fraud, fraud involving welfare payments, computer fraud <strong>and</strong> breaching of<br />

trust/embezzlement were concepts not separately identifiable in criminal law.<br />

5. Conclusions<br />

Fraud was a new offence to be included in the questionnaire. As the results on<br />

definitions <strong>and</strong> data availability show, the definition proved to be useful <strong>and</strong> was<br />

met by most countries. Data availability was excellent. The results of the subsidiary<br />

questionnaire also helped to show that the suggested definition reflects the<br />

legal <strong>and</strong> statistical situation in most countries as good as possible. Fraud will<br />

therefore definitely be covered in future editions of the ESB, too. The definition<br />

will be kept.<br />
