1.2 Scope of the Work: 

The scope of the work against which tenders are invited is furnished in Clause No. 2.2 

of Chapter-II (Special Conditions of Contract) of this Tender document. Tenderers are 

advised to study the same carefully and submit their offers for the complete scope of the 

work failing which it will be treated as incomplete and dealt with accordingly. 

1.3 Rules & General Conditions 

• Authorized agents are allowed to buy the tender documents on behalf of their 

principals, with letter of authority from the principal. 

• Incomplete & tenders with special condition will generally not be considered 

• Tender without earnest money will be rejected. 

• Bids from Tenderers who have not purchased the documents from Railways but 

downloaded from web site and cost of tender is not submitted along with above said 

form, tender document are liable to be summarily rejected. 

• Tender form is not transferable and under no circumstances the amount paid for the 

tender document will be refunded. 

• Relevant documents and special condition shall be attached along with tender form as 

per terms and condition of tender. 

• The tenderer must sign on each page of the tender form. 

• Telex and incomplete offers are liable to be ignored. 

• If in terms and condition of tender is changed/added/deleted with malafide intention by 

the Tenderer/Contactor and the same is detected at any stage even after award of the 

Tender, all necessary action including banning of business, would be taken. In addition 

Tenderer is also liable to be prosecuted as per the law. 

• Tenderer should read the conditions carefully and also see the schedule of supply and 

works before submitting the offer and also ascertain site conditions and the magnitude 

of works involved. 

• New Arbitration Act 1996 will be in force in place of Arbitration Act 1940. 






1.4. Issue of Tender Document 

Tender forms can be obtained from the office of the Sr. Divisional Signal & Telecom 

Engineer, Western Railway, DRM Office, Near Chamunda Mata Mandir, Opp. 

New Swadeshi Mills, Naroda Road, Post – Saijpur Bogha, Ahmedabad-382 345 

on working days on production of money receipt for Rs. 1,000/- (Rupees One 

thousand only), if obtained by post (non-refundable), deposited with the Chief Cashier, 

/ any Station Master of the Western Railway. The contractor who desires to receive 

the tender document by post should send Demand Draft for Rs.1,500/- (Rs. One 

thousand Five Hundred only) drawn in favour of Sr. Divisional Finance Manager, W. 

Rly, Ahmedabad. This includes Rs.500/- per set for the speed post charges. Tender 

document will be sold and received upto the respective date and time mentioned in the 

NIT and its subsequent corrigenda issued, if any. Under no circumstances, the amount 

paid for the tender form will be refunded. Tender form is non-transferable. 

1.5 Downloading of Tender Document and Instructions thereon:- 

Tender document can also be downloaded from the internet website 

www.wr.indianrailways.gov.in as per the instructions given below:

Tenderer/s are free to download and take good quality printout on A-4 size paper for 

the purpose of perusal as well as for using the same as tender document for submitting 

their offer at their own risk and cost. Tenderers are advised to download tender 

documents well in advance and also to keep a watch on any corrigendum to the 

documents being released by the tender inviting office to ensure that they use the latest 

document for their offers. 

Master copy of the tender document duly incorporated with latest amendments (if any) 

will remain available for viewing in the Office of Sr. Divisional Signal & Telecom 

Engineer, Western Railway, DRM Office, Near Chamunda Mata Mandir, Opp. 

New Swadeshi Mills, Naroda Road, Post – Saijpur Bogha, Ahmedabad-382 345 

till the stipulated closing time. Tender offers are to be made only in the documents 

matching with this master copy failing which the offer may be rejected. In case, any 

discrepancy between the tender documents downloaded from the internet and the 

master copy, later shall prevail and will be binding on the Tenderer/s. In the event of 

acceptance of offer, an agreement will be prepared based on the master copy of tender 

document available in the above mentioned office and no claims on this account will 

be entertained.

It is the responsibility of the Tenderer to check any correction or any modifications 

published subsequently in web site and to take into account while submitting their 

tender. Tenderer shall download corrigendum (if any), print it out, sign and attach it 

with the main tender document. Tender document not accompanied by published 

corrigendum/s is liable to be rejected. The Railway will not be responsible for any 

postal delays/delay in downloading of tender document from the internet. 

In case of submitting Tender on downloaded document, the prescribed cost of tender 

document will have to be deposited by the Tenderer in the form of bank demand 

draft payable in favour of Sr. Divisional Finance Manager, Western Railway, 

Ahmedabad alongwith their tender documents while submitting offer. The draft 

towards the cost of Tender Documents must be separate and in no case shall be 

combined with the Earnest Money. The earnest money deposit required for this 

work as stipulated in the tender document is therefore to be submitted separately. 

Tender not accompanied with the demand draft towards the cost of the tender 

document will be summarily rejected. 

In case of submitting Tender on downloaded document, the following declaration 

should also be given by the tenderer while submitting the tender: 

(a) I/We have downloaded the tender form from the internet site http:// 

www.wr.indianrailways.gov.in and I/We have not tampered / modified the tender 

forms in any manner. In case, if the same is found to be tampered/modified I/We 

understand that my/our tender will be summarily rejected and full earnest money 

deposit will be forfeited and I/We am/are liable to be banned from doing business 

with Railways and/or prosecuted. 

(b) I/We submitting a separate demand draft No. ____________________ dated 

____________ issued by __________ for Rs. _________ towards the cost of 

tender form. 

1.6 Earnest Money Deposit 

The tender must be accompanied with requisite Earnest money mentioned in the tender 

notice, deposited in cash or in any of the forms as mentioned below drawn in favour of 

Sr. Divisional Finance Manager, Western Railway, Ahmedabad, Payable at 

Ahmedabad, failing which the tender will be summarily rejected. Any other form of 

earnest money or any amount, which may be deposited towards any other type of 

tenders like, Lump sum/Standing Earnest money / Bank Guarantee, is not acceptable as 

EMD against this tender. 

Deposit receipt, Pay orders and Demand drafts. These forms of earnest money could be 

either of the State Bank of India or of any Nationalized Banks. No confirmatory advice 






from the Reserve Bank of India will be necessary. 

Deposit receipt executed by the Scheduled Banks (other than the State Bank Of India 

and the Nationalized Banks) approved by the Reserve Bank Of India for the purpose. 

The earnest money wherever it is deposited in cash should be remitted to the Chief 

Cashier, Western Railway, Ahmedabad and the receipt obtained thereof should be 

enclosed with the tender as a proof of the deposit of requisite earnest money. The 

earnest money should not be deposited with Stations. 

1.7 Local Conditions 

It will be imperative on each Tenderer to fully acquaint him with all the local 

conditions and factors, which would have any effect on the performance of the contract 

and cost of the work. The purchaser shall not entertain any request for clarifications 

from the Tenderer regarding such local conditions. No request for change of price or 

time schedule of completion will be entertained after the offer is accepted by the 

purchaser on account of any local condition or factor. The tenderer(s) shall inspect the 

proposed site of work and acquaint himself/themselves with the site conditions, 

working hours, layout of land, trees and shrubs that he/they will have to cut, type of 

strata likely to be met within the borrow pits, stacking space for materials, approach 

roads, path ways available etc. and all relevant items connected with the execution of 

the work. No claim shall be entertained for the contractor(s) making his/their own 

arrangements for approaches/approach road from outside Railway land and 

contractor(s) will bear entire expenses such as road taxes, payment for right of way, 

etc. to outsiders and for Construction of approaches/approach roads, etc. 

1.8 Tender Form and required documents to accompany the offer:- 

The Tender Form duly signed by the Tenderer(s) and at least two independent 

witnesses shall invariably be accompanied by the following documents, over and 

above those mentioned already , failing which the offer can be treated as invalid 

and liable to be summarily rejected without any correspondence with the firm. Hence, 

the Tenderers are advised to ensure that these documents are submitted, duly signed at 

all pages, with their offer:- 

a) Requisite Earnest Money in prescribed and acceptable form. 

b) Payments towards the Cost of Tender Document in case of Downloaded Document 

through separate instruments. 

c) Filled-in and signed Tender Form (Top-Sheet) alongwith the Complete Tender 

document in original form duly filled in rates against all items indicated in the 

Tender schedule(s) signed and stamped in each page by the tenderer. 

d) Complete list indicating Type/Model/Version and name of OEM(s) against the 

(identified in the Schedule-A) items proposed to be supplied by them against this 

tender. 






e) Not applicable. 

f) The tenderer shall submit a statement indicating any deviations against any clause 

of this tender including all the technical specification concerned to this work in the 

format enclosed in Chapter-VI, duly signed & stamped on each page. If there 

are no deviation whatsoever, a “Nil” deviation statement should be submitted 

failing with the offer may be considered as incomplete & liable to be rejected. 

g) List of Personnel, organization /technical staff available on hand and proposed to be 

engaged for the subject work, with their designation and experience. 

h) List of works completed in the last three financial years giving description of work, 

organization for whom executed, approximate value of contract at the time of 

award, date of award and date of scheduled completion of work. Date of actual 

start, actual completion and final value of contract should also be given. . Not 

applicable for this work. 

i) List of works on hand indicating description of work, contract value, approximate 

value of balance work yet to be done and date of award. 

j) Documentary evidence necessary to establish that they possess the requisite skill, 

technical expertise, technical and skilled manpower and necessary equipments to 

execute complete work covered in the schedule with stipulated 

specifications/details. 

k) Document(s) in support of solvency. Not applicable for this work. 

l) Last audit report from registered Chartered Accountant. 

m) Power of Attorney, (if any), in acceptable form duly notarized from Magistrate as 

per GCC - Clause 16. 

n) Certified copy of JV agreement in case of JV, Partnership deed in case of 

partnership firms as per clause 15 Annexure- I (second sheet) of GCC, 

Memorandum of Articles of Association of the firm, extract of board of directors 

meeting authorizing signatory to submit the offer to the Railways. . Not applicable 

for this work. 

o) The tenderer shall also enclose in his offer that they accept all the Railways terms 

and conditions (unless for those covered under clause 1.9 (iii) below, if any) and 

have not offered any counter conditions. 

Tenderer’s Special conditions (if any) not in conformity with the tender Terms & 

Conditions / specifications / drawings, are required to be enclosed separately with 

details of exact financial implications wherever involved, (pl see Clause. No. 1.9 (iii) 

below). 






1.9 Submission of Tender:- 

i) The tenderer should read the tender document carefully especially the conditions and 

also see the schedule of supply and works before submitting the offer and also 

ascertain site conditions and the magnitude of works involved. 

ii) All offers shall be either type written or handwritten neatly in English. Each page of 

the offer must be numbered consecutively. A reference to total number of pages 

comprising the offer must be made at the top right of the top page. Each page of the 

tender document including technical brochures, manuals etc. should be signed by the 

tenderer. No scribbling is permissible in the tender documents. Any correction made 

by the Tenderer / Tenderers in his / their entries must be attested by him / them 

without which the offer will be liable to be rejected. If any change / addition / deletion 

is made by the Tenderer / Contractor and the same is detected at any stage even after 

the award of the tender, full earnest money deposit will be forfeited and the contract 

will be terminated. The tenderer is also liable to be banned from doing business with 

Railways and/or prosecuted. 

iii) As far as possible the Tenderer’s bid should not have any condition or specification or 

assumption contrary to the provisions in these tender documents on which the 

tenderer/s bid is based. Tenderer’s Special conditions, not in conformity with the 

tender specifications / drawings are required to be listed separately with details of 

exact financial implications, if any and to be submitted along with offer. Railways may 

not take cognizance of conditions / variations from the tender documents or drawings 

etc. It needs to be emphasized that only such conditions/ stipulations which are at 

variance with the tender conditions codal provision stipulated in the tender documents 

need be mentioned, in case tenderer choose to stipulate such special conditions taking 

into account the restrictions mentioned elsewhere in the tender document. Only such 

special conditions / specifications stipulated by the Tenderer’s which have been 

specifically approved by the Railways in writing shall be deemed to have been 

accepted by the Railways and shall form part of the Contract Agreement. The 

tenderer/s conditions / stipulations which are at variance with the tender conditions / 

codal provisions and not approved / accepted by Railways, shall be withdrawn by the 

tenderer/s. 

iv) Name of work: - Supply, Installation, Testing & Commissioning of CCTV at ICU 

Sabarmati Hospital and Annual Maintenance Contract for three years 

for CCTV system after expiry of warranty period of one years.

for Receipt of Offers in the NIT and its corrigenda (if any). 

