How to File a CDP Request • Complete and Sign Form 12153. • Include Cover Letter and Form 2848. • File within 30 days of Notice. There are no extensions. • If the hearing request is filed late, the taxpayer may be entitled to an equivalent hearing but only if specifically requested. (i.e. always check off EH Box ) – EH must be filed 1 year from date of notice. – EH determinations are not appealable to US Tax Court 25 How to File a CDP Request (cont’d) • If the taxpayer received both a lien and levy notice, both actions may be appealed. • The requests should be consolidated for the CDP hearing. • Taxpayer is allowed only one hearing per taxable period. 26 195
