Notice of Intent to Award <strong>Contra</strong>ct<br />
After completion of the evaluation process and contract negotiations and before the formal award<br />
of a contract, ECCTA will issue a “Notice of Intent to Award <strong>Contra</strong>ct” to all proposers. This<br />
notice shall contain the name and contract amount of the intended recipient of award.<br />
ECCTA Board of Directors Award<br />
The ECCTA Board of Directors will evaluate the Technical Review Committee’s<br />
recommendation and award a contract during the June 26, 2013, regularly scheduled meeting.<br />
<strong>Contra</strong>ct Execution<br />
ECCTA will execute the contract with the successful proposer on June 27, 2013.<br />
Rejection of Proposals<br />
ECCTA reserves the right to reject any or all proposals, to make any awards or any rejections in<br />
what it alone considers to be in the best interest of ECCTA, and to waive any informalities or<br />
irregularities in the proposals.<br />
If there is a reason to believe that collusion exists among any of the proposers, none of the<br />
proposals of the participants in the collusion will be considered. In addition, ECCTA may elect<br />
to reject all proposals received.<br />
ECCTA reserves the right to reject a proposal:<br />
that is incomplete, obscure, or irregular;<br />
that is from a proposer who has previously failed to perform properly or to<br />
complete contracts of any nature on time;<br />
that contains unauthorized conditions, exceptions, limitations, or provisos<br />
that contain erasures or irregularities of any kind, without initialing; and/or<br />
that does not include properly completed and signed forms.<br />
Protest Procedures<br />
These procedures will apply to all procurement actions whether by sealed bid, request for<br />
proposal or sole source and regardless of the stage of the procurement process at which the<br />
protest is filed.<br />
A. Protest Before Bid/Proposal Opening<br />
Protests based upon restrictive specifications or alleged improprieties in the<br />
bidding/proposal procedure shall be filed, in writing, ten (10) days prior to the<br />
bid/proposal opening date. A detailed description of the facts underlying the protest plus<br />
any supporting documentation must be included with the written protest.<br />
