Cites TV Films in Fight
On Sunday Show Curb
CHARLOTTE—Charles McGree, head of
the Mecklenburg Drive-In Theatre Co., which
operate.s the North 29 Drive-In here, has
taken to superior court his fight against the
city blue law which forbids operation of a
theatre before 9
p.m. on Sundays.
Frank N. Littlejohn. chief of police, was
named defendant in a suit in which McGree
asks for an injunction against police interference
with Sunday operation of his drive-in.
The suit was to be heard this week (26)
before Judge J. Will Pless.
McGree was convicted in police court February
13 on a charge filed by Chief Littlejohn
of violating the city ordinance regulating
Sunday hours of motion picture exhibition.
McGree also has appealed this conviction.
Two days after the conviction, on February
15, he was arrested on the same charge. This
case has been continued pending outcome of
the other cases.
McGree, in his suit for an injunction,
charges the city code regulation of theatres
is "discriminatory, unreasonable and arbitrary."
He pointed out the local television
station, a competitor to the motion picture
business, is not prohibited from showing films
on Sunday.
He charges Chief Littlejohn and his officers,
"wrongfully, illegally trespassed on the
North 29 Drive-In property, disrupted its business,
intimidated the employes and drove
away the drive-in's customers."
Both the North 29 and the York Road
Drive-In ai-e situated inside the city limits,
and until early in February they had operated
without interference on Sunday. Following
a warning. Chief Littlejohn first arrested
McGree on February 8.
