B. Protest of Award<br />
A bidder/proposer may file a protest with ECCTA alleging a violation of applicable<br />
federal or state law relative to the seeking, evaluating and/or awarding of a procurement<br />
contract. Such protest must be filed no later than three (3) days after the date of the notice<br />
of pre-award or non-award of the contract by ECCTA. A detailed description of the facts<br />
underlying the protest plus any supporting documentation should be included with the<br />
written protest.<br />
The protest should be submitted to the Director of Administrative Services at ECCTA,<br />
801 Wilbur Avenue, Antioch, CA 94509.<br />
C. Investigation of Protest<br />
The Director of Administrative Services shall investigate any protest filed pursuant to (A)<br />
and/or (B) above, and respond in writing to each point raised by the bidder/proposer<br />
within five (5) working days. The written response shall specify any action to be taken by<br />
ECCTA. If the bidder/proposer is not satisfied with the decision of the Director of<br />
Administrative Services, the bidder/proposer may appeal the decision in writing within<br />
(3) three working days to ECCTA’s Chief Executive Officer (CEO), 801 Wilbur Avenue,<br />
Antioch, CA 94509.<br />
The CEO shall investigate and shall respond in writing specifying any differences<br />
between findings and those of the Director of Administrative Services.<br />
The CEO shall state the action to be taken by ECCTA or the fact that no action shall be<br />
taken. The decision of the CEO is the final decision of ECCTA.<br />
The bidder/proposer will be notified of its right to appeal to the appropriate state or local<br />
administrative or judicial authorities.<br />
In the event a protest has been filed in a timely manner prior to an award being made by<br />
the ECCTA Board of Directors, ECCTA shall not make the award prior to five calendar<br />
days after the resolution of the protest, unless ECCTA makes a written determination<br />
that:<br />
• the items to be procured are urgently required;<br />
• delivery or performance will be unduly delayed by failure to make the award<br />
promptly; or<br />
• failure to make a prompt award will otherwise cause undue harm to ECCTA.<br />
Failure to comply with any of the requirements set forth in ECCTA’s bid/proposal protest<br />
procedures may result in rejection of the protest.<br />
