from the list of illustrated standards the one best suited to his project,and shall be responsible for the cost of constructing the selectedstandard.If, however, the soils upon which the street is to be constructed poseconstraints to street development, the County Engineer will require aGeotechnical Engineer to evaluate the soils and prepare arecommendation as to what would be required to ensure that thesubbase would be adequate. If the Geotechnical Engineerdetermines that the existing conditions are adequate, then theCounty will pay the costs of testing and if the conditions are requiredto be modified, then the costs will be incurred by the developer orcontractor.15. Street WarrantyAs a condition of receiving Final Plat Approval, the developer orother responsible party shall enter into an agreement withSpartanburg County to repair, upon written notification by the Countyand at his own expense any and all defects in materials andworkmanship which occur in any streets or drainage systemspursuant to the granting of Final Plat Approval for a period of oneyear from the date such work is accepted by Spartanburg Countyand the Final Plat is recorded in the office of the Register of Deeds.Section 2.05-3Private Road Development in Minor (Residential) SubdivisionsThe development, use and maintenance of private streets and roads inSpartanburg County shall be governed by the following.Private streets in a Private Road Development shall:a. Have a maximum eight (8) lots with one (1) dwelling unit per lot;b. Have a cleared forty (40) foot right-of-way;c. Have a sixteen (16) foot wide driving surface with four (4) inchcompacted stone base and height clearance of 13.5 feet. SeeAppendix B for detail;d. Be maintained by a homeowner's association provided for by deedrestrictions;e. Be certified for compliance by a Civil Engineer or Tier B Surveyor,see Certificate of Compliance in appendix;2-61
