By: Rana Goodman / On My Soapbox It seems like just yesterday that I completed my 18-month service on the first Nevada Guardianship Commission. It’s Chairman was James Hardesty who, at that time was chief justice of Nevada’s Supreme Court. The commission consisted of attorneys, judges, a senior advocate and two journalists, one from Reno and yours truly. At every meeting, people who had been victims of guardianship were invited to speak to the commission and tell their experiences. One in particular, a young wheelchair bound man, told the commission that one of the attorneys sitting on the commission had sold his home, out from under him to benefit the guardian. To put it bluntly, every victim, or person speaking on their behalf told “gut wrenching” tales that often had some of the commission members (but never the attorneys) in tears. For more information and to RSVP, contact The Vegas Voice at: 702/251-4441 or www.thevegasvoice.net However, when the “permanent” commission was formed, I was shocked to learn that the group chosen to serve were several attorneys, and judges who had served originally. There were no senior advocates nor were there any journalists who could make sure the public knew what was happening. I hoped and believed that the commission would serve as a lifeline for our seniors caught in the guardianship trap. Sadly, that has not been the case. One of the judges on the commission, Linda Marque, presided over a case last year of a very well know, active Sun City resident whose children wanted to remove their mother from her home. The children, after many hearings, got their way. Mom was involuntarily moved away from her friends and placed into an assisted living facility in California. As you can imagine it was against her (and her numerous friends willing to testify) very vocal objections. Beyond tragic. Oh, but not a total loss. The attorneys made a ton of money. As I wrote last month, the danger to our seniors these days are not coming from private guardians as they were a couple of years ago. Now it is from their own families and in some cases, rivalry between children or siblings. And what is the Guardianship Commission doing to protect our rights and dignity? Not a damn thing, but don’t worry, the lawyers and judges on the commission are doing just fine. I have to admit Publisher Dan is correct on one point – the guardianship court system is not broken, but “fixed.” You need to protect yourself and not become a victim. If you have not filed a guardianship nomination form, PLEASE do so. There is no cost involved other than a postage stamp. Some people say, “I don’t need one, I have named my guardian in my trust” Well, think about this - no one will see your trust until it is too late. As I have pointed out many times, if someone files with the court to be your guardian, how does the judge know what’s in your trust? Once you have filed the nomination form, should someone come along and try to take guardianship of you, the first thing the court MUST do is call the Secretary of State’s office and ask if you have filed a nomination form. If you have…..CASE OVER! Your wishes must be followed. Since the nomination form was passed into law more than 5,000 have been filed by our seniors.
