Consular Information Units<br />

SENSITIVE BUT UNCLASSIFIED<br />

Each of the five posts in <strong>India</strong> has a consular information unit that provides essential<br />

services in responding to case inquiries on NIVs <strong>and</strong> immigrant visas (IV). They organize<br />

outreach activities <strong>and</strong> help manage the Web sites. The <strong>OIG</strong> team was impressed with the energy<br />

<strong>and</strong> creativity in all the teams but believes that CTI would gain efficiencies by centralizing many<br />

of these functions. Among other things, a countrywide CTI would be able to manage a unified<br />

NIV appointment system, including an emergency appointment system, <strong>and</strong> maintain Web sites.<br />

Each post would still have responsibility for outreach programs.<br />

Given that a significant part of the work of a centralized consular information unit would<br />

be answering case inquiries on IV work, the MCCA should place such a centralized function in<br />

<strong>Embassy</strong> <strong>New</strong> <strong>Delhi</strong> or Consulate General Mumbai, depending on which post will house a<br />

consolidated IV operation.<br />

Recommendation 20: <strong>Embassy</strong> <strong>New</strong> <strong>Delhi</strong> should centralize the consular information unit<br />

functions to the extent possible, including managing a unified nonimmigrant visa appointment<br />

system, an emergency appointment system, <strong>and</strong> consistent Web sites, at either Consulate General<br />

Mumbai or <strong>Embassy</strong> <strong>New</strong> <strong>Delhi</strong>. (Action: <strong>Embassy</strong> <strong>New</strong> <strong>Delhi</strong>)<br />

The consular information unit in Chennai is not using the call center in <strong>New</strong> <strong>Delhi</strong> for<br />

answering routine phone calls <strong>and</strong> routine emails. This is an unnecessary use of LE staff time.<br />

Chennai is the only post in <strong>India</strong> that is not using the call center for this purpose. This situation<br />

needs to be corrected.<br />

Recommendation 21: <strong>Embassy</strong> <strong>New</strong> <strong>Delhi</strong> should coordinate with Consulate General Chennai<br />

so that the call center in <strong>New</strong> <strong>Delhi</strong> will respond to all routine phone calls <strong>and</strong> emails for<br />

Chennai as it does for the other posts in <strong>India</strong>. (Action: <strong>Embassy</strong> <strong>New</strong> <strong>Delhi</strong>)<br />

Temporary Worker (H1B) <strong>and</strong> Intracompany Transferee (L) visas<br />

Some of the most complicated NIV cases involve L (intracompany transferee) <strong>and</strong> H<br />

(temporary worker) visas. Mission <strong>India</strong> processes more such cases than any other mission in the<br />

world. Many involve applicants who work in the information technology sector. Because the law<br />

is complex, consular officers need more time to adjudicate such cases <strong>and</strong> need to exchange<br />

ideas with their colleagues who are working on similar cases. Officers must refuse applicants<br />

who do not meet the qualifications under the law. Because the applicants apply based on<br />

petitions that were approved by the Department of Homel<strong>and</strong> Security, consular officers must<br />

request that department to revoke the petitions. These revocation requests are complicated <strong>and</strong><br />

time-consuming. LE staff members currently help the officers to prepare the basic outlines for<br />

these requests. <strong>Embassy</strong> <strong>New</strong> <strong>Delhi</strong> could use its large pool of qualified eligible family members<br />

(EFM) to write revocation requests for H <strong>and</strong> L visa petitions for the mission. This procedure<br />

would save considerable officer time.<br />

Recommendation 22: <strong>Embassy</strong> <strong>New</strong> <strong>Delhi</strong> should centralize writing requests for revocation of<br />

H <strong>and</strong> L visa petitions for all posts in <strong>India</strong> at the embassy, using eligible family members for<br />

this work. The consular officers who adjudicate the individual cases should provide their case<br />