Tender documents sealed and superscribed as mentioned above, can also be sent by 

Registered. Post with acknowledgement due, to the above-mentioned office so as to 

reach well in advance. No tender received after closure of the tender box at the time 

and date specified above shall ordinarily be considered. Railway shall not consider 

postal delays due to any reason. 

vii) Tender submitted by the Tenderers who have not purchased / downloaded the tender 

documents themselves or through their agents and tenders submitted by agents without 

letter of authority from the principals will be summarily rejected. 

1.10 System of Quoting Rates 

Tenders are requested to quote their rates against each item, to cover the entire scope 

of the work, in figures rounded off to one Rupee. The quoted rates shall include all 

duties, Taxes, charges etc. As per rule prevailing on date, Railway being a Govt. 

Organization is eligible to exempt Octroi tax and hence a suitable Octroi Tax 

exemption certificate will be issued in favour of the contractor on demand. The rate 

should also be inclusive of license fee for the application software(s) wherever 

applicable. Tenderers if quoting rates in any other form or anywhere other than the 

Schedule of material & Works shall not be considered as valid. 

Note: - The facility of inter state purchaser by Government Department against from D 

and Octroi tax etc. stands withdrawn as per rule. 

1.11 Validity of Offer: 

(i)

The tenderer shall keep the offer open for a minimum period of 3 calendar months 

from the date of opening of tender. Within that period, the tenderer cannot withdraw 

his offer subject to the period being extended further if required by mutual agreement 

from time to time. Any contravention of the above condition will make the tenderer 

liable for forfeiture of his Earnest Money Deposit. 

It is understood that the tender document has been sold/issued to the Tenderer(s) and 

the Tenderer(s) is / are permitted to tender in consideration of the stipulation on 

his/their part that after submitting his / their tender subject to the period being 

extended further if required by mutual agreement from time to time, he will not resile 

from his offer or modify the terms and conditions thereof in a manner not acceptable 

to Western Railway. Should the Tenderer fail to observe or comply with the foregoing 

stipulation, the amount deposited, as Earnest Money for the due performance of the 

above stipulation shall be forfeited by the Railway. 






1.12 Opening of Tenders: 

Tender will be opened on the day as described in NIT in the office of Sr. Divisional Signal 

& Telecom Engineer, Western Railway, DRM Office, Near Chamunda Mata Mandir, 

Opp. New Swadeshi Mills, Naroda Road, Post – Saijpur Bogha, Ahmedabad-382 345, at 

15.30 hrs . 

1.13 Rates During Negotiation 

The Tenderer/s shall not increase his/their quoted rates in case the Railway 

Administration negotiate for reduction of rates, such a negotiation shall not amount to 

cancellation or withdrawal of the original offer and the rates originally quoted will be 

binding on the Tenderer/s. 

1.14 Errors, Omissions & Discrepancies (in the tender document) 

The Contractor(s) shall not take any advantage of any mis-interpretation of the 

conditions due to typing or any other error and if in doubt shall bring it to the notice of 

the Engineer, without delay. In case of any contradiction only the printed rules, and 

books should be followed and no claim for the mis-interpretation shall be entertained. 

If a Tenderer finds discrepancies in, or omission from the drawing or any of the Tender 

papers or he has any doubt to their meaning, he should at once notify the Railway who 

may send a written clarification to all Tenderers. 

1.15 Rights of Railway to deal with Tenders: 

The authority for the acceptance of the Tenderer will rest with the Western Railway 

administration on behalf of President of India, who shall not be bound to accept the 

lowest or any tender or to assign any reason for declining to consider, non-acceptance 

or rejection of a tender. The Western Railway administration reserves the right to 

accept any tender in respect of the whole or any portion of the work specified in the 

tender paper or to sub-divide the work among different Tenderers or to reduce the 

work or to accept any tender for less than the tendered quantities without assigning 

any reason whatsoever. 

Railway administration also reserves the right to cancel any or all tenders at any stage 

and in such case cost of tender document shall not be refunded. 

1.16 Acceptance of Tender, issue of LoA, Submission of Performance BG Bond and 

commencement of Contract by the successful Tenderer. 

A letter of acceptance (LoA) of the offer shall be issued by the Railway Administration 

to the successful Tenderer that his offer has been accepted, on receipt of which he shall 

submit a Performance Bank Guarantee (PBG) bond of 5% of cost of work within 15 

days of receipt of LoA as described in Clause No. 2.6 of Chapter II, Special Conditions 

of Contract and shall execute a formal Contract Agreement with the President of India 

acting through the Sr. Divisional Signal & Telecom Engineer, Western Railway. 

Railway, Ahmedabad, for carrying out the work according to terms and conditions of 






this tender including "General Conditions of Contract” of Western Railway and Special 

Conditions / Specifications of this tender. Upon issuing of LoA the contract for the 

work shall be deemed to have been awarded to the Tenderer and accordingly the 

completion period will be reckoned from the date of issue of LoA irrespective of the 

date of signing of contract agreement subsequently. 

1.17 Signing of Contract Agreement

The successful Tenderer shall be required to present himself or his duly authorized 

representative at the office of the Sr. Divisional Signal & Telecom Engineer, 

Western Railway to execute the aforesaid Contract Agreement, within seven days after 

receipt of notice that the said documents are ready. 

Failure to do so shall constitute a breach of the agreement effected by the acceptance of 

the Tender in which case, the Railway may determine that such Tenderer/s has/have 

abandoned the contract and there upon his/their tender and the acceptance thereof shall 

be treated as cancelled and the Railway shall be entitled to forfeit the full amount of the 

earnest money and to recover the liquidated damages for such default, without 

prejudice to any other rights or remedies. 

1.18 Commencement of work by Submission of Programme for execution : 

The successful tenderer upon receipt of LoA shall commence the work by way of 

submitting a detailed time schedule in terms of Clause No. 2.9 of of Chapter – II, 

Special Conditions of Contract, for completion of work within the allowed completion 

period. 

1.19 Security Deposit 

In addition to the Performance Guarantee Bond mentioned above, Security deposit will 

be deducted from 1 st running bills onwards for an amount of 5% of the contract value 

as per latest GCC and details given at Clause No. 2.7of Chapter –II, Special conditions 

of contract. 

1.20 Retention / Release of Earnest Money 

(i) 

The tenderer shall deposit in favour of the Sr.Divisional Finance Manager, D.R.M. 

Office, Western Railway, Ahmedabad, a sum of Rs. 4,060/- (Rupees Four Thousand 

Sixty Only) as Earnest Money Deposit, failing which tender will be summarily rejected. 

The tenderer/s shall hold the offer open till such date as may be specified in Validity 

Clause of the tender. It being understood that the tender documents have been 

sold/issued to the tenderer and the tenderer has been permitted to tender in consideration 

of the stipulation on his part that after submitting his tender he will not resale from his 

offer or modify the terms and conditions thereof in a manner not acceptable to the 

Sr.Divisional Signal & Telecommunication Engineer, D.R.M. Office, Western Railway,

Ahmedabad, should the tenderer fail to observe or comply with the foregoing 

stipulation, the aforesaid amount shall be liable to be forfeited by the Railways. 

If the tender is accepted, the amount of the Earnest Money will be retained as part of 

Security Deposit for the due and faithful fulfilment of the contract. The Earnest Money 

of the unsuccessful tender will save as here in before provided, be returned to the 

unsuccessful Tenderer, but the Railway shall not be responsible for any loss or 

depreciation that may happen thereto while in their possession nor be liable to pay 

interest thereon. The Earnest Money receipt shall be incorporated in the original copy of 

the tender document. (Other copies of the offer, if any shall contain true copies of the 

Earnest Money Receipt) 

The tenderer shall be required to deposit earnest money with the tender for the due 

performance with the stipulation to keep the offer open till such date as specified in the 

tender, under the conditions of tender. (i) The earnest money shall be 2% of the 

estimated tender value as indicated in the Tender Notice (for tenders of value 

upto Rs. 1 crore.(ii) The earnest money shall be Rs. 2 Lakh plus ½% ( half 

percent ) of the excess of estimated cost of the work beyond Rs. 1 crore ( tender 

value) subject to a maximum of Rs. 1 crore. – This is as per - As per Railway 

Board’s letter No. 2007/CE.1/CT/18 dated 28-9-2007. 

The earnest money shall be rounded to the nearest Rs.10/-. This earnest money shall be 

applicable for all modes of tendering. 

(a) It shall be understood that the tender documents have been sold/issued to the 

tenderer and the tenderer is permitted to tender in consideration of stipulation on his 

part, that after submitting his tender he will not resale from his offer or modify the 

terms and conditions thereof in a manner not acceptable to the Engineer, should the 

tenderer fail to observe or comply with the said stipulation, the aforesaid amount 

shall be liable to be forfeited to the Railway. 

(b) If his tender is accepted this earnest mentioned in sub clause (a) above will be 

retained as part security for the due and faithful fulfillment of the contract in terms 

of Clause-16 of the General Conditions of Contract. The Earnest Money of other 

tenderers, shall save as herein before provided, be returned to them, but the Railway 

shall not be responsible for any loss or depreciation that may happen thereto while 

in their possession, nor be liable to pay interest thereon. 

(c) The Earnest Money should be in cash or in any of the following forms: 

As per Railway Board’s letter No 2003/CE.1/CT/4 Pt. I dated 04-4-2008. “The 

Earnest Money should be in cash or in the form of deposit receipt, pay orders or 

demand drafts executed by State Bank Of India or any of the Nationalized Banks 

or by a Scheduled Bank “. 

No reference to the previous deposit of Earnest Money & Security Deposit for 

adjustment against the present tender will be accepted and any request for recovery 

from any Security Deposit against present Tender will not be entertained 






(v) The earnest Money shall remain deposited with the Purchaser for the Period of 180 

days from the date of opening of tenders. If the validity of the offer is extended, the 

Earnest Money Deposit/Bank Guarantee duly extended shall also be furnished, failing 

which the offer after the expiry of the aforesaid period shall not be considered by the 

Purchaser.

No interest will be payable by the Purchaser on the Earnest Money. 

The earnest money deposited is liable to be forfeited if the tenderer Withdraws or 

amends, impairs or derogates from the tender in any respect within the period of 

validity of his offer. 

The earnest Money of the successful tenderer will be returned after the Security 

Deposit as required under Chapter – II clause 2.7 of Special Conditions of 

Contract is furnished and the Purchaser receives formal contract duly signed. 

If the successful tenderer fails to furnish Security Deposit as required in the Special 

Conditions of Contract and fails to return the formal Contract duly signed within fifteen 

days of the receipt of the formal contract, then the Earnest Money shall be liable to be 

forfeited by the Purchaser. 

The Earnest Money of the unsuccessful tenderer (s) will, save as here-in-before 

provided, be returned to the unsuccessful tenderer(s) within a reasonable time but the 

Railway shall not be responsible for any loss or depreciation that may happen to the 

Security for the due performance of the stipulation to keep the offer open for the 

period specified in the tender documents or to the Earnest Money while in their 

possession nor be liable to pay interest thereon. 

Any tender not accompanied by Earnest Money in one of the approved forms will 

be summarily rejected. 

1.21 QUALIFYING CRITERIA :-

1.22 Criteria to evaluate Joint Venture firms:- 

Instructions to tenderer/s for submitting the Tenders as Joint Venture Firms: (As per 

Railway Board letter No. 2002/CE-1/CT/37 New Delhi Dated :07.09.2011) “Joint 

Venture Firms” shall be applicable to the works tenders of value more than Rs. 25 

crore only.) 

All the constituent firms should individually qualify for solvency and turnover criteria 

prescribed in the tender document and at least one of the constituent firms should have 

experience of similar work as prescribed in the eligibility criteria. In case one of the 

constituents individually does not qualify for solvency and turnover, the solvency and 

turnover of constituents should be factored based on the percentage share in the Joint 






Venture. However, one of the constituents should be eligible on account of past 

experience of similar work. The method of factorization shall be adopted as per Para 

10.1 of Annexure-I, Chapter VI, Annexure and Performa’s. The instruction for 

submitting the tenders by new Joint ventures are enclosed as Annexure-I, Chapter VI, 

Annexure and Performa’s.

Chapter – II – Special Condition of Contract 

2.0 SPECIAL CONDITIONS OF CONTRACT 

The Tender shall be governed by the following Special Conditions of Contract 

(SCC), and Technical specifications etc (Chapters III and IV) in addition to the 

General Conditions of Contract of Western Railway (hereinafter called as GCC, 

although meant for civil engineering works but will also be applicable to this 

work). Where there is any conflict between the instructions to Tenderer, 

conditions of tendering, special condition of contract, Tender forms, Annexure 

etc. on one hand and GCC on the other, the former (SCC) shall prevail. Similarly 

in case of any conflict between the SCC and the Technical Specifications of the 

Contract, the latter shall prevail. 

