BEYOND DECRIMINALIZATION: <strong>Sex</strong> Work, <strong>Human</strong> <strong>Rights</strong> <strong>and</strong> a <strong>New</strong> Frame<strong>work</strong> for Law ReformAs with all taxpayers, sex <strong>work</strong>ers should be provided with accessible information about the personaldeductions that are available to them.Income tax law recommendations1. Provide information <strong>and</strong> education to sex <strong>work</strong>ers who have not paid taxes on the income theyhave earned through prostitution so that they may underst<strong>and</strong> the fundamentals of the Canadiantax system <strong>and</strong> learn how to file a basic income tax return.2. Should prostitution be decriminalized, Revenue Canada <strong>and</strong> the federal Minister of Financeshould exempt sex <strong>work</strong>ers from retroactive tax assessments of income earned prior to the date theprovisions in the Criminal Code relating to prostitution are repealed.3. Provide specialized education <strong>and</strong> sensitivity training for Revenue Canada personnel in order togive them the information necessary to assist sex <strong>work</strong>ers with the taxation information they needin a respectful <strong>and</strong> non-discriminatory manner.4. Consult with sex <strong>work</strong>ers about how to address their specific privacy concerns.5. Ensure that sex <strong>work</strong>ers are not subject to discriminatory treatment, such as unwarranted audits ordisproportionate penalties.173
