UNION FUNCTIONThe Polytechnic recognises the Union as the sole collectivenegotiating body in respect of all terms and conditions of employmentof employees within the scope of this Agreement and in accordancewith the Industrial Relations Act. The Polytechnic also recognises thatit is the function of the Union to make representation in any omissionof the Polytechnic which in the opinion of the Union, is contrary to orwhich diminishes the value of the provisions of this Agreement and tobargain for its members within the scope of this Agreement concerningsuch terms and conditions of employment.6. NON-UNION MEMBERSEmployees within the scope of this Agreement and who are notmembers of the Union shall not receive terms and conditions morefavourable than those conferred on the union members under thisAgreement. 7. FULL SETTLEMENT(1) This Agreement shall be a full and complete settlement of allclaims by the Union as of the date of this Agreement relating toall terms and conditions of employment within the scope of thisAgreement.(2) During the currency of this Agreement, neither party shall modifyor annul any of the provisions of this Agreement in any waywhatsoever save as is provided herein or by operation of law andneither party shall seek to implement any such change beforehaving duly varied this Agreement.(3) The parties agree that if any part of this Agreement is orbecomes contrary to any applicable law, such part shall beamended so as to comply with the law without in any wayaffecting the other parts of this Agreement that are not contraryto the law. The effective date of any such amendment shall becoincident with the date of the law coming into force.8. GRIEVANCE PROCEDURE(1) PurposeRecognising the value and importance of full discussion inclearing up misunderstandings and preserving harmoniousindustrial relations, every reasonable effort shall be made by thePolytechnic and the Union to resolve any grievance or complaintfrom employees at the lowest possible level.(2) Definition of Grievance(a) A grievance for the purpose of this clause shall be a formalcomplaint lodged in the manner herein provided in respectof industrial matters.(b) “Industrial matters” means matters pertaining to therelations of employer and employees which are connectedwith the employment or non-employment or the terms ofemployment or the conditions of work of any person.CA 75 of 2011 Page 3 of 61Ngee Ann Polytechnic Academic Staff Agreement, 2011ASCA( NC 290711)