Any Special conditions stated by the Tenderer in the covering letter 

submitted along with the tender shall be deemed to be part of the Contract to 

such extent only as have been explicitly accepted by the Railway. 

Performed and the method of construction, these specifications / documents 

describe the material to be supplied, work to be for the complete installation in 

strict accordance with the drawings and specifications mentioned here and such 

instructions as may from time to time be given by the Railway. 

It should clearly be understood that the contractor agrees to furnish, without any 

extra cost, anything and everything necessary for the complete installation and its 

reliable, safe and satisfactory working except such items as are specifically stated 

as being supplied by the Railway in this specification and at the time of placing 

the contract by the written agreement, the contractor shall quote for the work, 

given all information. 

2.1 Completion period: 

The entire work shall be completed with in a period of 2 calendar months from 

the date of issue of LOA of the tender. 

2.2 SCOPE OF WORK : 

The scope of work against which tenders are invited, involves the following two 

distinct parts:- 

2.2.1 (a) The CCTV camera system shall be monitor to patients in ICU covered in this 

tender document is to be installed and commissioned at Sabarmati Hospital 

ICU. The system to be provided shall be consist of PTZ dome camera, recording 

in 4 channel DVR and associated data, power cable etc., It shall be an integrated 

the video management software can work and integrate with as per schedule 

standard cameras and IT Hardware.

(b) 

Note :- The contractor shall submit along with his tender document a 

tentative scheme and lay out as to how the tendered work will be executed by 

him in the time frame. 

Networking & System Integration:- 

The work involve networking and integration CCTV system, matron room to 

ICU and one monitor installed at out side of ICU for visitors. This includes 

supply and installation of command control system hard ware & software. 

The details of technical specification, specification for execution of work, 

schedule of material & Works are furnished in Chapter-III, IV & V respectively 

of tender document. 

Provision of Comprehensive Maintenance service for 12 month for schedule- 

‘A ‘ after completion for the entire work as per the warranty condition vide 

clause no. 2.36 of chapter-II (special condition of contract) 

Hence it is important to note that this part of the work ( Para 2.2.1)will be 

deemed to have been completed only when installations and commissioning at 

different places over Ahmedabad Railway station & surrounding area are 

completed as per the contract agreement and successful completion of the 

warranty period. 

2.2.2 Provision of a Comprehensive Maintenance Service of the complete work 

executed under Part - `2.2.1’ above for at least three years after expiry of 

warranty period under an Annual Maintenance Contract to be separately 

executed if so decided by Railway. 

The Rates for such Annual Maintenance Service shall be quoted separately for 

each year and the total cost for 3 (three) years shall be taken into 

consideration while evaluating the Tenders for finalization. The accepted 

rates and terms & conditions quoted by the Tenderers shall be binding on 

them. Railway reserves the right to enter into AMC and also to vary the 

period for AMC in terms of Clause No 2.39 of Special condition of Contract 

governing variation of quantity against an item of the contract. 

The details of the Terms & Conditions of the operation of the AMC shall be as 

per Clause no. 2.39 of this chapter. 

2.3 RAILWAY SHALL PROVIDE FOLLOWING: 

i) Locations for installation testing & commissioning of PTZ camera ,DVR & 

Monitor. 

ii) Electric Power Supply will be provided as per extent rule. 






2.4 Quantum of Work, Recommended Spares & Optional Items: 

(i) The estimated quantities of various items required to be installed and 

commissioned are mentioned in the Tender Schedule. It should be clearly noted 

that the items and the quantities mentioned have been worked out by Railways 

as per the estimated requirements. However if the Tenderer feels that the desired 

features can not be achieved or some of the essential features can not be 

obtained through the quantities provided in the Tender Schedule, then quantity 

as required for the work in the opinion of the Tenderer shall be quoted as 

additional items and/or quantity. In such cases, Tenderer shall give, full 

justification for such variation, clearly mentioning the consequences of 

procuring the quantities suggested by the contractor instead of quantities 

indicated in schedule. 

(ii) Similarly for any other item(s) necessary for satisfactory completion/ 

functioning of the tendered work in accordance with the objective of 

requirement, rates and quantities of such item(s) shall be quoted separately, 

along with detailed justification for the need of the item(s) to achieve end 

objective. 

(iii) Costs for additional items mentioned above shall be quoted separately wherever 

necessary which shall not be taken into account for evaluation criteria of the 

offers. 

(iv) 

Railway reserves the right to include any of the additional items which shall be 

binding on the contractor. 

2.5 PRICE VARIATION CLAUSE (PVC): No price variation will be applicable. 

2.6 PERFORMANCE GUARANTEE: 

Revised Clause 16(4) to Indian Railways General Conditions of contract 

{Ref: Item-1 to Railway Boards letter no.2007/CE.I/CT/18 Pt.XII dated: 

31.12.2010} Clause 16(4). Performance Guarantee 

The procedure for obtaining Performance Guarantee is outlined below: 

(a) 

The successful bidder shall have to submit a Performance Guarantee (PG) 

within 30 (thirty) days from the date of issue of Letter of Acceptance (LOA). 

Extension of time for submission of PG beyond 30 (thirty) days and upto 60 

days from the date of issue of LOA may be given by the authority who is 

competent to sign the contract agreement. However a penal interest of 15% 

per annum shall be charged for the delay beyond 30 (thirty) days, i.e. from 

31 st day after the date of issue of LOA. In case the contractor fails to submit 

the requisite PG even after 60 days from the date of issue of LOA the contract 






(b) 

shall be terminated duly forfeiting EMD and other dues, if any payable against 

that contract. The failed contractor shall be debarred from participating in retender 

for that work. 

The successful bidder shall submit the Performance Guarantee (PG) in any of 

the following forms amounting to 5% of the contract value: (5% of total value 

separately for work and AMC i.e. Schedule-A + B and Schedule-C respectively.) 

(i) A deposit of Cash; 

(ii) Irrevocable Bank Guarantee; 

(iii) Government Securities including state loan bonds at 5% below the 

market value. 

(iv) Deposit Receipts Pay orders, Demand Drafts and Guarantee Bonds. 

These forms of performance guarantee could be either of the State 

Bank of India or of any of the Nationalized Banks; 

(v) Guarantee Bonds executed or Deposits Receipts tendered by all 

Scheduled Banks; 

(vi) A Deposit in the Post office Saving bank. 

(vii) A Deposit in the National Savings Certificates; 

(viii) Twelve years National Defence Certificates; 

(ix) Ten years Defence Deposits; 

(x) National Defence Bonds and 

(xi) Unit Trust Certificates at 5% below market value or at the face value 

whichever is less. 

Also, FDR in favor of FA&CAO (free from any encumbrance) may be 

accepted. 

Note: The instruments as listed above will also be acceptable for Guarantees 

in case of Mobilization advance. 

(c) 

(d) 

The performance Guarantee shall be submitted by the successful bidder after 

the Letter of Acceptance (LOA) has been issued, but before signing of the 

contract agreement. This PG shall be initially valid upto the stipulated date of 

completion plus 60 days beyond that. In case the time for completion of work 

gets extended, the contractor shall get the validity of P.G. extended to cover 

such extended time for completion of work plus 60 days. 

The values PG to be submitted by the contractor will not change for variation 

upto 25 %( either increase or decrease). In case during the course of 

execution, value of the contract increases by more than 25% of the original 

contract value, an additional Performance Guarantee amounting to 5% (five 

percent) for the excess value over the original contract value shall be 

deposited by the contactor.

The Performance Guarantee (PG) shall be released for works portion after 

physical completion of the work as per schedule of material and works and 

completion of warranty period. However, Performance Guarantee for Annual 

Maintenance Contact period of 3 years an unconditional and unequivocal 

bases on ‘Completion Certificate’ issued by the competent authority stating 

that the contactor has completed the work in all respects satisfactorily. The 

Security Deposit shall, however, be released only after expiry of the 

maintenance period and after passing the final bill based on ‘No claim 

Certificate’ from the contractor. 

Whenever the contract is rescinded, the Security Deposit shall be forfeited and 

the Performance Guarantee shall be encashed. The balance work shall be got 

done independently without risk & cost of the failed contractor. The failed 

contractor shall be debarred from participating in the tender for executing the 

balance work. If the failed contactor is a JV or a Partnership firm, then every 

member/partner of such a firm shall be debarred form participating in the 

tender for the balance work in his/her individual capacity or as a partner of 

any other JV/partnership firm. 

The engineer shall not make a claim under the Performance Guarantee except 

for amounts to which the President of India is entitled under the contract (not 

withstanding and/or without prejudice to any other provisions in the contract 

agreement)in the event of: 

(i) Failure by the contractor to extend the validity the Performance Guarantee 

as described herein above, in which event the Engineer may claim the full 

amount of the Performance Guarantee. 

(ii) Failure by the contractor to pay President of India any amount due, either 

as agreed by the contractor or determined under any of the 

Clauses/Conditions of the Agreement, within 30 days of the notice to this 

effect by Engineer. 

(iii)The Contract being determined or rescinded under provision of the GCC, 

the Performance Guarantee shall be forfeited in full and shall be 

absolutely at the disposal of the President of India. 

2.7 SECURITY DEPOSIT: 

In addition to the Performance Guarantee mentioned above, Security deposit 

at a flat rate of 5 % of the accepted value will be collected from the contractor 

as per latest GCC. 






The earnest money deposit of successful tender will be retained as a part of 

Security Deposit. The amount over and above the earnest money so retained to 

make up the full security deposit will be recovered from each running bills at the 

rate of 10 % of the bill amount till the full Security Deposit is recovered. The 

balance to make up the full Security Deposit will be recovered only from the 

running bills. Bank guarantee, fixed deposit, Government securities etc. will not 

be accepted for security deposit. 

No interest will be payable upon the Earnest Money and Security Deposit or 

amounts payable to the Contractor under the Contract, but Government Securities 

deposited in terms of Sub Clause (1) of this clause will be payable with interest 

accrued thereon 

Total Security Deposit deducted will be 5 % of total value (total accepted cost of 

both Schedule-A and Schedule-B). 

The security deposit shall be released against: 

• Schedule – ‘A’+’B’ after satisfactory completion of part (2.2.1) of the work 

including maintenance service during warranty period followed by issue of ‘Final 

Acceptance Certificate’ of the work with an unconditional and unequivocal ‘No 

claim certificate’ is signed by the contractor and submitted to the Railway 

Engineer. 

• Schedule – ‘C’ after satisfactory completion of part (2.2.2) of the work i.e. 

Comprehensive Annual Maintenance Service for the contracted period followed 

by issue of No Dues Certificate with an unconditional and unequivocal ‘No 

claim certificate’ is signed by the contractor and submitted to the Railway 

Engineer. 

2.8 Rescind of contract 

Whenever the contracts are rescinded, the security deposit should be forfeited and 

the performance guarantee shall be en-cashed and the balance work should be got 

done separately. 

The balance work shall be getting done independently without risk and cost of the 

original contractor. The original contractor shall be debarred from participating in 

the tender for executing the balance work. 

(1) Determination of contract owing to default of contractor (1) if the 

Contractor should :- 

(i) 

(ii) 

Becomes bankrupt or insolvent, or 

Make an arrangement with of assignment in favour of the creditors, or 

agree to carry out the contract under a Committee of Inspection of his 

creditors, or 






(iii) Being a Company or Corporation, go into liquidation (other than a 

voluntary liquidation for the purpose of amalgamation or reconstruction), 

or 

(iv) Have an execution levied on his goods or property on the works, or 

(v) Assign the contract or any part thereof otherwise than as provided in 

clause 7 of these conditions or 

(vi) Abandon the contract, or 

(vii) Persistently disregard the instructions of the Engineer, or contravene any 

provision of the contract, or 

(viii) Fail to adhere to the agreed programme of work by a margin of 10% of 

the stipulated period, or 

(ix) Fail to remove materials from the site or to pull down and replace work 

after receiving from the Engineer notice to the effect that the said 

materials or works have been condemned or rejected under clause 25 and 

27 of these conditions, or 

(x) Fail to take steps to employ competent or additional staff and labour as 

(xi) 

required under Clause 26 of the conditions, or 

Fail to afford the Engineer or Engineer's representative proper facilities 

for inspecting the works or any part thereof as required under Clause (28) 

of the conditions, or 

(xii) Promise, offer or give any bribe, commission, gift or advantage either 

himself or through his partner, agent or servant to any officer or 

employee of the Railway or to any person on his or on their behalf in 

relation to the execution of this or any other contract with this Railway. 

