Some project participants said that theywould be willing to participate in picketing <strong>and</strong> strike if they were part of a union:138A. So would those strategies be useful to sex <strong>work</strong>ers, striking <strong>and</strong> picketing?A. Yeah.A. Oh sure. Well if there is a reason for something happening, like somebody’s, like youwanna open up a house <strong>and</strong> it’s a unionized house of <strong>work</strong>ers <strong>and</strong> next door they saywell no we don’t want this house to open well then you have to picket <strong>and</strong> strike tokeep it open. Yeah, that would be y’know.- female street-level sex <strong>work</strong>ersHowever, one out-call sex <strong>work</strong>er argued that, in order for a sex <strong>work</strong>er union to be successfulpicketing <strong>and</strong> striking, it would have to be in a <strong>work</strong>place setting, like that of a massage parlour,where a group of employees <strong>work</strong> at one location waiting for business to come through the door.Section 4: Complaints <strong>and</strong> grievancesIn order to improve <strong>work</strong>ing conditions in the sex industry, employment st<strong>and</strong>ards should becreated along with a mechanism to enforce them. Presently, for a host of reasons, sex <strong>work</strong>ers havefew, if any, options to report unfair or exploitative <strong>work</strong>place conditions. One project participantsuggested that, as things st<strong>and</strong>, the police are the only available option:A. Women get fired all the time, not showing up to <strong>work</strong>, late all the time, customercomplaints. Customers will complain if the girl rushed them out or a girl was toocold, or not nice enough she would just walk away if something bad happened there,there is no one she feels she could complain to unless maybe if she went to vice [police]<strong>and</strong> said they are pimping the girls in this establishment.- female off-street out-call sex <strong>work</strong>erThis is hardly a satisfactory situation, because many sex <strong>work</strong>ers stated that police do not take theirreports seriously. Given that the police are not in a position to establish or enforce employment law,sex <strong>work</strong>ers feel they have few, if any options, to change poor <strong>work</strong>ing conditions. Workers in otherindustries have access to a number of different complaint mechanisms to combat poor <strong>work</strong>ing conditions.For example, if a <strong>work</strong>er feels that an employer is violating an OHSR st<strong>and</strong>ard, they can makea complaint to the Workers’ Compensation Board. Also, where an employee feels that their employeris violating a provision of the ESA, they can make a written complain to the Employment St<strong>and</strong>ardsBranch (the “Branch”).Under the ESA, the Branch reviews the complaint <strong>and</strong>, if it suspects that a violation is occurring,it will attempt to mediate a settlement between the employee <strong>and</strong> the employer. If this is not possible,then the complaint may be taken to the Employment St<strong>and</strong>ards Tribunal (the “Tribunal”) for ahearing. The Tribunal comprises independent members who make a decision based on the facts aspresented to them. Complainants can request that their identity be kept confidential, <strong>and</strong> it will notbe disclosed unless the disclosure is necessary for the purposes of a proceeding, or the director believesthat the disclosure is in the public interest. The director of the Employment St<strong>and</strong>ards Branch hasaccess to all relevant information during the course of the investigation.<strong>Sex</strong> <strong>work</strong>ers face a number of barriers should they wish to participate in this complaint process.The main reason that sex <strong>work</strong>ers do not report their employment concerns to government agenciesis that it could attract the attention of police <strong>and</strong> result in criminal consequences for the <strong>work</strong>er orthe business owner. Another reason is sex <strong>work</strong>ers do not make complaints is that the existing bodies

One employer suggested that it is veryimportant for sex <strong>work</strong>ers to be able to speak out when they feel that they are being exploited in the<strong>work</strong>place:A. I mean, people in this business don’t mobilize very often for a cause. And that’s agood example of a group of people coming together, current employees, ex-employees,coming together <strong>and</strong> saying, we, we need to do something about this, it’s so wrong.It takes a lot for a sex <strong>work</strong>er to say, this is wrong. A lot of what we do is wrong. Weswallow our pride everyday, y’know, men will make disgusting comments, <strong>and</strong> youjust sort-of smile, Oh – you’re, you’re funny! Um – y’know, part of the job is swallowingyour pride. Because part of the job is playing to the male ego. And, again,I am sorry for your gender. But part of the job, involves swallowing your pride. Sowhen it comes to what an employee will take from an employer, quite a bit! AndI mean, I have, myself. And – <strong>and</strong> I’m not a pushover. It’s just part of your cost todoing a lot of business. I’ve <strong>work</strong>ed for a lot of pigs. And I’ve – I’ve never wonderedy’know, mobilize against someone – it would have to be really bad.- female massage parlour owner, former sex <strong>work</strong>erWhen asked whether they would be interested in having a mechanism for complaints againstemployers, many participants said that sex <strong>work</strong>ers need a mechanism for making complaints aboutproblems in the <strong>work</strong>place. However, sex <strong>work</strong>ers raised a number of concerns about a governmentalbody, such as the Branch, h<strong>and</strong>ling complaints. They were concerned that a government body wouldnot underst<strong>and</strong> prostitution <strong>and</strong> the particular <strong>work</strong>place issues that sex <strong>work</strong>ers face. Several projectparticipants felt that any government or other body that is made responsible for overseeing sex <strong>work</strong>placest<strong>and</strong>ards will need to include sex <strong>work</strong>ers in its membership if it is to underst<strong>and</strong> <strong>and</strong> addressthe problems that sex <strong>work</strong>ers currently experience:A. Regardless of the section of employer, I definitely think that there needs to be anarbitration board or a complaint system. Because there’s – there’s been known abusesin this industry.A. For sure.A. And you don’t have no voice. Traditionally, the women doing the <strong>work</strong> have no voice,if there are problems <strong>and</strong> complaints.A. You have to, yeah, establish like somebody that would listen to the hearings though.A. And I think that should be a board of retired hos.A. Yeah. Somebody who has been in the industry for yearsA. Then it would be like a tribunal, not just a union, a tribunal always, only, like threevoices.- female off-street out-call sex <strong>work</strong>ersSome project participants identified ways that the existing ESA complaint system would have to bemodified to address the particular needs of sex <strong>work</strong>ers. They felt sex <strong>work</strong>ers should be able to makeanonymous complaints. Also, they suggested that it should be possible to make a complaint at anytime of day or night:A. That there would be an organization that they could go to report these incidents ofthat are occurring <strong>and</strong> how they are being treated. And so that, something that backstheir involvement. That they won’t just be fired, that there is some sort organizationthat can come in <strong>and</strong> say hey this is either the regulations, you can’t do this <strong>and</strong> youcan’t do that. So then they get penalized for it . . . You could make the complaintanonymous, y’know, <strong>and</strong> just make a number, or something. To make it an anony-139
