Item 29: Notice <strong>of</strong> hearings <strong>and</strong> reviews to caregivers<br />

Goal: The State will ensure that foster parents, pre-adoptive parents, <strong>and</strong> relative caregivers <strong>of</strong> children in foster care be<br />

notified <strong>of</strong>, <strong>and</strong> have an opportunity to be heard in, any review or hearing held with respect to the child.<br />

To meet this goal, the State will work with the courts <strong>and</strong> child welfare agencies to develop a mechanism for child welfare<br />

agency reporting on the timeliness <strong>and</strong> consistency <strong>of</strong> notification for hearings for foster parents, pre-adoptive parents,<br />

<strong>and</strong> relative caregivers <strong>of</strong> children in foster care for any review or hearing held with respect to the child <strong>and</strong> will ensure<br />

that this system is effective in 90% <strong>of</strong> applicable cases. To accomplish this goal, the State must develop a mechanism for<br />

reporting on the involvement <strong>of</strong> foster parents, pre-adoptive parents, <strong>and</strong> relative caregivers <strong>of</strong> children in foster care at<br />

reviews <strong>and</strong> hearings. This process is still under development.<br />

NRS 432B, NAC 432B <strong>and</strong> statewide policy 0206 Court Notification m<strong>and</strong>ate that proper notification <strong>of</strong> court hearings <strong>and</strong><br />

court reviews regarding the status <strong>of</strong> a child in the custody <strong>of</strong> a child welfare agency must be provided <strong>and</strong> is necessary to<br />

ensure active involvement <strong>and</strong> participation <strong>of</strong> parents, foster parents, guardians, pre-adoptive parents, <strong>and</strong> relative<br />

caregivers in the child’s safety, permanency <strong>and</strong> well-being. While internal policies <strong>and</strong> procedures regarding court<br />

notification requirements <strong>and</strong> protocols may differ between child welfare agencies, formal written notification to the<br />

aforementioned caregivers must be supplied pursuant to NRS 432B.580 (6) (a) (b). Notice <strong>of</strong> the hearing must be given<br />

by registered or certified mail to all parties to any <strong>of</strong> the prior proceedings, <strong>and</strong> parents <strong>and</strong> any persons planning to adopt<br />

the child, relatives <strong>of</strong> the child or providers <strong>of</strong> foster care who are currently providing care to the child. If a child in<br />

protective custody is determined to be <strong>of</strong> Indian descent, the child welfare agency must notify the tribe in writing at the<br />

beginning <strong>of</strong> the proceedings. If the Indian child is eligible for membership in more than one tribe, each tribe must be<br />

notified.<br />

In the 2009 Nevada CFSR, this item received a rating <strong>of</strong> area needing improvement.<br />

Systemic Factor C: Quality Assurance System<br />

Item 30: St<strong>and</strong>ards ensuring quality services<br />

Goal: The State will endure that st<strong>and</strong>ards are adequately developed <strong>and</strong> implemented to ensure that children in foster<br />

care are provided quality services that protect the safety <strong>and</strong> health <strong>of</strong> the children.<br />

This goal has two main objectives. The first is that the State will engage in necessary regulation development to ensure<br />

quality st<strong>and</strong>ards for foster care are updated according to bills passed in the 2009 legislative session. The second is that<br />

the State will develop a system for evaluating the implementation <strong>of</strong> the st<strong>and</strong>ards for foster care, including a mechanism<br />

to provide feedback to key stakeholders; to ensure that children in foster care are provided quality services that protect<br />

the safety <strong>and</strong> health <strong>of</strong> the children. The second objective is dependent on the outcome <strong>of</strong> the first. Specifically, it will<br />

not be addressed until the regulations are adopted <strong>and</strong> an evaluation protocol is developed. Therefore, for this reporting<br />

period, only first objective will be addressed in Nevada’s effort to reach this goal.<br />
