that no direct statutory safeguard <strong>of</strong> this nature is possible. The other possibility is that the Governor in<br />
his discretion should set apart funds and that these funds should be outside the vote <strong>of</strong> the legislature.<br />
We feel that such a provision is likely to be repugnant to the provincial legislature.<br />
We recommend however that the revenues derived from and the expenses incurred on the Scheduled<br />
Areas from the provincial budget should be shown separately so as to prevent the needs <strong>of</strong> these areas<br />
being overlooked through incorporation in the general items Such a separate statement will <strong>of</strong> course<br />
afford a better opportunity for scrutiny and criticism.<br />
19. GOVERNOR'S RESPONSIBILITY -<br />
In connection with financial safeguards the view was expressed that the formulation <strong>of</strong> a plan <strong>of</strong><br />
improvement affords sufficient guarantee for the expenditure <strong>of</strong> funds .We are <strong>of</strong> the view that in the<br />
provisions corresponding to the Instrument <strong>of</strong> Instructions the Governor should be required to see that a<br />
suitable scheme <strong>of</strong> development is drawn up and implemented as far as possible (See Para. *17)<br />

20. TRIBAL MINISTER -<br />
Connected with the formulation <strong>of</strong> development schemes and the provision <strong>of</strong> adequate expenditure<br />
for the hill tracts is the need for the appointment <strong>of</strong> a separate Minister to give effect to the plans and to<br />
look after the interests <strong>of</strong> the aboriginals. The tribal population in the C. P., Orissa and Bihar forms a<br />
considerable proportion <strong>of</strong> the total population and on this ground alone the tribals have a case for<br />
representation in the Provincial Government. In the C. P., the tribal population is nearly 18 per cent. In<br />
Orissa, almost a fifth <strong>of</strong> the population is tribal, and in Bihar there are over 5 millions <strong>of</strong> them<br />
constituting about 14 per cent. Partly in order to provide representation for the tribals and in any case to<br />
see that adequate attention is paid to their administration we are <strong>of</strong> the view that there should be a<br />
separate Minister for the tribal areas and tribes in C. P., Orissa and Bihar and that this should be<br />
provided by statute. The Minister should be a tribal himself unless a suitable person cannot be found. We<br />
may add that the Government <strong>of</strong> Orissa have recognised that there should be a separate portfolio for the<br />
welfare <strong>of</strong> the backward classes under the new constitution.<br />
21. SERVICES -<br />
It has been pointed out that the tribals constitute an appreciable proportion <strong>of</strong> the population<br />
particularly in some Provinces. On this account, the policy <strong>of</strong> recruitment <strong>of</strong> a due proportion <strong>of</strong><br />
aboriginals having regard to reasonable efficiency, into the Government services is justified and<br />
necessary and must be followed. Apart from this, however, it is necessary that there should be an<br />
adequate number <strong>of</strong> tribals in the services so that the constant complaints <strong>of</strong> mishandling by non-tribal<br />
Officials, particularly, <strong>of</strong> such servants as forest guards, constables or excise peons and clerks can be<br />
minimized. Moreover, it is only by adequate representation in the Government and local bodies' services<br />
that the tribal can gain the necessary confidence and status.<br />
We do not consider that a separate service <strong>of</strong> tribal people is necessary or desirable for the Scheduled<br />
Areas, and we recommend that they should be recruited to a general cadre. This will enable them to<br />
come into contact with non-tribes people and we also consider that there is no objection to the posting <strong>of</strong>
