substances above certain quantities. In addition, planning permission may be<br />

required for development involving hazardous substances.<br />

4.3.28. The development of hazardous installations and the storage and use of<br />

hazardous substances must not increase the risks to persons in the area, the<br />

wider community or the environment to an unacceptable degree. The <strong>Council</strong><br />

will aim to keep hazardous installations and substances separate from land<br />

uses with which they may be incompatible (<strong>Plan</strong>ning (Control of Major<br />

Accident Hazards) Regulations 1999).<br />

4.3.29. Where hazardous installations exist, the Health and Safety Executive (HSE)<br />

are responsible for notifying consultation zones around such sites, and Local<br />

Authorities are required to seek the HSE’s view on the likely risks to any<br />

proposed development within those zones (Department of Environment<br />

Circular 11/92).<br />

4.3.30. In <strong>Wychavon</strong>, consultation zones exist around several sites as well as some<br />

oil and gas pipelines. These zones are subject to review by the HSE, and<br />

their number and extent may change during the <strong>Plan</strong> period. Information<br />

regarding location may be obtained from the <strong>Plan</strong>ning Department.<br />

Environmental Statements<br />

4.3.31. The Town and Country <strong>Plan</strong>ning (Environmental Impact Assessment)<br />

Regulations 1999, require developers to submit an Environmental Statement<br />

with certain development proposals. The purpose of the Statement is to<br />

provide an assessment and analysis of the potential environmental effects of<br />

proposals to assist the decision making process. An Environmental Statement<br />

is mandatory for projects listed under Schedule 1 of the regulations. Schedule<br />

2 lists development for which a Statement may be required. All proposals for<br />

development covered by Schedule 2 will be “screened” by the Local <strong>Plan</strong>ning<br />

Authority to establish whether an Environmental Statement is required.<br />

4.3.32. The Regulations also extend the requirement for an Environmental Statement<br />

to Permitted Development which is likely to have significant environmental<br />

effects. Where this is the case, Permitted Development Rights will not apply<br />

and a planning application, accompanied by an Environmental Statement will<br />

be required.<br />