(xiii) (A) At any time after the tender relating to the contract has been signed 

and submitted by the contractor, being a partnership firm admit as one of 

its partners or employ under it or being an incorporated company elect or 

nominate or allow to act as one of its directors or employ under it in any 

capacity whatsoever any retired engineer of the gazetted rank or any 

other retired gazetted officer working before his retirement, whether in 

the executive or administrative capacity, whether in the executive post or 

not, in the Engineering Department of the Railways for the time being 

owned and administered by the President of India before the expiry of 

two years from the date of retirement form the said service of such 

Engineer or Officer unless such Engineer or Officer has obtained 

permission from the President of India or any officer duly authorized by 

him in this behalf to become a partner a director or to take employment 

under the contractor, as the case may be, or 

(B) 

Fail to give at the time of submitting the said tender: 

(a) 

The correct information as to the date of retirement of such retired 

engineer of retired officer from the said service or as to whether any such 

retired engineer or retired officer was under the employment of the

(e) 

contractor at the time of submitting the said tender or 

The correct information as to such engineers or officers obtaining 

permission to take employment under the contractor, or 

Being a partnership firm, the correct information as to whether any of its 

partners was such a retired engineer or a retired officer, or 

Being an incorporated company, correct information as to whether any of 

its directors was such a retired engineer or a retired officer, or 

Being such a retired engineer or retired officer suppress and not disclose 

at the time of submitting the said tender the fact of his being such a 

retired engineer or retired officer or make at the time of submitting the 

said tender a wrong statement in relation to his obtaining permission to 

take the contract or if the contractor be a partnership firm or an 

incorporated company to be a partner or director of such firm or 

company as the case may be or to seek employment under the contractor 

and after expiry of 48 hours notice, a final termination notice (Proforma 

as Annexure V) should be issued. 

Then and in any of the said clause the Engineer on behalf of the Railway may 

serve the Contractor with a notice (Proforma at Annexure III) in writing to 

that effect and if the Contractor does not within seven days after the delivery 

to him of such notice proceed to make good his default in so far as the same is 

capable of being made good and carry on the 

work comply with such directions as aforesaid to the entire satisfaction of the 

Engineer, the Railway shall be entitled after giving 48 hours notice (Proforma 

at Annexure IV) in writing under the hand of the Engineer to rescind the 

contract as a whole or in part or parts (as may be specified in such notice). 

(2) Right of Railway after rescission of contract owing to default of Contractor- In 

the event of any or several of the courses, referred to in sub-clause (1) of this 

clause, being adopted: -

The Contractor shall have no claim to compensation for any loss sustained by 

him by reason of his having purchased or procured any materials or entered 

into any commitments or made any advances on account of or with a view to 

the execution of the works or the performance of the contract and Contractor 

shall not be entitled to recover or be paid any sum for any work there to for 

actually performed under the contract unless and until the Engineer shall have 

certified the performance of such work and the value payable in respect 

thereof and the Contractor shall only be entitled to be paid the value so 

certified. 

The Engineer or the Engineer's Representative shall be entitled to take 

possession of any materials, tools, implements, machinery and building on the 






works or on the property on which these are being or out to have been executed, 

and to retain and employ the same in the further execution of the works of any 

part thereof until the completion of the works without the Contractor being 

entitled to any compensation for the use and employment thereof or for wear and 

tear pr destruction thereof. 

The Engineer shall as soon as may be practicable after removal of the Contractor 

fix and determined ex-parte or by or after reference to the parties or after such 

investigation or enquiries as he may consider fit to make or institute and shall 

certify what amount (if any) had at the time of rescission of the contract been 

reasonably earned by or would reasonably accrue to the contractor in respect of 

the work then actually done by him under the contract and what was the value of 

any unused, or partially used materials, any constructional plant and any 

temporary works upon the site. The legitimate amount due to the contractor after 

making necessary deductions and certified by the Engineer should be released 

expeditiously

2.9 PROGRAMME OF WORK EXECUTION

The Contractor shall have a competent project team with adequate resources to 

execute the work so that the entire work is completed within the completion 

period as mentioned in Clause 2.1 above ( Chapter II, Special Conditions of 

Contract). 

The Contractor is expected to have worked out a tentative programme for 

execution of the work well before issue of “Letter of Acceptance”, by Railway. 

Within 15 days of the date of issue of the LOA Contractor shall commence the 

work by way of submitting a Detailed Time and Activity Schedule for the 

execution of work aiming at completing the entire work within the stipulated 

completion time. The schedule shall thereafter be approved by the Engineer-In- 

Charge normally within 5 working days. 

Railway reserves the right to modify the activity schedule while approving the 

same as well as at any stage during execution if situation so warrants. Once 

approved, in the event of any slippage from the time schedule especially when 

resulting into time over-run of the work the contractor shall submit revised 

schedule duly justifying the circumstances without any delay. The revised 

schedule shall be approved by the Engineer-In-Charge only when considered 

justified in his opinion otherwise it will attract penal action on the contractor as 

per provision of this contract. 






2.10. SITE ORDER BOOK: 

An Inspection Register/ Site Order book shall be maintained at the site of work by 

the contractor, wherein the Engineer in charge of the work or his executive 

subordinate shall record instructions regarding the working etc. It is expected that 

the Contractor or his representative at the site shall note such instructions 

whenever asked upon to do so and take action accordingly. This register shall 

have entry on day-to-day basis regarding the progress of work. Record should 

also be kept with joint signature of Railways & firms representative for all release 

wiring (if any) too. This should be produced during the inspection & check of 

Railway engineer in charge along with drawing showing new installation 

locations. 

2.11 STORES TO BE SUPPLIED BY CONTRACTOR: 

(i) 

All materials mentioned in the schedule of material and works required for the 

execution of the contract, shall be arranged and supplied by the Contractor in the 

stores Depot. of SSE/Tele/II Ahmedabad or as advised by the Engineer In charge 

to realize the end objective. 

(ii) The material mentioned in the schedule shall be delivered by the Tenderer at 

various location depending on requirement, which is to be issued by Engineer In 

charge at appropriate time on receipt of a written request from the contractor. 

(iii) The contractor will be responsible for the safety of the material at site from the 

date of issue to the date of issue of Provisional Acceptance Certificate of the 

system. 

(iv) Authorized representative(s) of engineer in-charge will keep record of material on 

day-to-day basis in summarized form and shall convey monthly position of store 

supplied by and issued to the contractor to the engineer in-charge of the work 

2.12 WORK SPECIFIC DRAWINGS: 

(i) This will constitute – 

(a) 

(b) 

Wiring and cable laying diagram 

Test results of each item. 

(ii) The documents viz. Block diagram of various components function of individual 

cards/modules, step-by-step fault diagnostic and remedial action to be taken along 

with procedure for maintenance of equipments specific in this work should be 

supplied by the contractor. 

(iii) Sets of two hard copies containing details of technical specifications, installation 

and commissioning, trouble shooting & maintenance schedule etc. shall be 

supplied before finalization of work 






2.13 QUALITY ASSURANCE DOCUMENTATION (FOR SUPPLY OF 

MATERIALS): 

(i) The Tenderer shall submit the quality control plan alongwith the tender including 

full details of in-house quality assurance organization, procedures and 

documentation. During the manufacturing process, proper record shall be 

maintained for the purpose of inspections and all the tests should be carried out 

according to that. 

(ii) In the event of Railways waving off the inspection, all tests provided in the test 

schedules approved by Railways shall be carried out by the quality assurance 

organization and proper record of all such tests and results thereof shall be 

maintained and supplied to railways on demand along with the supply. 

(iii) It is desirable that Tenderer has to submit detail list of acceptance test & 

procedure, method of test required to be carried out by the railway for the 

assurance of the quality and real functionality of the system. 

2.14. FUTURE AVAILABILITY OF SPARES AND ADDITIONAL PARTS: 

For future expansion maintenance of the system, spares and additional parts or 

other components shall be required by the Railways. Tenderer shall guarantee that 

Spares and such additional parts will be supplied as and when railways place 

order for the same, therefore firm has to give detailed specification of the items 

being used & supplied by him as ordering details. Tenderer shall also provide 

warranty that this material will be supplied at a rate not exceeding the rate 

accepted by the Railways which is shown in the break-up of the costs in Schedule 

of Work upto the expiry of warranty period. Any order placed by railways on the 

Contractor within the expiry of warranty period will be fully honoured and the 

materials will be supplied within the period of 60 days or as required by the 

railway. The fact that contractor is supplying some materials from 3 rd party will 

not absolve the tenderer from his responsibility. 

2.15. TEST & MEASURING INSTRUMENTS, SPECIAL TOOLS AND 

INSTALLATION MATERIAL: 

(i)

All tests and measuring instruments and other arrangements required for all the 

acceptance tests shall be made available by the contractor free of cost for 

conducting the tests. 

Special tools required for installation and maintenance of all the equipments shall 

be arranged by the contractor in adequate quantities. The contractor shall provide 

all installation material for complete commissioning of the system. 






2.16. INSPECTION OF MATERIAL: 

(i) 

The inspection of material shall be done by RDSO / Railways (Engineer In charge 

of the work or Railway representative nominated by, Western Railway) in the 

factory premises / assembling unit of the contractor. 

(ii) All equipment, materials, fittings and components will be subject to inspection by 

the RDSO/Railways at the manufacturer’s factory premises/assembling unit, 

before dispatch and no materials shall be dispatched from the manufacturer’s 

factory/assembling unit prior to inspection and/or approval by the Railways. The 

Railway may also inspect the materials again at the contractor’s depot or with 

consignee. The Railways shall have the right to be present during all stages of 

manufacturing and test process and shall offer, reasonable facilities for inspection 

and testing of the material at all the stage so as to satisfy himself that the materials 

are in accordance with the specifications and approved drawing / 

designs. Any unreasonable delay in inspection will be on reasonable ground for 

extension of time for completion of the work. 

(iii) Materials put up for inspection shall be exactly of the type, quality and quantity 

laid down in the schedule of materials. Any variation shall require the prior 

approval of the Railway before the material is manufactured, tendered or offered 

for inspection. 

(iv) In the event of waive off of Inspection at Manufacturer’s premises, The contractor 

has to arrange all the OEM’s test certificate along with certification that the 

equipment under supply are as per Railways’ specification. 

(v) 

All materials that are not covered under the specifications, designs and drawings 

of RDSO/TEC etc. shall be procured from the manufacturers of repute/theirauthorized 

dealers. Such materials are to be approved by the engineer. The 

contractor is required to produce test certificate from the manufacturer. 

(vi) The cost of services of Railway Engineers or other personnel for inspection of 

material will be on Railway’s account subject to other provisions herein 

contained. The Contractor shall give at least two weeks’ notice to the RDSO / 

Railways to arrange necessary inspection. 

(vii) During the execution of the contract, samples may be taken from all the 

materials employed for the purpose of test and or analysis, under the conditions 

laid down in specification; such samples to be prepared for testing and forwarded 

to the testing entity shall be free of cost to the Railways. 

(viii) The decision of the Railway in respect of acceptability of any material, 

equipment etc. required for the work. The cost of equipment and materials, all 

tests and or analysis performed for inspection shall be borne by the Contractor. 






(ix) 

All materials to be used on this installation shall be subject to inspection by 

RDSO /RITES / RAILWAY Representative as per predefined guide lines given 

below at site / manufacturer's premises. For this purpose, the contractor shall give 

sufficient notice of time ( at least 15 days) to RDSO / Railway Representative 

when the material is ready for testing/ inspection. The contractor for carrying out 

the tests as may be necessary shall provide all facilities. The Contractor shall 

make such tests as may be necessary to demonstrate to the satisfaction of the 

Railway that the apparatus and the system as installed are in accordance with the 

requirements of the specifications and contract. The Contractor shall provide 

such instruments and apparatus as may be necessary for making the tests. Board's 

letter no.74/RS(G)/379/2Pt. Dated 4-3-91 and 18-6-91. 

• In respect of signaling items other than those mentioned above RDSO will 

undertake inspection of only such orders the value of which is more than Rs. one 

lakh and inspection in respect of those orders below Rs. one lakh may be got done 

by RITES, subject to supplies being from sources approved by RDSO. 

• Railway Board vides latter No.98/Sig/SGF/2 dt. 21-09-2005 has stopped the use 

of Maintenance free Secondary Cell as per Spec No. IRS: S 93/96 (A) for 

Signalling applications. 

• (a) Railway Board Letter No.2006/Tele/TC/1 Dated 17-04-2006 & dated 09-01- 

2008 wherein it has been specified for inspection of Telecom items that: the 

materials which are procured from RDSO approved firms with RDSO 

specification and if the cost of the material is over Rs. 1 lakh, the inspection shall 

be carried out by RDSO. 

