CHAPTER – I <strong>TENDER</strong> FORM AND INSTRUCTION TO <strong>TENDER</strong>ER<br />

1.2 Scope of the Work:<br />

The scope of the work against which tenders are invited is furnished in Clause No. 2.2<br />

of Chapter-II (Special Conditions of Contract) of this Tender document. Tenderers are<br />

advised to study the same carefully and submit their offers for the complete scope of the<br />

work failing which it will be treated as incomplete and dealt with accordingly.<br />

1.3 Rules & General Conditions<br />

• Authorized agents are allowed to buy the tender documents on behalf of their<br />

principals, with letter of authority from the principal.<br />

• Incomplete & tenders with special condition will generally not be considered<br />

• Tender without earnest money will be rejected.<br />

• Bids from Tenderers who have not purchased the documents from Railways but<br />

downloaded from web site and cost of tender is not submitted along with above said<br />

form, tender document are liable to be summarily rejected.<br />

• Tender form is not transferable and under no circumstances the amount paid for the<br />

tender document will be refunded.<br />

• Relevant documents and special condition shall be attached along with tender form as<br />

per terms and condition of tender.<br />

• The tenderer must sign on each page of the tender form.<br />

• Telex and incomplete offers are liable to be ignored.<br />

• If in terms and condition of tender is changed/added/deleted with malafide intention by<br />

the Tenderer/Contactor and the same is detected at any stage even after award of the<br />

Tender, all necessary action including banning of business, would be taken. In addition<br />

Tenderer is also liable to be prosecuted as per the law.<br />

• Tenderer should read the conditions carefully and also see the schedule of supply and<br />

works before submitting the offer and also ascertain site conditions and the magnitude<br />

of works involved.<br />

• New Arbitration Act 1996 will be in force in place of Arbitration Act 1940.<br />
