precautionary measures contemplated in paragraph (b) and (d), or any precautionary measures which may<br />
be prescribed, have been taken;<br />
g. Taking all necessary measures to ensure that the requirements of this Act are complied with by every<br />
person in his employment or on the premises under his control where plant and machinery is used;<br />
h. Enforcing such measures as may be necessary in the interest of health and safety;<br />
i. Ensuring that work is performed and that plant and machinery is used under the general supervision of a<br />
person trained to understand the hazards associated with it and who has the authority to ensure that<br />
precautionary measures taken by the employer are implemented; and<br />
j. Causing any employees to be informed regarding the scope of their authority as contemplated in Section<br />
37(1) (b).<br />
4.9 Mine Health and Safety Act (Act 29 of 1996)<br />
To provide for protection of the health and safety of employees and other persons at mines and, for that purpose<br />
-<br />
• to promote a culture of health and safety;<br />
• to provide for the enforcement of health and safety measures;<br />
• to provide for appropriate systems of employee, employer and State participation in health and safety<br />
matters;<br />
• to establish representative tripartite institutions to review legislation;<br />
• promote health and enhance properly targeted research;<br />
• to provide for effective monitoring systems and inspections, investigations and inquiries to improve health<br />
and safety;<br />
• to promote training and human resources development;<br />
• to regulate employers' and employees' duties to identify hazards and eliminate, control and minimise the<br />
risk to health and safety;<br />
• to entrench the right to refuse to work in dangerous conditions; and to give effect to the public international<br />
law obligations of the Republic relating to mining health and safety;<br />
• and to provide for matters connected therewith.<br />
4.10 Explosives Act (Act 26 of 1956)<br />
To provide for the health and safety of persons employed in connection with the use of explosives; the transport<br />
of explosives and safety arising out of or in connection with the activities of persons working with explosives; to<br />
establish an advisory council for the management of explosives; and to provide for matters connected therewith.<br />