(b) All the materials with TEC/BSNL specification ad procured from TEC/BSNL 

approved firms (approved for bulk supply and not as interface approval) shall also 

be inspected by RDSO provided the cost of the material is more than Rs. 1 lakhs. 

(c) All the materials with TEC/BSNL specification and procured from sources not 

approved by TEC/BSNL (including firms having only interface approval) shall 

also be inspected by RDSO provided the cost of the material is over Rs. 5 lakhs. 

However, in such cases RDSO shall carry out prototype approval before taking up 

(d) 

regular inspection. 

Sophisticated telecom items as an exception can also be taken up for inspection by 

RDSO as per Railway's specification. The approved acceptance test format shall 

have to be supplied by Railways duly approved by the concerned CSTE. 

(e) RDSO shall not inspect "Test and Measuring” equipments, Electronic exchanges / 

intercom, auto telephones and spare parts of all telecom equipments. The same 

may be inspected by Railway's representative as nominated by zonal railways.

(x) 

RITES INSPECTION 

As per RITES letter No. RITES/WR/MIS/07 Dated 13-08-2007. RITES will carry 

out inspection of items of Amount greater than or equal to Rs.1 lakh only. 

Therefore items other than those mentioned above and of Amount less than Rs.1 

lakh shall be inspected by consignee. But it Should be strictly ensured that the 

items which are manufactured by RDSO approved sources shall be supplied by 

RDSO approved sources only. Certificate in this regard should invariably be 

submitted along with. 

As per Railway Board's letter No. 2000/RS (G)/379/2 dt. 27-05-2008 In specific 

cases of purchase orders valuing less than Rs. 1 lakh, where the inspection 

involves technical expertise or a special facility that is ordinarily not available 

with the consignee, the pre-inspection shall continue to be made by RDSO/RITES 

as advised in Board's letter or even no. dated 09-08-2006 

(xi)

INSPECTION CHARGES 

Inspection charges approximately @ 1% of the cost levied by RDSO/RITES shall 

be borne by contractor, not applicable for this tender . 

MATERIALS AND WORKMANSHIP 

• All the items shall be procured from RDSO approved firms to IRS / RDSO 

Specification and shall be inspected by RDSO. Further items which do not have 

RDSO Specification or for which RDSO has not approved any suppliers, 

inspection shall be carried out by RITES / Authorized Railway Representatives. 

In this case the material shall be accepted only against firm's guarantee certificate. 

(RDSO approved firms shall be from the Part – I list only). 

• Any relaxation with respect to procurement/inspection shall be with the prior 

approval of the competent authority. The Railway's decision shall be final and 


• Material shall be in accordance with Specifications and Drawings specified or 

approved by the Railway with latest amendments. 

• The Railway shall have full powers to reject any material that the Railway may 

consider to be defective or inferior in quality, workmanship, and design or 

otherwise, not in accordance with the specifications and drawings specified by the 

Railway. 

• The contractor shall remove forthwith all rejected materials and replace such 

material at his own expenses. 

• All material should be in properly packed condition and the consignee reserves 

the right to reject the material even though it was passed by RDSO/RITES. 






2.17 INSPECTION OF WORKS: 

The Engineer In-charge or his authorized representative may inspect and test the 

various portions of the work at all stages and shall have full power to reject all or 

any portion of the work that he may consider to be defective or inferior in quality 

of materials, workmanship or design in comparison to what is called for in the 

specification. In the event of rejection of any work already executed and not in 

accordance with specification as in this tender and / or as determined by the 

Engineer or which the Contractor has been apprised, the Contractor shall carry 

out alterations/replacements to such works to the satisfaction of the Engineer Incharge 

of the work for which no additional payment will be borne by the 

Railways. 

2.18 INSPECTING OFFICER – POWER OF REJECTION 

The supply portion of work wilI be inspected by ADSTE/ADI or any 

representative of DRM(S&T) ADI as nominated to realize the end objective. The 

execution portion will be inspected by respective Sectional officer or any 

representative of DRM(S&T) ADI as nominated to realize the end objective. 

Power of rejection:-

To reject any items submitted as not being in accordance with the tendered 

technical specification. 

To reject the whole of the installation offered for inspection, if after inspection the 

inspection authority is satisfied that the material offered for inspection is 

unsatisfactory. 

To mark the rejected stores with a rejection mark, so that they can be easily 

identified if resubmitted. 

The inspecting officer’s decision as regards the rejection shall be final and 


Note- The contractor shall arrange, when so required, suitable means of transport 

for inspection of material/ work sites by officer nominated for this purpose on 

the days mutually decided. 

2.19 CONSIGNEE’S RIGHT OF REJECTION: 

(i) 

Notwithstanding any approval which the inspecting officer may have given in 

respect of the stores or any materials or the work or workmanship involved in the 

performance of the contract (Whether with or without any test carried out by the 

contractor or the Inspecting officer or under the direction of the Inspecting 

officer) and notwithstanding delivery of the stores where so provided to the 






interim consignee, it shall be lawful for the consignee, on behalf of the 

purchaser, to reject the stores or any part, portion of consignment thereof within 

a reasonable time after actual delivery thereof to him at the place or destination 

specified in the contract. If such stores or part, portion of consignment thereof is 

not in all respects in conformity with the terms and conditions of the contract 

whether on account of any loss, deterioration or damage before dispatch or 

delivery or during transit or otherwise whatsoever. 

(ii) When any stores delivered at the consignee’s depots are rejected, this shall be 

removed by the contractor within 15 days from the date of rejection. Such 

rejected stores shall lie at the contractor’s risk from the date of rejection. If the 

stores are not removed by the contractor within this period, the purchaser or his 

nominee shall have the right to dispose of such stores, as deemed fit, at the 

contractor’s risk and account. 

(iii) The purchaser shall also be entitled to recover from the contractor, handling and 

ground rent/demurrage and any other charges for the period the rejected stores 

are not removed after the aforementioned period. 

(iv) Stores that have been dispatched by rail and rejected after arrival at destination 

may be taken back by the contractor either at the station where they were 

rejected or at the station where they were dispatched. If the contract is placed 

for delivery F.O.R. station of dispatch, the contractor shall pay the carriage 

charges on the rejected consignment at Public Tariff Rates from the station of 

dispatch to station where they were rejected. If the contractor prefers to take 

back the goods at the station from which they were dispatched, the goods shall, 

in addition, be booked back to him, freight to pay at Public Tariff Rates and at 

owner’s risk. 

2.20 CONSEQUENCES OF REJECTION: 

If on the stores being rejected by the Inspecting Officer or consignee at the 

destination, the contractor fails to make satisfactory supplies within the 

stipulated period of delivery, the purchaser shall be at liberty to: - 

i. Request the contractor to replace the rejected store forthwith but in any event 

not later than period of 21 days from the date of rejection and the contractor 

shall bear all the cost of such replacement, including freight, if any, on such 

replacing and replaced stores but without being entitled to any extra payment on 

the or any other account. 

ii. 

Purchase or authorize the purchase of quantity of the stores rejected or others of 

a similar description (when stores exactly complying with the particulars are not 

readily available, in the opinion of the purchaser, which shall be final), without 

notice to the contractor action will be taken as per Clause 2.8 of Chapter II, 

Special Conditions of Contract , OR 






iii. 

Cancel the contract and purchase or authorise the purchase of the stores or 

others of a similar description (when stores exactly complying with the 

particulars are not readily available, in the opinion of the purchaser, which shall 

be final) and action will be taken as per Clause 2.8 of Chapter II, Special 

Conditions of Contract. 

2.21 RIGHT TO RAILWAY TO KEEP BACK FROM THE CONTRACT OR 

ANY PORTION OF THE WORK. 

The successful tenderer will however, have no claim or right in the execution of 

work which in the opinion of the Engineer should be carried out departmentally 

or otherwise and the Railway reserves the right that any time after acceptance of 

the tender, to keep back from the contract and carry out the work or any portion 

of work, through any other agent. No claim for compensation/loss or 

whatsoever on this account will be entertained by the Railways. 

2.22 SUBLETTING AND ASSIGNMENT: 

(i) The contractor may sublet a part of the works under this contract and enter into 

contract with suppliers for supply of materials. 

(ii) The names of all subject contractors proposed to be employed for execution of 

work or any part thereof including manufacturing of equipment and other 

materials shall be submitted by the contractor to the Railway and got approved 

by him before the contractor enter into an agreement with the sub contractor for 

the purchase. 

(iii) The contractor shall arrange for effective supervision of sub contractor’s work 

and remain solely responsible for materials supplied and for works carried out 

on his behalf by the sub contractor. The contractor shall not, save with the 

previous consent in writing of the Purchaser, sublet, transfer or assign the 

contract or any part thereof or interest therein or benefit or advantage thereof 

any manner whatsoever. 

In the event of the Contractor’s subletting of assigning this contract or any part 

thereof without such permission, the Railway shall be entitled to cancel the 

contract and action will be taken as per Clause 2.8 of Chapter II, Special 

Conditions of Contract. 

2.23 EXECUTION OF WORK 

All the work shall be executed in strict conformity to the provisions of the 

contract document and with such explanatory detailed drawings, specifications 

and instructions as may be approved from time to time by the Railways, based 






on detailed design and engineering carried out by the contractor in line with 

requirements as per contract document. The contractor shall be responsible for 

ensuring that the work throughout are executed in the most substantial, proper and 

workmanlike manner with the quality of material and workmanship in strict 

accordance with the specifications and as per sound industrial practices and to the 

entire satisfaction of the Railways. 

2.24 PROGRESS REPORTING 

The Contractor shall submit the periodic progress reports at regular intervals 

regarding the state and progress of work to the Railways. The details and 

Performa of the report will mutually be agreed after award of the contract. Such 

reports shall be for daily manpower, equipment and plant development, weekly 

work progress and monthly progress review reports. All actions as directed by 

Railways, pursuant to such reports shall be promptly attended to by Contractor. 

2.25 MEASUREMENT OF WORKS 

Payments for the works shall be made in accordance with approved designs and 

drawings and measured in relevant units. The measurements will be made 

generally in accordance with standard engineering practice and in conformity with 

the General Condition of Contract. 

The contractor will obtain written approval of the supervisor after completion of 

the various sub-items of each work mentioned in the schedule (wherever 

applicable). 

a) The contractor shall sign the measurement book as a token of acceptance of the 

measurement entered by the supervisor in-charge of the work (wherever 

applicable). 

b) The contractor should ensure that measurement has been made for such work, 

which is not possible to measure subsequently and shall remain hidden. For 

example: 

• After trenching is done. 

• After RCC trunking is placed in trench and properly aligned. 

• After the above is laid properly. 

• After the earth is filled. 

• After brick / slab / capping is laid. 

• Any laying of cable on roof, post etc. 

c) Back filling of the trench shall be done only after the inspection and written 

confirmation from the Railway representative. 

d) The contractor shall maintain record of cable laid as per Performa in Drawing 

CSTE / 3644 (pages 10 & 11). 






Cable laying shall be done as per technical specifications and instructions for 

trenching laying of S&T cables issued by CSTE and as per CSTE drawing no. 

3644 (pages 1 to 11). 

2. 26 SAFETY OF WORK AND TRAINS 

• The contractor shall conform to all Railway Rules relating to safety of 

personal and operation of signals and points. In the A.C. electrified areas the 

special precautions as laid down in the manual for installation of S&T 

equipment in AC electrified area, shall be taken. 

• The contractor shall do no work that may interfere with traffic until protection 

has been provided by the Railway and under the supervision of Rly's 

representative. 

• While testing and commissioning of the system, the contractor shall not work 

without the authorization from the railway in-charge of the work. 

• The contractor shall also be responsible for any damage that he may cause due 

to the carelessness of his workman and will bear the consequences in this 

regard. 

• The contractor will not be entitled to any compensation for any damage or 

loss sustained by him during execution of the work for any idle labour or 

transport or any loss of deterioration of the material or tools. 

2.27. MEANING AND INTERPRETATION BY RAILWAYS TO BE FINAL 

All measurement, method of measurement, meaning and intent of 

specifications and interpretation of Special Conditions of Contract, given and 

made by the Purchaser or by the Purchaser Engineer shall be final and binding 

and shall be considered “excepted matters” in terms of conditions laid down in 

the General Conditions of Contract. 






