Means for asserting <strong>the</strong> interests of heritage:<br />

For <strong>the</strong> objective of asserting <strong>the</strong> interests of cultural heritage <strong>the</strong> authorities can utilize various coercive<br />

means, <strong>the</strong> tools of resolutions, obligations and fines.<br />

The owner is burdened by an obligation for tolerance: According to section 69 (1) <strong>the</strong> owner, trustee or user<br />

of <strong>the</strong> protected cultural heritage must tolerate <strong>the</strong> work ordered or permitted by <strong>the</strong> authority.<br />

If heritage interests cannot be ensured in any o<strong>the</strong>r way, chapter III, section 87 of <strong>the</strong> law provides <strong>the</strong><br />

opportunity for expropriation in <strong>the</strong> case of both archaeological sites and historic properties.<br />

For <strong>the</strong> realization of certain objectives set down in <strong>the</strong> instruments for town planning, town governments<br />

can sign town planning contracts with <strong>the</strong> owners of <strong>the</strong> affected lot or with parties having <strong>the</strong> intent to<br />

invest in <strong>the</strong> lot.<br />

5.d Existing Plans Related to <strong>the</strong> Municipalities and Regions in Which<br />

<strong>the</strong> Proposed Property is Located<br />

a/ From <strong>the</strong> amended Law XXVI of 2003 on <strong>the</strong> National Regional Development Plan:<br />

Chapter I, section 1 The purpose of this law is to determine <strong>the</strong> land use stipulations for <strong>the</strong> country’s<br />

individual regions and <strong>the</strong> coordinated spatial order for technical and infrastructure networks taking into<br />

consideration <strong>the</strong>ir sustainable development, as well as <strong>the</strong> preservation of regional, landscape, natural,<br />

ecological and cultural conditions and <strong>the</strong> protection of resources.<br />

Section 2. In <strong>the</strong> application of this law:<br />

15. Areas to be administered as a high priority from <strong>the</strong> point of view of cultural heritage: zones determined in<br />

<strong>the</strong> National Regional Development Plan where <strong>the</strong> sites of World Heritage and tentative World Heritage,<br />

as well as historic town districts can be found.<br />
