that this should be compared <strong>to</strong> <strong>the</strong> heading of Article 30 – ‘Trade and Distribution’. 160On <strong>the</strong> o<strong>the</strong>r hand, <strong>the</strong> ordinary meaning of distribution is ‘<strong>the</strong> act of sharing somethingout among a number of recipients’, 161 and <strong>the</strong> use of both terms ‘trade’ and ‘distribution’in paragraph 1 could suggest that distribution was intended <strong>to</strong> have a wider meaningthan distribution in or for <strong>the</strong> purposes of trade. Accordingly, it is possible that <strong>the</strong>obligations in paragraph 1 could be interpreted as extending <strong>to</strong> non-commercialdistribution of <strong>drug</strong>s <strong>to</strong> recipients for <strong>the</strong>ir personal use. It may not be practicable forParties <strong>to</strong> license small-scale distribution for personal use, so <strong>the</strong> effect of thisinterpretation may be <strong>to</strong> prevent Parties from permitting such distribution.4.13.2 Option 1 – changes <strong>to</strong> Article 30(1)The new Article 3 bis would ensure beyond doubt that Parties would not be preventedby Article 30(1) from permitting non-commercial distribution of small quantities of<strong>drug</strong>s <strong>to</strong> recipients for <strong>the</strong>ir personal use for <strong>the</strong> purposes of Option 1. Parties wouldonly be obliged <strong>to</strong> apply <strong>the</strong> control measures in Article 30(1) <strong>to</strong> distribution of morethan a small quantity of <strong>drug</strong>s and/or distribution for a commercial purpose. Therefore,no direct changes <strong>to</strong> Article 30(1) would be needed.4.13.3 Option 2 – changes <strong>to</strong> Article 30(1)It is proposed <strong>un</strong>der Option 2 that Parties would be allowed <strong>to</strong> permit trade anddistribution of <strong>drug</strong>s for non-medical or non-scientific purposes, but that trade in <strong>drug</strong>s,and distribution of more than small quantities of <strong>drug</strong>s for commercial purposes, shouldbe subject <strong>to</strong> <strong>the</strong> control measures in Article 30(1). Again, <strong>the</strong>re would be no need fordirect amendment of Article 30(1) <strong>to</strong> achieve this.
