Des Moines Shoreline Master Program<br />
Exempt developments 1 . Those development activities set forth in Chapter 7 of the Des Moines<br />
SMP which are not required to obtain a Substantial Development Permit but which must otherwise<br />
comply with applicable provisions of the act and the SMP.<br />
Extreme low tide 1 . The lowest line on the land reached by a receding tide.<br />
Fair market value 1 . The open market bid price for conducting the work, using the equipment<br />
and facilities, and purchase of the goods, services and materials necessary to accomplish the<br />
development. This would normally equate to the cost of hiring a contractor to undertake the<br />
development from start to finish, including the cost of labor, materials, equipment and facility<br />
usage, transportation and contractor overhead and profit. The fair market value of the<br />
development shall include the fair market value of any donated, contributed or found labor,<br />
equipment or materials.<br />
Feasible 1 . An action, such as a development project, mitigation, or preservation requirement,<br />
that meets all of the following conditions: (a) the action can be accomplished with technologies<br />
and methods that have been used in the past in similar circumstances, or studies or tests have<br />
demonstrated in similar circumstances that such approaches are currently available and likely to<br />
achieve the intended results; (b) the action provides a reasonable likelihood of achieving its<br />
intended purpose; and (c) the action does not physically preclude achieving the project's primary<br />
intended legal use.<br />
Federally designated endangered and threatened species 3 . Those fish and wildlife species<br />
identified by the U.S. Fish and Wildlife Service and the National Marine Fisheries Service that<br />
are in danger of extinction or threatened to become endangered. The U.S. Fish and Wildlife<br />
Service and the National Marine Fisheries Service should be consulted for current listing status.<br />
Fill 1 . The addition of soil, sand, rock, gravel, sediment, earth retaining structure, or other<br />
material to an area waterward of the OHWM, in wetlands, or on shorelands in a manner that<br />
raises the elevation or creates dry land.<br />
Fish and wildlife habitat conservation area 3 . Land management for maintaining species in<br />
suitable habitats within their natural geographic distribution so that isolated subpopulations are<br />
not created. Fish and wildlife habitat conservation areas include:<br />
1. Areas with which endangered, threatened, and sensitive species have a primary<br />
association;<br />
2. Habitats and species of local importance;<br />
3. All public and private tidelands or bedlands suitable for commercial or recreational<br />
shellfish harvest;<br />
4. Kelp and eelgrass beds identified by the Washington Department of Natural Resources;<br />
5. Herring and smelt spawning areas as outlined in chapter 220-110 WAC and the Puget<br />
Sound Environmental Atlas as presently constituted or as may be subsequently amended;<br />
6. Naturally occurring ponds under 20 acres and their submerged aquatic beds that provide<br />
