11.2.2. Landing and Shipping Rights<br />

11.2.2.1. This is the right that allows the leaseholder to import and export cargo over<br />

the berth using own stevedores.<br />

11.2.2.2. Landing and shipping rights will be granted in terms of new signed<br />

commercial leases.<br />

11.2.3. Preferential Berthing Rights<br />

11.2.3.1. This is a right given by TNPA to a leaseholder in order to handle a specified<br />

cargo over specific berth(s) under special conditions.<br />

11.2.3.2. Preferential berthing rights will be accorded to parties listed below:<br />

11.2.3.2.1. High-volume clients provided that notification of the 72 hours prior<br />

to vessel arrival has been given to the Berth Planners;<br />

11.2.3.2.2. leaseholders on special-purpose berths with fixed bulk/liquid bulk<br />

infrastructure and equipment, provided that notification of at least<br />

72 hours prior to vessel arrival has been given to the Berth<br />

Planners;<br />

11.2.3.2.3. any amendments to the above notifications will result in a new<br />

notification being allocated, thereby forfeiting the original one.<br />

Notifications and amendments thereof must be in writing;<br />

11.2.3.2.4. exception with regard to notification of arrival times will be 48 hours<br />

in the case of Agriport.<br />

11.2.4. Berth Issues<br />

11.2.4.1. Berths<br />

11.2.4.1.1. Berth will be designated by large numbers as opposed to both<br />

numbers, possibly reducing them <strong>from</strong> the current 15 berths to<br />

approximately 9 future berths.<br />

11.2.4.1.2. There will be no lay-by berths in Maydon Wharf. Exceptions can be<br />

made in the case where berths are vacant and shifting or removal of<br />

the vessel will be at owners' risk and expense.<br />

11.2.5. Dedicated Berths<br />

11.2.5.1. No leaseholder will be granted dedicated berthing rights and TNPA will<br />

retain control over all berths.<br />
