7. FULL SETTLEMENT(1) Th<strong>is</strong> Agreement shall be a full and complete settlement of allclaims by <strong>the</strong> Union as of <strong>the</strong> date of th<strong>is</strong> Agreement relating <strong>to</strong>all terms and conditions of employment within <strong>the</strong> scope of th<strong>is</strong>Agreement.(2) During <strong>the</strong> currency of th<strong>is</strong> Agreement, nei<strong>the</strong>r party shall modifyor annul any of <strong>the</strong> prov<strong>is</strong>ions of th<strong>is</strong> Agreement in any waywhatsoever save as <strong>is</strong> provided herein or by operation of law andnei<strong>the</strong>r party shall seek <strong>to</strong> implement any such change beforehaving duly varied th<strong>is</strong> Agreement.(3) The parties agree that if any part of th<strong>is</strong> Agreement <strong>is</strong> orbecomes contrary <strong>to</strong> any applicable law, such part shall beamended so as <strong>to</strong> comply with <strong>the</strong> law without in any wayaffecting <strong>the</strong> o<strong>the</strong>r parts of th<strong>is</strong> Agreement that are not contrary<strong>to</strong> <strong>the</strong> law. The effective date of any such amendment shall becoincident with <strong>the</strong> date of <strong>the</strong> law coming in<strong>to</strong> force.8. GRIEVANCE PROCEDURE(1) PurposeRecogn<strong>is</strong>ing <strong>the</strong> value and importance of full d<strong>is</strong>cussion inclearing up m<strong>is</strong>understandings and preserving harmoniousindustrial relations, every reasonable effort shall be <strong>made</strong> by <strong>the</strong>Polytechnic and <strong>the</strong> Union <strong>to</strong> resolve any grievance or complaintfrom employees at <strong>the</strong> lowest possible level.(2) Definition of Grievance(a) A grievance for <strong>the</strong> purpose of th<strong>is</strong> clause shall be a formalcomplaint lodged in <strong>the</strong> manner herein provided in respec<strong>to</strong>f industrial matters.(b) “Industrial matters” means matters pertaining <strong>to</strong> <strong>the</strong>relations of employer and employees which are connectedwith <strong>the</strong> employment or non-employment or <strong>the</strong> terms ofemployment or <strong>the</strong> conditions of work of any person.CA 75 of 2011 Page 3 of 61Ngee Ann Polytechnic Academic Staff Agreement, 2011ASCA( NC 290711)
