1. First steps <strong>and</strong> development of draft definitions <strong>and</strong><br />

questions<br />

One conclusion at the beginning was that there is a need for data on pre-trial detention<br />

<strong>and</strong> detainees <strong>and</strong> other related data, starting at the prison level <strong>and</strong> going<br />

back in the criminal justice process:<br />

- conviction level: number of persons held in pre-trial detention before conviction,<br />

by type of offence<br />

- prosecution level: see if data exists at this level, maybe for the total of offences<br />

- police level: how many people are submitted to some form of police custody<br />

One question was whether the ESB should also include confiscation measures,<br />

telephone taps etc. The group decided members should look if these data are accessible<br />

in their respective countries <strong>and</strong> where these can be found.<br />

The improvements in SPACE 51 European data collection <strong>and</strong> in particular in<br />

the tables giving the breakdown of prison population by legal status (SPACE<br />