2.28 TERMS OF PAYMENT 

Subject to any deductions or recovery which the Railway may be entitled to make 

under contract, the Contractor will be entitled to be paid from time to time by way 

of on account payment for supply of goods and progress made for works in the 

opinion of the Engineer-In-Charge that he has executed in terms of contract, as 

per the following terms & conditions:- 

(i) 

“On Account Payment” at the rate of 80% for the items supplied and installed, 

will be made subject to successful installation, testing & commissioning of the 

CCTV cameras in ICU-SBI covered by item no. 1 to 8 of schedule “A” followed 

by observation of satisfactory performance for a period of one month along with 

submission of certificate by the contractor that the materials supplied and 

executed as per the contract and the amount claimed in the invoice is correct as 

per terms of the contract. 

• Original Inspection certificate issued by concerned Inspecting Officer. 

• Challan /Invoice in duplicate. 

• A certificate should be submitted by the contractor that the materials supplied are 

as per the contract and the amount claimed in the invoice is correct as per terms of 

the contract. 

(ii) 

Balance 20% will be made after commissioning of entire system CCTV at ICU 

Sabarmati Hospital followed by the observation of satisfactory performance for a 

period of after expiry of warranty period and issue of Final Acceptance Certificate 

thereafter. 

2.28.1 DEDUCTION FROM ON ACCOUNT PAYMENT BILLS - All costs, damages 

or expenses, which Railways may have paid or incurred, which under the 






provisions of contract are Contractor’s obligations will be deducted by Railways 

from progress payment Bills/Invoice of Contractor, as and when it is understood 

that such an expenses has been incurred or paid for. All such claims of Railways 

shall, however, be duly supported by appropriate and certified vouchers, receipts 

or explanations as are available to enable the Contractor to identify such claims. 

2.28.2 Cess & Water charges, if applicable will be recovered from the contractor as per 

rules. 

2.28.4 TAXES – 

Deduction of Income Tax at source as per provisions of Finance Act and Income 

tax in force shall be made from the Contractor/Sub-Contractor and the amount so 

deducted will be credited to the central Government. Settlement of Income Tax 

should be made with Income Tax authorities. Wherever the law makes it statutory 

for the Purchaser to deduct on amount towards Sales Tax on Works Contract, the 

same will be deducted and remitted to the concerned authority. 

(ii) 

The contractor and all personnel employed by him shall pay such taxes like 

Income Tax as are payable under statutory laws of India and the Purchaser will 

not accept any liability for the same. 

(iii) 

As per AFA (X) CCG letter No. X / Income Tax / Policy and corresp / H.Q 

dt.28.05.10, following in this revised rates of Tax deduction at source to be 

deducted from the bills as for finance (No. 2) Act.2009

Regarding any changes in income tax rates under section which ever is applicable, 

Income tax ready reckoned pertaining to the relevant year may also be referred. 

2.29 The payments for AMC will be made on quarterly basis at the end of each 

quarter. While making the payment for each quarter 95% of the total amount due 

at the end of that particular quarter will be paid to the contractor, the remaining 

5% balance from first 11 (eleven) quarters will be paid at the end of the twelveth 

quarter on successful completion of maintenance period for full three year. 

Quarterly payments (which are also called progress on account payment) shall be 

made on the certificate of the Engineer that the maintenance for preceding quarter 

for which the payment has become due, has been carried out successfully 






2.30 FINAL SETTLEMENT 

Security deposit and Performance bank Guarantee will be released as per clause 

2.6 and 2.7 of chapter –II Special Conditions of Contract respectively, after 

adjustment of any dues payable by the Contractor. 

2.31 DEDUCTION FROM ON ACCOUNT PAYMENT BILLS:

which under the provisions of contract are Contractor’s obligations will be 

deducted by Railways from progress payment Bills/Invoice of Contractor, as and

(ii) All such claims of Railways shall, however, be duly supported by 

appropriate and certified vouchers, receipts or explanations as are available to 

enable the Contractor to identity such claims. 

2.32 PROVISIONAL ACCEPTANCE TEST: 

As soon as the Contractor informs the Railway and the Purchaser’s Engineer 

determines that the works are completed from end to end, Railways shall carry out 

all tests as per the acceptance test schedule. Any component, modules, subassemblies 

or equipment failing during the commissioning test shall be 

replaced/repaired free of cost by the tenderer. When all the tests are successfully 

completed end to end, the provisional test report will be jointly prepared. 

2.33 OBSERVATION PERIOD: 

After the completion of provisional acceptance test, system shall be put under 

observation for period of 15 days. During this period Railway may at their 

discretion connect the user equipment and observe the performance from the end 

user point of view. If any defects or failures are noticed during this period the 

contractor will replace or rectify such modules and additional test or repetition of 

some of the tests will be carried out to make sure that all parameters are within 

specified values. 

2. 34 PROVISIONAL ACCEPTANCE CERTIFICATE 

After completion of provisional acceptance test and if no problems are noticed 

during observation period, the Engineer in-charge shall issue a Provisional 

Acceptance Certificate for successfully commission of whole system covering all 

materials and services included in the Schedule of works, after the acceptance test 

and as per the approved test procedure have been completed and the performance 

has been found to meet the specifications. The decision of Engineer in-charge in 

this respect shall be final. The date of issue of the Provisional Acceptance 

Certificate will be treated as the date of Completion of the work. 






2.35 PART COMMISSIONING 

If the works are not completed as per the programme of work and there is 

deviation from the milestones to be achieved Railways will be free to make use of 

the partially commissioned work. Making such use of partially commissioned 

work will not be deemed as provisional acceptance from the Railways. 

2.36 PLACING IN SERVICE AND MAINTENANCE 

(i) 

After the equipment has been commissioned and placed in service and Provisional 

Acceptance Certificate is issued by the Engineer in-charge, the contractor shall be 

responsible for proper maintenance of the equipment for a period of one year of 

schedule ‘A’ & ‘B’ from the date of issuing of the provisional acceptance 

certificate. For this purpose he shall prepare a maintenance plan and make 

available the services of qualified maintenance engineers for a prompt service. 

(ii) Service engineers for maintenance shall normally be out of those engineers 

associated with the execution of the work. Details of the Service 

Personnel/Engineers (Bio-data and experience) proposed to be associated with 

maintenance, shall be furnished by the Contractor to the Railways, well in advance 

of the commencement of the maintenance period. Changes, if any on special case 

shall be with the specific approval of Engineer in-charge. 

(iii)

The team will comprise of atleast one Maintenance Engineer and other supporting 

staff (preferably located at Ahmedabad ). Maintenance Engineers will be stationed 

at the location approved by Engineer in-charge and Contractor will make sure that 

they can be easily contacted through telephones/Cell Phones at any time. 

If any lacuna is noticed in the functions as a result of any defect in configuration or 

manufacture, the same will be rectified by the contractor free of cost. During such 

rectification if any faulty equipment/modules need replacement or repair, they 

shall be provided by the contractor from the set of equipment or modules that the 

contractor should bring to the site of installation in addition to all the materials to 

be supplied against this contract. Use of spare modules covered under the schedule 

of material of this tender shall not be permitted to be used during installation, 

commissioning and during the period of maintenance/supervision for thirty six 

months. 

2.37 WARRANTY and MAINTENANCE PERIOD UNDER WARRANTY: 

The contractor shall warrant that every equipment shall be free from defects and 

faults in design, materials, workmanship and manufacture and shall be of highest 

grade and consistent with the established and generally accepted standards for 

goods of the type ordered. The warranty of materials/works schedule ‘A’’ 12 






months for a period of from the date of completion of the work i.e. date of issue 

of the Provisional Acceptance Certificate. 

The contractor shall rectify any defect with in 24 hrs. either in materials supplied 

and /or due to bad/poor workmanship in all respect including replacement (if 

necessary) of material and/or works free of charge during the said warranty 

period. In case of any unusual delay of rectification of any part or function of the 

installations the warranty period may be extended to the extent of the delay and in 

this matter the decision of the Engineer in-charge will be final. 

2.38 FINAL ACCEPTANCE

The final acceptance of the entire equipment installed in the section shall take 

effect from the date of expiry of the period of maintenance ( as defined in the 

clause 2.36) after testing and certification of Engineer in-charge. 

The contract shall not be considered as completed until the issue of 

Final Acceptance certificate by the Purchaser. 

The purchaser shall not be liable to the Contractor for any matter arising out of or 

in connection with the contract or execution of the work unless the contract shall 

have made a claim in writing in respect thereof before the issue of Final 

Acceptance Certificate under this clause. 

Notwithstanding the issue of Final Acceptance Certificate, the contractor and the 

purchaser (subject to Sub Clause as above) shall remain liable for fulfillment of 

any obligation incurred under the provision of the contract prior to the issue of 

Final Acceptance Certificate which remains unperformed at the time such 

certificate is issued and for determining the nature and extent of such obligation 

the contract shall be deemed to remain in force between the parties hereto. 

2.39 ANNUAL MAINTENANCE CONTRACT:-

Comprehensive Annual Maintenance Contract for the period of 3 years after 

commissioning of entire system and successful completion of stipulated warranty 

period shall be separately entered into by Railway and Contractor as per the 

accepted rates and terms & conditions quoted by the Tenderers which shall be 

binding on them. The date of commencement of Annual Maintenance Service 

under the AMC shall be reckoned from the date of issue of Final Acceptance 

Certificate as per Clause 2.38 or the date of execution of the AMC whichever is 

later. However Western Railway reserves its right to terminate such Contract at 

any stage which shall be acceptable to the Tenderer without any demur. 

This shall be a comprehensive AMC, Railway will not provide any material 

during the comprehensive AMC period. The comprehensive maintenance 

consists of the following; 






• The rates of AMC charges shall be inclusive of costs towards all type of recurring 

licensing fees, upgrades, replacements etc against all software, firmware and 

hardware components, sub-systems, systems etc to be covered under AMC. 

• Regular Preventive maintenance once in a quarter. 

• Attending and rectification for corrective maintenance within 48 Hrs of call against 

any major failure. The decision of Railway on the nature of the failure whether 

major or not shall be binding on the contractor. 

• All types of defects arising in any of the software, firmware and hardware will be 

attended as part of AMC with in 24 hrs of receiving information. The rectification 

period for the fault will not be more than 48 Hrs from the time of receiving 

information. 

• All types of faults in DVR/cameras/monitor and other item shall be rectified with-in 

48 hrs of receiving the information. 

• The contractor is expected to maintain requisite amount of spares in all the divisions 

to keep the downtime minimum. 

• All types of defects/bugs in software/hardware will be rectified as part of AMC. It 

includes replacement of any hardware/software if required. 

• If the Railways desire changes in system configuration/ system design without 

involving hardware change/ replacement in a ICU Sabarmati Hospital it will be 

done by the contractor as a part of AMC. 

• Contractor shall submit a detailed escalation cameras in handling the issues 

related to AMC and promptly advice any changes thereon as and when taking 

place. 

For this purpose it is desirable to have branch offices of contractor in 

Ahmedabad areas. 

As a part of AMC if the contractor needs to replace any of the hardware part he will 

provide a fresh new one purchased from OEM, not a reconditioned or refurbished 

one. 

The maintenance engineer for AMC shall be available on call in every division. It is 

desirable that the maintenance engineer shall be stationed at places approved by 

Engineer in charge in every division. The contact number of his/her shall be made 

available to the Railways’ Engineer-in-charge. 

The record for the work done during AMC & failure calls shall be maintained. It 

shall be jointly signed by the representative of the tenderer & representative of the 

Railway. 






After completing the preventive maintenance as well as corrective maintenance 

work, the Service Engineer shall meet / communicate and take acknowledgement 

from the designated representative of Railway, indicating the nature of the work 

done. 

During the period of AMC, the contractor will replace all the defective 

equipments, cards & components including software if any at his own cost. The 

defective component/parts removed from the system, shall be the property of the 

contractor. 

The corrective maintenance shall be done by visiting the installations as soon as a 

call is made to the Contractor and such calls should be attended within 24 hours 

from the receipt of the call. 

The contractor shall provide a working substitute for the Equipment in case the 

Equipment or any sub-system/sub-assembly is taken out for repairs at their 

workshop or the repairs are being carried out at the site. 

All to and fro transportation, handling charges, etc. will be borne by the 

contractor. 

In case the contractor fails to repair any item to the full satisfaction of the Railway 

within a reasonable time, the Railway shall be at liberty to get the same repaired 

by engaging any other agency as per the sole discretion of the Railway, and action 

will be taken as Clause 2.8 of S.C.C. 

Quality and standard of parts replaced shall be original or similar so that quality 

of service is not degraded. 

