4.3.24. Potentially contaminated land includes those sites where former or current use<br />

may cause significant harm, or have the possibility of causing significant harm<br />

to human health or cause the pollution of controlled waters or the potential to<br />

cause pollution of controlled waters. “The Department of Environment Industry<br />

Profiles” and “Public Registers of Land which may be Contaminated”<br />

Consultation Paper May 1991, gives guidance on those types of industrial use<br />

which would be considered potentially contaminated land.<br />

4.3.25. The <strong>Council</strong> has a duty to inspect the <strong>District</strong> for contaminated land. “The<br />

Public Register of Contaminated Land” is a Register of sites designated as<br />

Contaminated Land, where enforcement action is to be taken to ensure<br />

appropriate remedial measures are completed. The Register is maintained by<br />

the <strong>Council</strong> and is available for public inspection at the Civic Centre in<br />

Pershore.<br />

4.3.26. Unstable land, and more particularly subsidence, is an issue in the <strong>District</strong><br />

along the old salt runs in and around Droitwich Spa. The areas affected by<br />

subsidence are constantly changing through natural processes, but<br />

information regarding specific sites may be obtained from the <strong>Council</strong>’s<br />

Building Consultancy Unit. The presence of unstable land does not<br />

necessarily mean that development cannot take place. An appraisal will be<br />

required to ascertain whether remedial measures could overcome the<br />

instability to prevent risk of harm to human health and the general<br />

environment.<br />

POLICY ENV22 DEVELOPMENT INVOLVING HAZARDOUS<br />

SUBSTANCES<br />

Proposals that would involve the presence of hazardous substances or<br />

proposals involving the storage and use of hazardous substances will<br />

not be permitted if the proposal:<br />

a) poses an unacceptable level of risk to the public or the natural<br />

environment;<br />

b) cannot provide adequate emergency access to the site and adjoining<br />

areas of human activity that potentially may be affected; or<br />

c) will seriously prejudice the development of neighbouring land.<br />

POLICY ENV23 DEVELOPMENT CLOSE TO HAZARDOUS<br />

INSTALLATIONS AND PIPELINES<br />

Within the defined consultation zone of a hazardous installation or<br />

pipeline, development will only be permitted if the development and its<br />

uses will not be subject to an unacceptable risk of an accident from the<br />

installation or the pipeline.<br />

4.3.27. Certain manufacturing and other processes use substances defined under The<br />

<strong>Plan</strong>ning (Hazardous Substances) Act 1990, are considered to be a risk to<br />

human health. This can be due to their toxicity or reactive nature. Hazardous<br />

Substance Consent needs to be obtained for the use or storage of such<br />
