appearance of the AONB. The presence of the designation does not negate<br />

many forms of development in the area. Indeed, it is vital that planning<br />

decisions are made with regard to the economic and social well being and<br />

needs of communities within the AONB. The challenge is to accommodate<br />

development to meet the economic and social needs of local communities<br />

whilst conserving and enhancing the landscape - which is itself a<br />

fundamental economic, social and environmental resource.<br />

4.2.10. Proposals for development within the AONB or affecting its setting will be<br />

determined, therefore, against any Policy in the <strong>Plan</strong> which is specific to the<br />

type of development proposed including GD1 and GD2, together with this<br />

Policy.<br />

4.2.11. In accordance with national planning guidance on development within<br />

protected landscapes such as the AONB’s (PPG7), t The siting of major<br />

development within the AONB will only be allowed in exceptional<br />

circumstances. is considered inconsistent with the aims of the designation.<br />

Such development may include, for example, waste disposal facilities, mineral<br />

working, major road development or generally major development proposals<br />

which are more national than local in character. Proposals for such<br />

development will be subject to rigorous examination because of the serious<br />

impact they can have on the landscape and will only be permitted where it can<br />

be demonstrated that a proposal is in the national interest and cannot be<br />

accommodated outside of the area.<br />

4.2.12. The ability to undertake certain forms of development without the need for<br />

planning permission (permitted development) is permitted within the AONB.<br />

However, if it is considered that the special qualities of the landscape are<br />

being adversely affected and require additional protection from types of<br />

permitted development, the <strong>Council</strong> will use its powers under Article 4(2) of the<br />

General Permitted Development Order (1995) to withdraw certain specified<br />

classes of Permitted Development. These may include, for example,<br />

Agricultural or Residential Permitted Development Rights.<br />

POLICY ENV3 SITES OF INTERNATIONAL IMPORTANCE FOR<br />

NATURE CONSERVATION<br />

Proposals for development which may affect a designated or candidate<br />

Special Area of Conservation will be subject to the most rigorous<br />

examination.<br />

Development which would have an adverse effect or which would result<br />

in an unacceptable risk of an adverse effect on the integrity of a site will<br />

not be permitted unless:<br />

a) there are imperative reasons of over-riding public interest for the<br />

development; and<br />

b) the <strong>Council</strong> is satisfied that there are no reasonable alternative sites<br />

or solutions to accommodate the development proposed.<br />

Where a proposed location hosts a priority natural habitat type and/or<br />

priority species, development which would have an adverse effect on the<br />

integrity of the site will not be permitted unless it can be demonstrated<br />

to be necessary for reasons of human health or public safety or have<br />

beneficial consequences of primary importance for nature conservation.<br />
