from the list of illustrated st<strong>and</strong>ards the one best suited to his project,<strong>and</strong> shall be responsible for the cost of constructing the selectedst<strong>and</strong>ard.If, however, the soils upon which the street is to be constructed poseconstraints to street <strong>development</strong>, the <strong>County</strong> Engineer will require aGeotechnical Engineer to evaluate the soils <strong>and</strong> prepare arecommendation as to what would be required to ensure that thesubbase would be adequate. If the Geotechnical Engineerdetermines that the existing conditions are adequate, then the<strong>County</strong> will pay the costs of testing <strong>and</strong> if the conditions are requiredto be modified, then the costs will be incurred by the developer orcontractor.15. Street WarrantyAs a condition of receiving Final Plat Approval, the developer orother responsible party shall enter into an agreement with<strong>Spartanburg</strong> <strong>County</strong> to repair, upon written notification by the <strong>County</strong><strong>and</strong> at his own expense any <strong>and</strong> all defects in materials <strong>and</strong>workmanship which occur in any streets or drainage systemspursuant to the granting of Final Plat Approval for a period of oneyear from the date such work is accepted by <strong>Spartanburg</strong> <strong>County</strong><strong>and</strong> the Final Plat is recorded in the office of the Register of Deeds.Section 2.05-3Private Road Development in Minor (Residential) SubdivisionsThe <strong>development</strong>, use <strong>and</strong> maintenance of private streets <strong>and</strong> roads in<strong>Spartanburg</strong> <strong>County</strong> shall be governed by the following.Private streets in a Private Road Development shall:a. Have a maximum eight (8) lots with one (1) dwelling unit per lot;b. Have a cleared forty (40) foot right-of-way;c. Have a sixteen (16) foot wide driving surface with four (4) inchcompacted stone base <strong>and</strong> height clearance of 13.5 feet. SeeAppendix B for detail;d. Be maintained by a homeowner's association provided for by deedrestrictions;e. Be certified for compliance by a Civil Engineer or Tier B Surveyor,see Certificate of Compliance in appendix;2-61
