5.c Means of Implementing <strong>the</strong> Measures for Protection<br />
The protection of <strong>the</strong> World Heritage Sites has been framed in a separate law, Law LXXVII of 2011 on<br />
<strong>the</strong> World Heritage, which takes effect on January 1 st 2012. The law ensures a proper framework for <strong>the</strong><br />
preservation, sustainable development and management of <strong>the</strong> outstanding universal value that exists at<br />
<strong>the</strong> World Heritage sites. However, Law LXIV of 2001 on <strong>the</strong> preservation of cultural heritage provides<br />
a proper framework for <strong>the</strong> preservation of World Heritage sites even today. The system for implementing<br />
this protection is ensured by Law XXVI of 2003 on <strong>the</strong> National Regional Development Plan, as well<br />
as Law LXXVIII of 1997 on <strong>the</strong> protection and shaping of <strong>the</strong> built environment and Law LXV of<br />
1990 on local governments. The National Office of Cultural Heritage sees to <strong>the</strong> measures taken to<br />
provide sites with protection, as well as <strong>the</strong> supervision of this protection.<br />
All of <strong>the</strong> nominated sites are protected under law. The National Regional Development Plan adopted<br />
by law has classified every town where nominated sites can be found as districts to be administered with a<br />
high priority for <strong>the</strong> considerations of cultural heritage.<br />
The provisions of <strong>the</strong> National Regional Development Plan are binding for <strong>the</strong> lower level development<br />
plans (regional, county and town), and on <strong>the</strong> basis of law <strong>the</strong>se plans must designate land uses that are<br />
compatible with heritage preservation interests. The guarantee that heritage preservation considerations<br />
will be asserted in <strong>the</strong> town planning process is <strong>the</strong> heritage preservation impact statement. The<br />
preparation of a heritage preservation impact statement is required in <strong>the</strong> town planning process (<strong>the</strong> town<br />
development conception, <strong>the</strong> town development plan, <strong>the</strong> local building regulations and <strong>the</strong> regulatory<br />
plan, as well as in <strong>the</strong> case of major projects). The provision of <strong>the</strong> law on <strong>the</strong> impact statement stipulates<br />
an analysis of how <strong>the</strong> envisaged change will impact <strong>the</strong> condition, preservation, and future possibilities<br />
for <strong>the</strong> prosperity of archaeological and historic sites.<br />