2.40 PENALTY :- 

Penalty in case of AMC if any / all subsystems remains faulty without a proper 

substitute for more than specified period as under after intimation of failure to the 

contractor then a penalty will be levied which will be calculated as follows: 

The penalty evaluated per faulty component shall be as : 

Suppose the moment the failure information is received by contractor at a day 

‘A’. Contractor will attend the failure within A+ 48 Hrs. 

All faults related including software maintenance, i.e. operating system (OS) 

software of various software driven equipments, camera, Monitor DVR & 

CD/DVD writer drives etc. Repair of defective hardware equipments/ modules 

and subsystems during the AMC period and other items will be rectified within 

A+48 hrs. 






After lapse of A + 48 Hrs. if the failure persists then a penalty will be imposed. 

Suppose No. of days eligible for penalty = X 

Total AMC value of the concerned component installed = Y. 

Per day AMC value of the concerned component = Y / 365. 

Penalty = Z = X * (Y/365) * 2. 

Penalty of `.1000/- shall be imposed monthly for location as per schedule whose 

maintenance has not been carried out as per schedule. 

2.41 INSURANCE OF MATERIALS AND INSTALLATIONS: 

(i)

The Contractor shall take out and keep in force a Policy or policies of Insurance 

for all materials including railways supply materials/equipment irrespective of 

whether used up in the portion of work already done or kept for the use in the 

balance portion of the work until such works are provisionally handed over to the 

Railways. 

For this purpose the works are deemed to have been provisionally handed over 

when provisional acceptance certificate is issued. 

The contractor shall not be liable for losses/damages to the materials either used 

up in the portion of work done or his material kept for use at site, inconsequence 

of mutiny, or other similar causes over which the Contractor has no control and 

which cannot be insured. Such losses or damages shall be the liability of the 

Purchaser and if required by the Purchaser, be made good by the contractor, at the 

cost of the Purchaser. 

The contractor should, however insure the stores brought to site against risks in 

consequence of war and invasion as required under the Emergency Risk (Goods 

Insurance) Act in force from time to time. 

2.42. VARIATION IN CONTRACT QUANTITIES 

New Clause 42(4) to Indian Railways General Conditions of Contract. (Ref:- 

Item-9 to Railway Board’s letter no.2007/CE-I/CT/18 dated 28.09.2007 and 

Item-2 to letter no.2007/CE-I/CT/18 Pt.XII,dated 31.12.2010} The procedure 

detailed below shall be adopted for dealing with variations in quantities during 

execution of works contracts: 

1. Individual NS items in contracts shall be operated with variation of plus or 

minus 25% and payment would be made as per the agreement rate. For this, 

no finance concurrence would be required. 

2. In case an increase in quantity of an individual item by more than 25% of the 

agreement quantity is considered unavoidable, the same shall be got 

executed by floating a fresh tender. If floating a fresh tender for operating 

that item is considered not practicable, quantity of that item may be operated 






in excess of 125% of the agreement quantity subject to the following 

conditions: 

(a) Operation of an item by more than 125% of the agreement quantity needs 

the approval of an officer of the rank not less than S.A. Grade; 

(i) Quantities operated in excess of 125% but upto 140% of the agreement 

quantity of the concerned item, shall be paid at 98% of the rate awarded 

for that item in that particular tender; 

(ii) Quantities operated in excess of 140% but upto 150% of the agreement 

quantity of the concerned item shall be paid at 96% of the rate awarded for 

that item in that particular tender; 

(iii) Variation in quantities of individual items beyond 150% will be prohibited 

and would be permitted only in exceptional unavoidable circumustances 

with the concurrence of associate finance and shall be paid at 96% of the 

rate awarded for that item in that particular tender. 

(b) 

(c) 

The variation in quantities as per the above formula will apply only to the 

Individual items of the contract and not on the overall contract value. 

Execution of quantities beyond 150% of the overall agreemental value 

should not be permitted and, if found necessary, should be only through 

fresh tenders or by negotiating with existing contractor, with prior 

personal concurrence of FA&CAO/FA&CAO(C) and approval of General 

Manager. 

3. In cases where decrease is involved during execution of contract: 

(a)

The contract signing authority can decrease the items upto 25% of 

individual item without finance concurrence. 

For decrease beyond 25% for individual items or 25% of contract 

agreement value, the approval of an officer not less than rank of S.A. 

grade may be taken, after obtaining ‘No Claim Certificate’ from the 

contractor and with finance concurrence, giving detailed reasons for each 

such decrease in the quantities. 

It should be certified that the proposed to be reduced will not required in 

the same work. 

4. The limit for varying quantities for minor value items shall be 100% (as 

against 25% prescribed for other items). a minor value item for this 

purpose is defined as an item whose original agreement value is less than 

1% of the total original agreement value. 






5. No such quantity variation limit shall apply for the foundation items. 

6. As far as SOR items are concerned, the limit of 25% would apply to the 

value of SOR schedule as a whole and not on individual SOR items. 

However in case of NS items, the limit of 25% would apply on the 

individual items irrespective of the manner of quoting the rate (single 

percentage rate or individual item rate). 

7. For the tenders accepted at Zonal Railways level variations in the 

quantities will be approved by the authority in whose powers revised value 

of the agreement lies. 

8. For tenders accepted by General Manager variations upto 125% of the 

original agreement value may be accepted by General Manager. 

9. For tenders accepted by Board Members and Railway Ministers, 

variations upto 110% of the original agreement value may be accepted by 

General Manager. 

10. The aspect of vitiation of tender with respect to variation in quantities 

should be checked and avoided. In case of vitiation of the tender (both for 

increase as well as decrease of value of contract agreement), sanction of 

the competent authority as per single tender should be obtained. 

2.43. FORCE MAJOR CLAUSE 

If at any time, during continuance of this Contract, the performance, in whole or 

part, by either party, of any obligation under this contract shall be prevented or 

delayed by reason of any war, hostility, act of the public enemy, civil Commotion, 

Sabotage, fires, Floods, Earth quakes, explosions, strikes, epidemics, quarantine, 

restrictions, lockouts, any statute, statutory rules, regulations, order of requisitions 

issued by any Government Department or Competent Authority or acts of God 

(here-in-after referred to as event) then provided notice of the happening of any 

such event is given by either party to the other within twenty one days from the 

date of occurrence there of neither party shall by reason of such event be entitled 

to terminate this Contract nor shall either party have any claim for damage against 

the other in respect of such non-performance or delay in performance, and the 

obligations under the Contract shall be resumed as soon as practicable after such 

event has come to an end or ceased to exist, PROVIDED FURTHER that if the 

performance in whole or part of any obligation under this contract is prevented or 

delayed by reason of any such event beyond a period as mutually agreed to by the 

Railways and the Contractor after any event or 60 days in the absence of such an 

agreement whichever is more, either party may at its option terminate the Contract 

provided also that if the contract is so terminated under this clause the railways 

may at the time of such termination take over from the Contractor at prices as 

provided for in the contract, all works executed or works under execution. 






2.44. ARBITRATION ACT 

Arbitration and conciliation ordinance 1996/ Arbitration act 1996 will be valid for 

this tender in place of Arbitration Act 1940. 

2.45. SETTLEMENT OF DISPUTES: 

(i) The disputes will be settled under the arbitration act 1996. 

(ii) 

The successful tenderer/s shall put up his / their claim as per clause 43 of the 

General Conditions of Contract during the progress of work and not after 

completion of the work. All such claims and disputes shall be settled promptly 

during the progress of the works. The final authority for giving the decision on 

claims and disputes put up by the tenderer/s, contractor/s shall be the Sr. 

Divisional Signal & Telecom Engineer, Western Railway, Ahmedabad only. 

(iii) The provision of Clauses 63 & 64 to the General Condition of Contract will be 

applicable only for settlement of claims or disputes between the parties for values 

less than or equal to 20% of the value of the contract, and when claim or disputes 

are of value more than 20% of the contract, provision of Clauses 63 & 64 and 

other relevant clauses of the General Conditions of Contract will not be applicable 

and arbitration will not be a remedy for settlement of such disputes. 

(iv) The contractor shall not be entitled to ask for reference to arbitration, before the 

completion of the work assigned to him / them under this contract. The 

contractor/s shall seek reference to arbitration to settle disputes only once within 

the ambit of condition 45-(c) above. 

(v) The contractor/s shall not be entitled to make any claim whatsoever against the 

Railway under or by virtue of or arising out of this contract, nor shall the Railway 

entertain or consider any such claim, if made by the contractor/s after he/they 

would have signed a ‘No Claim Certificate’ in favour of the Railway, in such 

form as shall be required by the Railway/s after the works are finally measured 

up. The contractor/s shall be debarred from disputing the correctness of the items 

covered by ‘No Claim Certificate’ or demanding a reference to arbitration, in 

respect thereof. After clear ‘no claim’ as given by contractor the dispute if any 

will not be arbitrable. 

(vi) If any dispute arises between the parties with respect to the tenderer any 

application or suit shall be instituted only in the court with the local limits of 

whose jurisdiction the Western Railways Divisional Head Quarters office is 

situated and both the parties shall be bound by this clause. 






2.46 TRAINING 

The tenderer shall undertake to train 6 Railways engineers and other staff 

nominated by the Railways in different aspects of equipment designs, functioning 

of field installation, testing, commissioning, operations, maintenance and repair 

covering both hardware and software. 

The training should be comprehensive for transfer of complete know-how so as to 

impart full knowledge and competence to successfully execute the installation 

operation and maintenance of all equipment independently. The training courses 

should apart from formal class room training include hands on practical 

experience. The training shall be deemed to be completed only after 

certification by concerned engineer . 

The concerned contractor shall appoint suitable engineer for training. The 

contractor shall supply along with the installation manual, software manual 

etc. & all other manual required to understand the equipment functioning 

before installation. 

The contractor shall at every state of installation; testing and commissioning 

provide all facilities for adequate training of Railway personnel who may be 

deputed to work on that project. 

The training should be conducted on site / offshore / on premises (Either in India 

or abroad) so as to ensure complete understanding of the system which has to be 

verified by competent authority / authorized Railway Engineer. Cost of all such 

training will be borne by the tenderer. 

2.47 PARTNERSHIP DEEDS, POWER OF ATTORNEY ETC:- 

The tenderer shall clearly specify whether the tender is submitted on his own or 

on behalf of partnership concern. If the tender is submitted on behalf of a 

partnership concern, he should submit the certified copy of partnership deed along 

with the tender and authorizations to sign the tender documents on behalf of 

partnership firm. If these documents are not enclosed along with tender 

documents, the tender will be treated as having been submitted by individual 

signing the tender documents. The Railway will not be bound by any power of 

attorney granted by the tenderer or by changes in the composition of the firm 

made subsequent to the execution of the contract. 

It may, however, recognize such power of attorney and changes after obtaining 

proper legal advice, the cost of which will be chargeable to the contractor. 

The tenderer whether sole proprietor, a limited company or a partnership firm, if 

they want to act through agent or individual partner (s) should submit along with 

the tender or at a later stage, a power of attorney duly stamped and authenticated 

by a notary public or by magistrate in favour of the specific person whether 

he/they be partner (s) of the firm or any other person specifically authorizing 

him/them to submit the tender, sign the agreement, receive money, witness 






measurements, sign measurements books, compromises, settle relinquish any 

claim (s) preferred by the firm and sign “No claim certificate” and refer all or any 

refer all or any disputes to arbitration. 

Power of Attorney / Partnership Deed furnished by the Proprietary / Partnership 

firm / Company will not be accepted unless & until it is executed in correct 

manner. 

2.48 VALIDITY OF LEGAL DOCUMENTS: 

Any legal document furnished by the tenderer shall not be accepted unless until it 

is duly & legally vetted by Law Department of Railway, Hence, the document 

which is duly completed, legally valid and acceptable in all respect should only be 

furnished with the tender or else, the tenderer / contractor shall only be 

responsible for any delay or / loss if any caused in execution contract agreement 

or work or payment etc. for want of the legally valid document or in compliance 

of the legal formalities thereof whatsoever. 

2.49 ENGAGEMENT OF QUALIFIED ENGINEER : (not applicable) 

(i) 

If the total cost of the tenderer’s offer is Rs.10 lakhs or more, the tenderer(s) shall 

also give a declaration along with his / their tender to the effect that he / they shall 

engage and continue in service for the period of the contract, one Engineering 

Degree holders and also one Engineering Diploma holders. 

(ii) 

None of the engineer should be related to the tenderer(s). 

If, the tenderer(s) fails / fail to give the above declaration, his/ their tender will be 

ignored. In case it is subsequently discovered that the declaration as aforesaid is 

in any way incorrect or the information furnished therein is wrong, the 

administration reserves the right to rescind the contract and to take action in 

accordance with clause 61 of the General Condition of Contract. As a deterrent if 

the Engineers are not at site, recovery of Rs.10, 000/- p.m. will be done.

