CHAPTER 2AIRPORT LAND USE COMMISSION POLICIESagency must provide a copy of the proposed decision and findings to both the ALUC andDivision of Aeronautics at least 45 days prior to taking action to overrule. The ALUC and Divisionof Aeronautics then have 30 days in which to respond to the local agency with their writtencomments. (Pub. Util. Code, §21676.5(a).) The ALUC may authorize the ALUC staff torespond as appropriate. The comments of the Division of Aeronautics and ALUC are advisory,but must be made part of the record of final decision to overrule the ALUC.2.10.4 Subsequent Review: Even after a project has been found consistent or conditionally consistent withthe <strong>Compatibility</strong> <strong>Plan</strong>—whether as part of a general plan change, zoning amendment, othermandatory-review action, or as a prior action related to the same project—it may still need to besubmitted for review at subsequent stages of the planning process if any of the following aretrue:(a) At the time of the original ALUC review, the project information available only wassufficient to determine consistency with compatibility criteria at a planning level ofdetail, not at the project design level. For example, the proposed land use designationindicated in a general plan, specific plan, or zoning amendment may have been foundconsistent, but information on site layout, maximum intensity limits, building heights,and other such factors that may also affect the consistency determination for a projectmay not have yet been known.(b) The design of the project subsequently changes in a manner that affects previouslyconsidered compatibility issues and could raise questions as to the validity of the earlierfinding of consistency. Proposed changes warranting a new review may include, but arenot limited to, the following:(1) An increase in the number of dwelling units or intensity of use (more people onthe site);(2) Any cumulative increase in the total building area or lot coverage for nonresidentialuses in excess of 10% of the previous project;(3) An increase in the height of structures which has been deemed a hazard by theFAA; and/or(3) Major site design changes (such as incorporation of clustering or modifications tothe configuration of open land areas proposed for the site).(c) The local agency concludes that further review is warranted.(d) At the time of original ALUC review, conditions are placed on the project that requiresubsequent ALUC review.2.11 SPECIAL COMPATIBILITY CONDITIONS2.11.1 Infill: Where land uses not in conformance with the criteria set forth in this <strong>Compatibility</strong> <strong>Plan</strong>exist at the time of the plan's adoption, infill development of similar land uses may be allowed tooccur in that area even if the proposed new land use is otherwise incompatible within thefactor/layer involved.(a) Except as specifically provided below, all policies provided in this <strong>Compatibility</strong> <strong>Plan</strong>shall apply to infill.(b) Infill is/is not permitted in the following locations.2–18 <strong>MCAS</strong> <strong>Miramar</strong> <strong>Airport</strong> <strong>Land</strong> <strong>Use</strong> <strong>Compatibility</strong> <strong>Plan</strong> (Adopted October 2008 Amended December 2010)
