Theoretical and practical appreciation<br />

on the juridical teaching<br />

ABSTRACT<br />

This article examines juridical teaching and the possible<br />

changes to be made in the list of subjects offered in<br />

Brazilian Law schools, setting as a starting point the<br />

assessment of the juridical positivism and its ideological<br />

commitment with the model presently in force. The<br />

author suggests that Law should be studied based upon the<br />

investigation of its sources, not to mention the necessity of<br />

jurists to critically analyse positive Law, in order to rebuild<br />

juridical knowledge. At the end, the author tackles the<br />

issues concerning the propaedeutical subjects, whether or<br />

not compulsory, and the duration of the Law course.<br />

CONSIDéRATIONS THéORIQUES ET PRATI-<br />

QUES SUR L’ENSEIGNEMENT JURIDIQUE<br />

RÉSUMÉ<br />

Le présent article aborde l’enseign<strong>em</strong>ent juridique et les<br />

éventuelles modifications et réformes du programme des<br />

facultés brésiliennes, à partir de l’analyse de la dogmatique<br />

positiviste et de son engag<strong>em</strong>ent idéologique avec l’actuel<br />

modèle en vogue. L’auteur suggère une étude du droit basée<br />

dans l’examen de leurs sources, sans oublier une analyse<br />

critique du droit positif, en vue de la reconstruction du<br />

savoir juridique. Final<strong>em</strong>ent, l’auteur aborde les disciplines<br />

propédeutiques, obligatoires et en option, des cours de<br />

droit, ainsi qu’à de durée idéale de cette formation.<br />