Chapter – IV –SPECIFICATIONS FOR EXECUTION OF WORK 

4. 0 PTZ Camera :- 

(i) P/T/Z dome type cameras shall be mounted at two locations in ICU . 

(ii) Contractor shall have to provide different type of hanging/ mounting 

arrangement (will be decided by site in-charge of the work) for cameras 

depending upon the type of location. Material used for clamping/ hanging 

and mounting accessories viz. nut, bolt, washer, spring washer etc. shall be 

non-corrosive & firm will carry out minimum two rounds of paint on 

various part of used material . 

(iii) Cameras shall be mounted at suitable height so that public is not able to 

tamper or damage the camera (Exact location of cameras will be given by 

site in-charge). Fixing of cameras shall be done in such a way that they are 

not directly affected by rain or light. 

(v.) Camera output will be connected to DVR through video cable. video cable 

shall be laid in PVC casing capping /conduit pipe after putting ferules for 

easy identification of video cable. Power cable shall have to run separate in 

PVC casing capping after putting ferules for easy identification of Power 

cable. The cables shall be properly dressed and clamped at regular intervals 

of approximately 1 meter.. Required adopters for feeding supply to camera 

male /female plug etc. shall be provided and installed by the contractor. 

(vi). Male/female electric plug with switch of good quality shall be installed by 

the contractor. 

(vii) All cameras shall be configured with viewing software so that all 

cameras can be freely accessible and controllable from control room.

4.3 Monitor 

In ICU unit , LCD monitors of minimum 21” and 29” size each shall be 

wall mounted inside / outside using anchor fastener nut bolt as per directives 

of site charge. The height of mounting shall be such that, on duty nurse &

visitor is easily able to view the picture of patient . LCD monitors shall be 

connected to DVR. All wiring shall be in PVC casing capping/conduit pipe /

electric male /female plug with switch shall be provided by the firm. Power 

cable, Data cable etc. shall be laid in cable guide after putting ferules for 

every identification of cable & lacing and clamping of cable shall be done at 

regular intervals of 1 meter. 

4.4 19” 9U rack 

. 

Fixing of 19” 9U rack on the wall should be rigid and aesthetics should be 

maintained using anchor fastener nut bolt as per directives of site charge.. 

Bottom panel shall be with gland plate for cable entry . 

All the required materials including installation/testing/commissioning 

and wiring materials such as wires, lugs, casing, capping, wooden stand, 

dressing/lacing and fixing/clamping materials shall be supplied by the 

contractor extended to U rack earth strip. 

Any damage to the wall or surroundings shall be repaired by the contractor 

without additional cost. Power cable, patch cord for each monitor / cameras 

DVR shall be laid in PVC casing capping /conduit pipe after putting ferules 

for easy identification of cable. The cables shall be properly dressed and 

clamped at regular intervals of approximately 1 meter.

CHAPTER – VI Annexures 

ANNEXURE-I 

INSTRUCTIONS FOR SUBMITTING THE TENDERS AS JOINT 

VENTURE FIRMS 

Criteria to evaluate Joint Venture firms:- 

(As per Railway Board letter No. 2002/CE-1/CT/37 New Delhi Dated 

:07.09.2011)“Joint Venture Firms” shall be applicable to the works tenders 

of value more than Rs. 25 crore only.) 

1. Separate Identity / name should be given to the Joint Venture firm / 

establishment. 

2. In case of parties to the Joint Venture Agreement have agreed to designate one of 

the partners as “Lead partner” the clause specifying the details of authorities, 

powers, rights, duties given to him should be included in the agreement in clear 

terms. 

3. Share of profit and loss along with share of individual/parties should be clearly 

indicated therein. 

4. For the interest of Railways a specific provision should be made in the J/V 

agreement in which the party to the agreement should be made jointly and 

severally liable/responsible in case of any default by either of the parties to the 

Joint Venture Agreement. 

5. If both the parties of J/V firm are partnership firms, the name of all the partners 

be mentioned in the J/V Agreement and should be signed by the all the partners 

OR their Power of Attorney should form an enclosure of the J/V Agreement. 

6. In case of one or more parties to the Joint Venture Agreement are partnership 

firm/s, the following documents should be enclosed: 

a) Certified copy of Partnership Deed. 

b) Consent of all the partners to enter into the Joint Venture Agreement on a stamp 

paper of appropriate valuation. 

c) Power of attorney in favour of one of the partner to sign the Joint Venture 

Agreement on behalf of all the partners and create liability against the firm. 

7. In case one or more parties are Proprietary firm OR HUF, the following 

documents should be enclosed: 

Affidavit on Stamp paper of appropriate valuation declaring that his concern is a 

Proprietary concern and he is sole proprietor of the concern OR he is in position 

of “KARTA” of Hindu Undivided Family and he has authority, power and 

consent given by other co-partners to act on behalf of HUF.

8. In case of one or more partners are limited companies, following documents 

should be submitted: 

(a) Certified copy of minutes of meeting of the directors of the company in which 

resolution was passed to the effect of entering into the Joint Venture Agreement. 

(b) of authorizing Managing Director/One of the director/manager of the 

company to sign the Joint Venture Agreement of authorizing M.D. / 

Director/Manager or any other person to sign all other documents, contracts, 

agreements etc. and the create liability against the company or and / or to do any 

other act on behalf of the company. 

(c) Copy of Memorandum and articles of Association of the company. 

Power of Attorney by the Competent Authorizing person to do act mentioned in 

the (c) above. 

9. Documents: 

a) Competent Authority should certify the copies of documents, sent in support of 

the Joint Ventures. 

b) Original documents, sent in support of the Joint Venture Agreement should be 

Registered / notarized as the case may be. 

10. While evaluating the performance of Joint Venture firms following criteria shall 

be applicable. 

i) Solvency/Turnover: 

Solvency / Turnover of all the parties/firms should invariably be submitted along 

with tender documents indicating their proportion in each company/firm. 

Total solvency shall be calculated based on their proportion. 

Example: 

2 individuals A & B from Joint Venture with 60% and 40% share ‘A’ has 

partnership with firm XI and X2 having stake of (say) 30% and 40% respectively 

having turnover of Z1 and Z2 respectively ‘B’ has partnership with firm Y1 and 

Y2 having stake of (say) 50% and 20% respectively having turnover of Z3 and 

Z4 respectively. 

Then Solvency / Turnover of a Joint Venture firm shall be: 

= (0.3Z1 + 0.4Z2) X 60 + 40 X (0.5 Z3 + 0.2 Z4)

One of the parties of Joint Venture firm should invariably fit in the technical 

eligibility criteria fixed in tender documents. 

11. Purchase of Tender Documents: 

Tender documents may be purchased either in the name of one of the Partners of 

Joint Venture firm OR in the name of J/V firm. Earnest money should be 

deposited in the name of J/V firm only. 

The Joint Venture Agreement should invariably contain clauses related to 

following subject/ issues in the manner specified herein below: 

Joint and Several Liability: 

The parties hereto shall if awarded the contract for the project be jointly and 

severally liable to Employer for execution of the project in accordance with 

General & Special conditions of the contract. The parties hereto also undertake 

to be liable jointly and severally for loss, damages caused to the Employer in 

course of execution or due to non-execution of the contract or part thereof or 

arising out of the contract. 

Validity of the Joint Venture Agreement: 

The Joint Venture Agreement must be executed prior to the date of submitting the 

tender and it should be duly registered or duly notarized by Notary Public. 

The Joint Venture Agreement shall not be terminated unless and until the work 

awarded under the contract is completed in all respect and also till the 

maintenance period is over or till all the contractual liabilities are discharged 

completely. 

Notices and correspondences: 

All correspondences of notices to the Joint Venture shall be addressed to M/s.

No party to the Joint Venture has the right to assign or transfer the interest, right

vii) Use of Machinery, Instruments, Labour force etc.: 

The parties here to undertake that whatever the machinery, instruments, labour 

force, (including unskilled, skilled, inspector, Engineers etc.) they posses at the 

time of entering into Joint Venture Agreement or which subsequently shall come 

in their possession and if such machinery, instruments, labour force is required 

for the speedy and efficient execution of the work, the party/parties having the 

control over the said machinery, instruments, labour force etc. without having any 

regard to their share of profit and loss agreed to between the parties in Joint 

Venture Agreement shall hand over the same at the disposal of the other party 

who is actually executing the work for purpose of execution of the contract 

without any hindrance and obstacle. 

viii) Execution Non Judicial Stamp Paper: 

The Joint Venture Agreement must be on Non Judicial Stamp Paper of Rs.100/- 

or as per Stamp Act of the concerned State where agreement has been executed.

payments to be made by the Railway, the Contractor will duly perform the said works in 

the said Schedule set forth and shall execute the same with great promptness, care and 

accuracy in a workman like manner to the satisfaction of the Railway and will complete 

the same in accordance with the said specifications and said drawings and said conditions 

of contract within _____ months from the date of acceptance, rectify the Installation 

defects if any of the said work for period of _______ months and maintain the same 

for _______ month from the certified date of their taking over by the Railway and keep 

all the conditions therein mentioned (which shall be deemed and taken to be part of this 

contract as if the same had been fully set forth herein), And the Railway do, hereby 

agree that if the contractor shall duly perform the said work in the manner aforesaid 

and observe and keep the said terms and conditions, the Railway will pay or cause to be 

paid to the Contractor for the said works on the final completion thereof the amount due 

in respect thereof at the rates specified in the schedule hereto annexed.

ANNEXURE VI 

INDEMNITY BOND 

Indemnity Bond for safe custody of Railway material to be supplied to

hereby undertake that we shall hold in our custody for and on behalf of the President of India 

acting in the premises through the General Manager, Western Railway or for him all Railway

by the Railway for the purpose of execution of the said contract until such time the materials 

are duly installed and/or erected or otherwise handed over to the Railway. 

We shall be entirely responsible for the safe custody and protection of the said materials

Railway or as directed otherwise and shall indemnify the Railway against any loss, damage 

or deterioration whatsoever in respect of the said materials. The said materials shall at all 

time be opened to Inspection by any Officer authorized by the General Manager, Western 

Railway or his nominee. 

Should any loss, damage or deterioration of materials occur or surplus materials disposed off 

and a refund becomes due, the Railway shall be entitled to recover from us the full cost and 

compensation determined in terms of the contract for such loss or damage, if any, along with 

the amount to be refunded without prejudice to any other remedies available to him by 

deduction from any sum due or any sum which at any time thereafter becomes due to us 

under the said or any other contract. 

In the event of any loss or damage as aforesaid the assessment of such loss or damage and the 

assessment of the compensation therefore would be made by the President of India acting 

through the General Manager, Western Railway or his authorized nominee shall be final and 

bind upon us.

ANNEXURE VII 

PROFORMA FOR PERFORMANCE GUARANTEE BOND

India and __________________(hereinafter called the contractor) this is to certify that at

indemnify and keep indemnified the President of India (Government of India) against any 

loss or damage that may be caused to or suffered by the President of India (Government

the amount of loss or damage that has been caused or suffered by the President of India 

(Government of India) shall be final and binding on us and the amount of the said loss or 

damage shall be paid by us forthwith on damage and without demur to the President of 

India (Government of India)

herein contain shall remain in full force and effect during the period that would be taken 

for the satisfactory performance and fulfillment in all respects of the said contract and till

and its claims satisfied or discharged or till the Senior Divisional Signal & Telecom 

Engineer, Western Railway, Divisional Railway Manager’s Office, Ahmedabad certified 

that the terms and conditions of the said contract have been fully properly carried out by 

the said Contractor and accordingly discharges this guarantee. 

It is fully understood that this guarantee is effective is effective from the date of the 

said Contract and that we ________________________Bank undertake not to revoke this 

guarantee during its currency without the consent in writing of the President of India 

(Government of India). 

We ____________________________Bank further agree that the President of India 

(Government of India) shall have the fullest liberty, without affecting in any manner our 

obligations hereunder to vary any of the terms and conditions to the said contract or to 

extend time of performance by the contractor from time to time or to postpone for any 

time or from time to time any of the powers exercisable by the President of India 

(Government of India) against the said contract and to forbear or enforce any of the terms 

and conditions relating to the said contract and we _____________________ Bank shall 






not be released from our liability under this guarantee by reasons of any such variation or 

extension and/or omission on the part of the President of India or any indulgence by the 

President of India to the said contractor or by any other matter of the thing whatsoever, 

which under the law relating to sureties would, but for this provision, have the effect of 

so releasing us from our liability under this guarantee.
