currently be allowed <strong>to</strong> permit small-scale cultivation of <strong>the</strong>se plants for <strong>the</strong> productionof <strong>drug</strong>s for personal use, <strong>un</strong>less <strong>the</strong>y applied <strong>the</strong> control measures <strong>to</strong> <strong>the</strong> cultivation. Inpractice, it is likely that this would have <strong>the</strong> effect of preventing Parties from permittingsmall-scale cultivation (as applying <strong>the</strong> control measures <strong>to</strong> such cultivation is likely <strong>to</strong>be impracticable). Therefore, for <strong>the</strong> purposes of Option 1, Articles 22, 23, 26 and 28would need <strong>to</strong> be amended, or changed in effect, <strong>to</strong> limit <strong>the</strong>ir application <strong>to</strong> cultivationof <strong>the</strong>se plants for commercial purposes (i.e. with <strong>the</strong> intention <strong>to</strong> sell <strong>drug</strong>s producedfrom <strong>the</strong> plants or <strong>to</strong> o<strong>the</strong>rwise receive pec<strong>un</strong>iary benefit).The addition of <strong>the</strong> proposed new provision <strong>to</strong> <strong>the</strong> Convention would limit <strong>the</strong>application of Articles 22, 23, 26 and 28 in this way, without any need for directamendment of <strong>the</strong>se articles, as <strong>the</strong> new provision would remove non-commercialcultivation of small quantities of opium poppy, coca bush or cannabis plant from <strong>the</strong>scope of <strong>the</strong> Convention.In relation <strong>to</strong> Parties’ obligation <strong>to</strong> prevent ‘misuse’ of cannabis leaves in Article 28(3),any ambiguity in meaning would be removed by <strong>the</strong> addition of <strong>the</strong> new Article 3 bis,which would remove any non-commercial use of small quantities of cannabis leavesfrom <strong>the</strong> meaning of ‘misuse’. Therefore, Parties’ obligations would be limited <strong>to</strong>adopting necessary measures <strong>to</strong> prevent <strong>the</strong> use of any quantity of cannabis leaves <strong>to</strong>produce cannabis extracts for non-medical or non-scientific commercial purposes (i.e.for sale). Parties are obliged <strong>to</strong> make this a p<strong>un</strong>ishable offence in any case <strong>un</strong>der Article36, which requires Parties <strong>to</strong> make ‘production’ and ‘extraction’ of <strong>drug</strong>s contrary <strong>to</strong> <strong>the</strong>provisions of <strong>the</strong> convention p<strong>un</strong>ishable offences when committed intentionally.(‘Production’ is defined in Article 1(t) as ‘<strong>the</strong> separation of opium, coca leaves, cannabisand cannabis resin from <strong>the</strong> plants from which <strong>the</strong>y are obtained’. Extraction is notdefined but would clearly include extracting cannabis resin and o<strong>the</strong>r extracts fromcannabis leaves.) Article 4(c) also requires Parties <strong>to</strong> limit production of <strong>drug</strong>s <strong>to</strong> medicaland scientific purposes. Therefore, <strong>the</strong>re may not be any need <strong>to</strong> retain <strong>the</strong> reference <strong>to</strong>‘misuse’ in Article 28(3) following <strong>the</strong> addition of <strong>the</strong> new Article 3 bis.4.11.3 Option 2 – changes <strong>to</strong> Articles 22, 23, 26 and 28Under Option 2, Parties would be allowed <strong>to</strong> permit cultivation of opium poppy, cocabush or cannabis plant for non-medical or non-scientific personal use, or for supply <strong>to</strong><strong>the</strong> non-medical or non-scientific market. Parties would be required <strong>to</strong> apply <strong>the</strong> controlmeasures in Articles 22, 23, 26 or 28 <strong>to</strong> cultivation of <strong>the</strong>se plants for commercial useand/or where <strong>the</strong> cultivation is of more than small quantities. However, for <strong>the</strong> samereasons as <strong>un</strong>der Option 1, it is proposed that <strong>the</strong> control measures should not apply inrelation <strong>to</strong> cultivation of small quantities of <strong>the</strong>se plants for non-commercial personaluse.The control measures in Articles 22, 23, 26 and 28 are not expressly limited <strong>to</strong> cultivationof opium poppy, coca bush or cannabis plant for medical or scientific purposes.Therefore, <strong>the</strong>re would be no need <strong>to</strong> directly amend <strong>the</strong>se provisions <strong>to</strong> extend <strong>the</strong>irapplication <strong>to</strong> cultivation of <strong>the</strong>se plants for non-medical or non-scientific purposes for117
