Revision <strong>of</strong> UT Martin Traffic <strong>and</strong> Parking Regulations - ActionTHE UNIVERSITY OF TENNESSEEBOARD OF TRUSTEESACTION ITEMDATE: February 28, 2012COMMITTEE:CAMPUS/UNIT:ITEM:RECOMMENDATION:PRESENTED BY:<strong>Finance</strong> <strong>and</strong> <strong>Administration</strong>UT MartinRevision <strong>of</strong> UT Martin Traffic <strong>and</strong> Parking RegulationsApprovalTom Rakes, Chancellor, UT Martin12UT Martin proposes revisions to its Traffic <strong>and</strong> Parking Regulations to allow for a$200 fine for possessing, using, reproducing, or altering a <strong>University</strong> registrationdecal in a manner that would violate state or local law <strong>and</strong> to allow restitution, ifappropriate, to the victim. <strong>The</strong> proposed revisions also provide that <strong>University</strong>students <strong>and</strong> employees may be subject to discipline for the same misconduct underother <strong>University</strong> policies <strong>and</strong> procedures. <strong>The</strong> current Regulations follow thismemor<strong>and</strong>um, <strong>and</strong> the proposed revisions appear on page 4 <strong>of</strong> the Regulations.<strong>The</strong> proposed revisions are the result <strong>of</strong> a request by local <strong>of</strong>ficials that <strong>of</strong>fenders beh<strong>and</strong>led through the <strong>University</strong> rather than the Weakley County court system.<strong>The</strong> Tennessee Uniform Administrative Procedures Act requires that regulations likethis be promulgated under the formal rulemaking provisions <strong>of</strong> the Act. Afterapproval by the <strong>Board</strong> <strong>of</strong> <strong>Trustees</strong>, the proposed revisions will be submitted to theState Attorney General for approval as to legality <strong>and</strong> subsequently published in theSecretary <strong>of</strong> State’s monthly administrative register prior to becoming effective.MOTION:That the proposed revisions to the UT Martin Traffic <strong>and</strong> Parking Regulations beapproved.227
