Chapter – II – Special Condition of Contract<br />

2.4 Quantum of Work, Recommended Spares & Optional Items:<br />

(i) The estimated quantities of various items required to be installed and<br />

commissioned are mentioned in the Tender Schedule. It should be clearly noted<br />

that the items and the quantities mentioned have been worked out by Railways<br />

as per the estimated requirements. However if the Tenderer feels that the desired<br />

features can not be achieved or some of the essential features can not be<br />

obtained through the quantities provided in the Tender Schedule, then quantity<br />

as required for the work in the opinion of the Tenderer shall be quoted as<br />

additional items and/or quantity. In such cases, Tenderer shall give, full<br />

justification for such variation, clearly mentioning the consequences of<br />

procuring the quantities suggested by the contractor instead of quantities<br />

indicated in schedule.<br />

(ii) Similarly for any other item(s) necessary for satisfactory completion/<br />

functioning of the tendered work in accordance with the objective of<br />

requirement, rates and quantities of such item(s) shall be quoted separately,<br />

along with detailed justification for the need of the item(s) to achieve end<br />

objective.<br />

(iii) Costs for additional items mentioned above shall be quoted separately wherever<br />

necessary which shall not be taken into account for evaluation criteria of the<br />

offers.<br />

(iv)<br />

Railway reserves the right to include any of the additional items which shall be<br />

binding on the contractor.<br />

2.5 PRICE VARIATION CLAUSE (PVC): No price variation will be applicable.<br />

2.6 PERFORMANCE GUARANTEE:<br />

Revised Clause 16(4) to Indian Railways General Conditions of contract<br />

{Ref: Item-1 to Railway Boards letter no.2007/CE.I/CT/18 Pt.XII dated:<br />

31.12.2010} Clause 16(4). Performance Guarantee<br />

The procedure for obtaining Performance Guarantee is outlined below:<br />

(a)<br />

The successful bidder shall have to submit a Performance Guarantee (PG)<br />

within 30 (thirty) days from the date of issue of Letter of Acceptance (LOA).<br />

Extension of time for submission of PG beyond 30 (thirty) days and upto 60<br />

days from the date of issue of LOA may be given by the authority who is<br />

competent to sign the contract agreement. However a penal interest of 15%<br />

per annum shall be charged for the delay beyond 30 (thirty) days, i.e. from<br />

31 st day after the date of issue of LOA. In case the contractor fails to submit<br />

the requisite PG even after 60 days from the date of issue of LOA the contract<br />
