3.4 Storage of ore<br />

The Run of Mine stockpile will store a maximum of 80 000 ton of ore at any one time, at a steady state in the<br />

beginning, a stockpile will be built of up to 30 000 tons so as to start up the contractor.<br />

The topsoil and subsoil will be removed and stockpiled separately. Ore will be stockpiled near the processing<br />

plant on a pre-prepared area, where soils will be treated, compacted and provided with adequate Bitumen<br />

product to prevent seepage of acid drainage. The stockpile areas will be connected to evaporation ponds which<br />

will also be lined to ensure impermeability. Ore will be stockpiled for a maximum of two to three months, or until<br />

the operations at Portion 6A of the Farm Jan Hedriksfontein ends.<br />

The water collected in the evaporation ponds will be used for dust suppression on the mine.<br />

3.5 Waste rock dump<br />

After the ore is extracted, waste rock will be placed on the waste rock dump by means of a conveyor belt. The<br />

waste rock dump will be positioned near the plant area. It is estimated that the ROM waste rock dump would be<br />

approximately 1 000 000m 3 .<br />

The footprint of the waste rock dump is calculated to be 600m by 800m with a height of 30m; therefore the total<br />

volume is estimated at approximately 14 400 000m 3 .<br />

The position of the waste rock dump is planned to reduce the initial hauling distance, at a position where it can<br />

be used to for the rehabilitation of the final void.<br />

4. LEGAL FRAMEWORK FOR THE PROPOSED<br />

DEVELOPMENT<br />

This section includes a list of Acts applicable to this project and a brief description of the relevant aspect(s) of the<br />

relevant Acts. The aim of this component of the report is to provide a brief overview of the pertinent policies as<br />

well as legal and administrative requirements applicable to the proposed development of the Usutu Coal Colliery.<br />

The legislative motivation for this project is underpinned by the Constitution of South Africa (Act No. 108 of<br />

1996), which states that:<br />

The State must, in compliance with Section 7(2) of the Constitution, respect, protect, promote and fulfil the rights<br />

enshrined in the Bill of Rights, which is the cornerstone of democracy in South Africa. Section 24 of the<br />

Constitution states:<br />

24. Environment.-Everyone has the right-<br />

(a) to an environment that is not harmful to their health or well-being; and<br />
