It is reconunended the Governing Board approve the specifications for a multi-term contract and the use of a<br />

cotnpetitive sealed proposal to procure Third Party Cobra Administrator Services for the District. If approved as<br />

recommended, the proposal is expected to be released in September, 2006 and is expected to close in October, 2006.<br />

It is hereby resolved that the District shall use the Request for Proposal (RFP) process to procure Third Party Cobra<br />

Administrator Services because:<br />

a. The quality of service and experience varies;<br />

b. the District wants to compare the price, quality, experience and contractual factors of the proposals submitted; and<br />

c. the RFP process is more advantageous to the District because it allows all of the above to occur.<br />

It is further resolved that a multi-term contract is appropriate because:<br />

c.<br />

a. I he estimated requirements of the District for Third Party Cobra Administrator Services cover the period of the<br />

contract;<br />

b. such a contract will serve the best interests of the District by promoting economies in the procurement and by<br />

encouraging competition; and,<br />

c. if monies are not appropriated or otherwise made available to support continuation of performance in a<br />

subsequent fiscal period, the contract shall be canceled and the contractor may only be reimbursed for the<br />

reasonable value of any nonrecurring costs incurred but not amortized in the price of the materials or services<br />

delivered under the contract or which are otherwise not recoverable. The cost of cancellation may be paid from<br />

any appropriations available for such purposes.<br />

SUMMARY AND RECOMMENDATION<br />

It is recommended that the Governing Board authorize the issue and release of a Request for Proposal for Third Party<br />

Cobra Administrator Services for the District.<br />
