3. This section shall apply only to legally-recorded conforming <strong>and</strong> nonconforminglots of record that were created prior to October 21, 2002.4. The total number of lots (parcels) resulting from this division of the originallot of record under this section of the ULMO shall not exceed three (3).Any remainder parcel is included in this total. (Amended 07/19/2004)5. Division of lots located in private road <strong>development</strong>s shall not be allowedunder this section.6. ANY <strong>and</strong> ALL plats approved under the Family Property Section of theULMO must contain the statement “THIS LOT (THESE LOTS) SHALLNOT BE FURTHER SUBDIVIDED UNTIL IT (THEY) CAN MEET ALLREQUIREMENTS OF SECTION 2.05 OF THE UNIFIED LANDMANAGEMENT ORDINANCE.” Deeds must make reference to the plat.The owner(s) of any remainder lot shall execute a Family PropertyRestriction (See Appendix G) form that acknowledges that the owner(s)knows that he/she is placing his property under such requirements,contains a legal description of the property, <strong>and</strong> makes reference to theplat. This document must be recorded with the plat <strong>and</strong> deed(s) for theconveyed lot(s). Any subsequent resurveys of any lot approved underFamily Property must also contain this language unless it meets therequirements of section 2.05 – Subdivisions. (Amended 07/19/2004)7. Only one residential structure will be allowed on each resulting lot.8. Any property divided under the provisions of this section will be subject toall setback requirements of Table 3.Section 2.07-2 Options for the Division of Family PropertyIf the requirements of Section 2.07-1 are met, the division of family property shallbe accomplished in the following manner:Option 1An initial lot of record with forty (40) or more feet of road frontage on a publiclymaintained road may be split into family lots with frontage of at least twenty (20)feet each, without regard to a maximum flag length. A three-lot maximum will beallowed if there is sixty (60) feet of frontage. All frontage, including the flags inflag lots, must be referenced in the deeds <strong>and</strong> the Family Property Restrictionform (See Appendix G). Any common driveway must be shown on the plat as aningress-egress easement to the publicly maintained road <strong>and</strong> this perpetualeasement that runs with the l<strong>and</strong> must be referenced in all deeds.
