principles as authority in domestic, bilateraland multilateral legal documents and in international<strong>for</strong>a.26 Legal commentators from various nations,including key negotiators <strong>of</strong> <strong>the</strong> Principles,27 hold <strong>the</strong>view that <strong>the</strong>y are legally binding as a matter <strong>of</strong>customary law. The space law community continues tocall <strong>for</strong> coordinated remote sensing legislation,28 and, inparticular, to place <strong>the</strong> "issue <strong>of</strong> [<strong>the</strong> Principles']conversion into [a] legally binding instrument" on <strong>the</strong>agenda <strong>of</strong> <strong>the</strong> Legal Subcommittee <strong>of</strong> COPUOS.29The stable, orderly extension <strong>of</strong> global remotesensing services into <strong>the</strong> 21st Century requires <strong>for</strong>mallyrecognizing that <strong>the</strong> Principles are legally accepted.COPUOS ought to be encouraged to fulfill <strong>the</strong> intent <strong>of</strong><strong>the</strong> Principles' drafters30 by transmitting <strong>the</strong>ir terms25 Christol, Carl, Q. The legal process that established <strong>the</strong>Principles, including <strong>the</strong>ir consistent use in settingstandards <strong>for</strong> bilateral and multilateral agreements, and<strong>the</strong>ir unchallenged existence <strong>for</strong> a quarter-centurydemonstrate that <strong>the</strong>ir authority rests on legitimate legalprocess and time.Legal processThe Principles were established according to <strong>the</strong>recognized legal process <strong>of</strong> first drafting generalprinciples and <strong>the</strong>n seeking <strong>for</strong>mal adoption.31 Theywere unanimously adopted as a resolution by <strong>the</strong>General Assembly32 "in con<strong>for</strong>mity with <strong>the</strong> <strong>United</strong><strong>Nations</strong> Charter, fur<strong>the</strong>ring its purposes andprinciples.”33 Resolutions containing a declaration <strong>of</strong>principles are "important tools in <strong>the</strong> process <strong>of</strong>evolving international law."34 They "express a legalconviction" <strong>of</strong> <strong>the</strong> international community concerningremote sensing law and are a particularly "suitable <strong>for</strong>m<strong>for</strong> developing [<strong>the</strong>] international law <strong>of</strong> outer space <strong>for</strong>new, more sophisticated space activities includingremote sensing."35Regarding <strong>the</strong> Principles <strong>the</strong>mselves, <strong>the</strong>y havespecific characteristics that streng<strong>the</strong>n <strong>the</strong>ir status.They begin with five definitions36 which set <strong>the</strong>m apartfrom o<strong>the</strong>r declarations <strong>of</strong> principles and is "clearevidence" <strong>of</strong> <strong>the</strong> intention to establish general regulatory31 Kopal, V., The Role o f <strong>United</strong> <strong>Nations</strong> Declarations o fPrinciples in <strong>the</strong> Progressive Development o f Space Law, 16 J.<strong>of</strong> Space Law 5, at 6.
