Article 9 does not apply <strong>to</strong> Schedule I substances, which are subject <strong>to</strong> <strong>the</strong> stricterrequirements of Article 7, and must only be used by duly authorised persons for verylimited medical purposes.5.4.2. Options 1 and 2 – changes <strong>to</strong> Article 9As with Article 30(2)(b) and <strong>the</strong> proposed new Article 3 bis of <strong>the</strong> 1961 Convention, if <strong>the</strong>new Article 2 bis of <strong>the</strong> 1971 Convention were <strong>to</strong> apply <strong>to</strong> <strong>the</strong> prescription requirementin Article 9 <strong>un</strong>der ei<strong>the</strong>r Option 1 or 2, its effect would be that non-commercial supply ordispensation of small quantities of <strong>drug</strong>s <strong>to</strong> individuals for medical purposes would beexempt from <strong>the</strong> requirement. For <strong>the</strong> reasons noted above in relation <strong>to</strong> Article 30(2)(b)of <strong>the</strong> 1961 Convention, it is also suggested that <strong>the</strong> medical prescription requirement inArticle 9 should apply in all cases where <strong>drug</strong>s are supplied or dispensed for medicaluse, and should not depend upon <strong>the</strong> quantity of <strong>drug</strong>s and/or commerciality of <strong>the</strong>supply.The same amendments are proposed for <strong>the</strong> purposes of both Option 1 and Option 2 <strong>to</strong>achieve this: Article 9 would need <strong>to</strong> be exempted from <strong>the</strong> new Article 2 bis (asproposed above) so that Article 9 would continue <strong>to</strong> apply <strong>to</strong> supply or dispensation ofsmall quantities of <strong>drug</strong>s for o<strong>the</strong>r than commercial purposes. In addition, Article 9should be amended directly <strong>to</strong> make it clear that <strong>the</strong> medical prescription requiremen<strong>to</strong>nly applies in relation <strong>to</strong> medical use of <strong>drug</strong>s.5.4.3. Options 1 and 2 – amendment of Article 9In paragraph 1, insert <strong>the</strong> word ‘medical’ after ‘dispensed for’.Article 9.
