SPECIAL CONDITIONS OF TENDER
1. Regulations and abolition act 1970 and general rules 1971:
[a] The contractor shall observe and follow all the provisions of the
contractual labour regulations and abolition act 1970 and general rules
1971 or any statutory modification or re enactment thereof for the time
being in force and any rules and regulations made there under in respect
of all the persons directly or through petty contractor or sub contractor
employed by him under this contract indemnify the Railway from and
against any claim under the contractual labour regulations and abolition
act 1970 and general rules 1971 or any further rules and regulations
framed there under by on or behalf of the person directly or through
petty contractor or sub contractor employed him or otherwise.

The contractor shall obtain license from the licensing officers specified in
the Act in necessary license fee as per section 12 of the Act 1970 and
rules 26 of the General Rules 1971 in every case in which by virtue of
section (20) (2) and 21 (4) of the central labour Regulations and abolitions
Act 1970 the Railway is obligated to provide amenities of pay wages to
labour employed by the contractor in executing the work, the Railway will
recover from the contractor the expenditure so incurred by the Railway or
the wages so paid and without prejudice to the rights of the Railway under
section (2) (2) and 21 (4) of the said Act sub amounts of part there or by
deducting it from the security deposit or from any such due by the
Railway to the contractor whether under these or any other present
provided that if any dispute arise as to the expenditure incurred by the
Railway in the provision of the said amenities the decision of the Engineer
there of shall be final and binding.
2. Inspection:
The Railway’s representative/ officers for checking the progress and quality of
work could inspect the work site at any time. Any defects as may be noticed by
the inspecting officials will have to be rectified by the contractor at his cost. In
case the inspecting officer finds the progress unsatisfactory or the quality of work
inferior, he may immediately order the contractor to suspend the work. The
defects noticed should be got attended immediately, failing which the defects
could be got rectified and the balance work got completed through any other
agency at risk and cost of the defaulting contractor.
3. Tools and plants:
The contractor will have to make his own arrangements for tools and plants
required for execution of the works.
4. Works completion report:
A work completion report will have to be given by the contractor after the work
has been completed in all respects with information as specified in clause and
before submitting his final bill.
