STATE LAWS RELATED TO AIRPORT LAND USE PLANNINGAPPENDIX ACALIFORNIA ENVIRONMENTAL QUALITY ACT STATUTESPUBLIC RESOURCES CODEDivision 13—Environmental QualityChapter 2.6—General(excerpts)21096. <strong>Airport</strong> <strong>Plan</strong>ning(a) If a lead agency prepares an environmental impact report for a project situated within airportcomprehensive land use plan boundaries, or, if a comprehensive land use plan has not beenadopted, for a project within two nautical miles of a public airport or public use airport, the<strong>Airport</strong> <strong>Land</strong> <strong>Use</strong> <strong>Plan</strong>ning Handbook published by the Division of Aeronautics of theDepartment of Transportation, in compliance with Section 21674.5 of the Public Utilities Codeand other documents, shall be utilized as technical resources to assist in the preparation of theenvironmental impact report as the report relates to airport-related safety hazards and noiseproblems.(b) A lead agency shall not adopt a negative declaration for a project described in subdivision (a)unless the lead agency considers whether the project will result in a safety hazard or noise problemfor persons using the airport or for persons residing or working in the project area.<strong>MCAS</strong> <strong>Miramar</strong> <strong>Airport</strong> <strong>Land</strong> <strong>Use</strong> <strong>Compatibility</strong> <strong>Plan</strong> (Adopted October 2008) A–33
