On Sunday Show Curb<br />
CHARLOTTE—Charles McGree, head of<br />
the Mecklenburg Drive-In Theatre Co., which<br />
operate.s the North 29 Drive-In here, has<br />
taken to superior court his fight against the<br />
city blue law which forbids operation of a<br />
theatre before 9<br />
p.m. on Sundays.<br />
Frank N. Littlejohn. chief of police, was<br />
named defendant in a suit in which McGree<br />
asks for an injunction against police interference<br />
with Sunday operation of his drive-in.<br />
The suit was to be heard this week (26)<br />
before Judge J. Will Pless.<br />
McGree was convicted in police court February<br />
13 on a charge filed by Chief Littlejohn<br />
of violating the city ordinance regulating<br />
Sunday hours of motion picture exhibition.<br />
McGree also has appealed this conviction.<br />
Two days after the conviction, on February<br />
15, he was arrested on the same charge. This<br />
case has been continued pending outcome of<br />
the other cases.<br />
McGree, in his suit for an injunction,<br />
charges the city code regulation of theatres<br />
is "discriminatory, unreasonable and arbitrary."<br />
He pointed out the local television<br />
station, a competitor to the motion picture<br />
business, is not prohibited from showing films<br />
on Sunday.<br />
He charges Chief Littlejohn and his officers,<br />
"wrongfully, illegally trespassed on the<br />
North 29 Drive-In property, disrupted its business,<br />
intimidated the employes and drove<br />
away the drive-in's customers."<br />
Both the North 29 and the York Road<br />
Drive-In ai-e situated inside the city limits,<br />
and until early in February they had operated<br />
without interference on Sunday. Following<br />
a warning. Chief Littlejohn first arrested<br />
McGree on February 8.<br />
