separate estimates and statistical returns in relation <strong>to</strong> s<strong>to</strong>cks of coca leaves <strong>to</strong> be usedfor <strong>the</strong> preparation of flavouring agents, as permitted <strong>un</strong>der Article 27.4.2.2 Option 2 – changes <strong>to</strong> Article 1(1)(x)As noted above, and discussed in fur<strong>the</strong>r detail below, it is proposed <strong>un</strong>der Option 2 that <strong>the</strong>requirements for co<strong>un</strong>tries and terri<strong>to</strong>ries <strong>to</strong> furnish estimates and statistical returns of <strong>the</strong>ir<strong>drug</strong> use (in Articles 19 and 20 of <strong>the</strong> 1961 Convention) and <strong>to</strong> prevent manufacture andimport beyond <strong>the</strong>ir requirements (in Article 21 of <strong>the</strong> 1961 Convention) should be extended<strong>to</strong> consumption of <strong>drug</strong>s for o<strong>the</strong>r than medical or scientific purposes. Accordingly, <strong>to</strong>ensure that Parties’ obligations <strong>un</strong>der <strong>the</strong>se provisions in relation <strong>to</strong> s<strong>to</strong>cks would apply <strong>to</strong>s<strong>to</strong>cks held for consumption for o<strong>the</strong>r than medical and scientific purposes, <strong>the</strong> definition ofs<strong>to</strong>cks in Article 1(1)(x) would need <strong>to</strong> be amended <strong>to</strong> remove <strong>the</strong> limitation <strong>to</strong> s<strong>to</strong>cks heldfor consumption for medical and scientific purposes. The reference <strong>to</strong> ‘medical and scientificpurposes’ should be replaced with a reference <strong>to</strong> ‘licit purposes’ <strong>to</strong> make it clear that Partieswould not be obliged <strong>to</strong> provide information in relation <strong>to</strong> s<strong>to</strong>cks held for consumption forillicit trade. The changes proposed <strong>to</strong> Articles 19, 20 and 21 <strong>un</strong>der Option 2 are discussed inmore detail in sections 6.7, 6.8 and 6.9 below.4.2.3 Option 2 – amendment of Article 1(1)(x)In Article 1(1)(x), for ‘medical and scientific’ substitute ‘licit’.x) “S<strong>to</strong>cks” means <strong>the</strong> amo<strong>un</strong>ts of <strong>drug</strong>s held in a co<strong>un</strong>try or terri<strong>to</strong>ry and intended for:i) Consumption in <strong>the</strong> co<strong>un</strong>try or terri<strong>to</strong>ry for medical and scientific licit purposes;ii) Utilisation in <strong>the</strong> co<strong>un</strong>try or terri<strong>to</strong>ry for <strong>the</strong> manufacture of <strong>drug</strong>s and o<strong>the</strong>rsubstances, oriii) Export;but does not include <strong>the</strong> amo<strong>un</strong>ts of <strong>drug</strong>s held in <strong>the</strong> co<strong>un</strong>try or terri<strong>to</strong>ry,iv) By retail pharmacists or o<strong>the</strong>r authorised retail distribu<strong>to</strong>rs and by institutions orqualified persons in <strong>the</strong> duly authorised exercise of <strong>the</strong>rapeutic or scientificf<strong>un</strong>ctions, orv) As “special s<strong>to</strong>cks”.82
