AIRPORT LAND USE COMMISSION POLICIES CHAPTER 2(b)Nonconforming residential uses may be rebuilt provided that the reconstruction doesnot result either in more dwelling units than existed on the parcel at the time of thedamage or, for multi-family residential uses, an increase in the floor area of the building,or the height of the structure. Addition of a secondary dwelling unit to a single-familyresidence is permitted if in accordance with state law.(c) A nonconforming nonresidential development may be rebuilt provided that thereconstruction does not increase the floor area of the previous structure or result in anincreased intensity of use (i.e., more people per acre).(d) Reconstruction under Paragraphs (b) or (c) above must have a permit deemed completeby the local agency within twenty-four (24) months of the date the damage occurred.(e) Nothing in the above policies is intended to preclude work required for normalmaintenance and repair.2.11.4 Development by Right:(a) Except as specifically provided below, all policies provided in this <strong>Compatibility</strong> <strong>Plan</strong>shall apply to development by right.(b) Nothing in these policies prohibits:(1) Other than in the CZ, construction of a single-family home, including a secondunit as defined by state law, on a legal lot of record if such use is permitted bylocal land use regulations.(2) Construction of other types of uses if local government approvals qualify thedevelopment as an existing land use (see Policy 2.2.18 for definition).(3) Lot line adjustments provided that new developable parcels would not be createdand the resulting density or intensity of the affected property would not exceedthe applicable criteria indicated in the Table MIR-2 of Chapter 3.<strong>MCAS</strong> <strong>Miramar</strong> <strong>Airport</strong> <strong>Land</strong> <strong>Use</strong> <strong>Compatibility</strong> <strong>Plan</strong> (Adopted October 2008 Amended December 2010) 2–21
