Come per le precedenti due edizioni, la linea
guida è stata sottoposta al Ministero di Giustizia
per valutarne l’idoneità a prevenire i reati:
un caso unico nel panorama delle linee guida
realizzate da associazioni di categoria. Il Ministero,
in data 2 gennaio 2024, a seguito della
richiesta formulata da Assofond, ha comunicato
quanto segue:
«RIFERIMENTO: Codice di Comportamento
ASSOFOND aggiornato, pervenuto al prot.
DAG n. 243044.E del 4-12-2023 - Con riguardo
al documento indicato in riferimento
(n.d.r.: Linee Guida Assofond, 3 a edizione
dicembre 2023) si comunica che il Codice di
Comportamento trasmesso da codesta Associazione
è stato giudicato idoneo ai sensi e per
gli effetti dell’art. 6, comma 3 1 , D.lgs. 8 giugno
2001, n. 231, offrendo adeguato supporto per
la predisposizione di modelli di organizzazione
e gestione da parte delle imprese associate.»
L’auspicio dell’associazione è che la linea guida
Assofond possa essere di utilità per le fonderie
nella costruzione di un modello organizzativo e
gestionale che non rappresenti una mera “apparenza”
di organizzazione, ma che possa essere
invece un reale strumento di prevenzione
dei reati capace anche, ove malauguratamente
se ne presentasse la necessità, di esonerare
l’impresa da qualsiasi responsabilità. •

the Italian Legislative Decree no. 231/01, protects
the Whistleblower, namely the person who
reports the offence committed within a public or
private organisation, from any retaliation.
Like for the previous two editions, the guidelines
have been put to the Ministry for Justice
to assess their suitability to prevent offences:
a singular case in the panorama of guidelines
created by trade associations. The Ministry, on
2 January 2024, following the request put forward
by Assofond, made the following communication:
“RE: Updated ASSOFOND Code of Conduct, received
at prot. DAG no. 243044.E of 4-12-2023
- With regard to the document indicated in the
reference (-Ed.: Assofond Guidelines, 3rd edition
December 2023) we inform you that the Code
of Conduct transmitted by the said Association
has been deemed suitable pursuant to and for
the purposes of art. 6, paragraph 3 1 , Italian Legislative
Decree no. 231 of 8 June 2001, offering
adequate support for the preparation of organisational
and management models by member
companies”.
The association hopes that the Assofond guidelines
may be useful to foundries in creating an
organisational and management model that is
not the mere “appearance” of organisation, but
can instead be a real crime prevention tool that
can also, should the need arise, exonerate the
company from any liability. •

organizzazione e di gestione possono essere adottati, garantendo
le esigenze di cui al comma 2, sulla base di codici di
comportamento redatti dalle associazioni rappresentative

adopted, guaranteeing the requirements set forth in paragraph
2, on the basis of codes of conduct drafted by associations
representing organisations, communicated to the Ministry
for Justice which, together with the competent Ministries,
may, within thirty days, formulate observations regarding the
suitability of the models to prevent offences”.
