<strong>un</strong>der its domestic law, when committed intentionally, <strong>the</strong> possession, purchase orcultivation of narcotic <strong>drug</strong>s or psychotropic substances for personal consumptioncontrary <strong>to</strong> <strong>the</strong> provision of <strong>the</strong> 1961 Convention, <strong>the</strong> 1961 Convention as amended or<strong>the</strong> 1971 Convention.…4.…d) The Parties may provide, ei<strong>the</strong>r as an alternative <strong>to</strong> conviction or p<strong>un</strong>ishment, or inaddition <strong>to</strong> conviction or p<strong>un</strong>ishment of an any offence with respect <strong>to</strong> narcotic <strong>drug</strong>s orpsychotropic substances established in accordance with paragraph 2 o<strong>the</strong>r than asrequired by paragraph 1 of this article, measures for <strong>the</strong> treatment, education, aftercare,rehabilitation or social reintegration of <strong>the</strong> offender.6.1.4. Option 2 – changes <strong>to</strong> <strong>the</strong> 1988 ConventionAs discussed above, <strong>the</strong> provisions of Article 3 are expressed <strong>to</strong> apply where actions arecontrary <strong>to</strong> <strong>the</strong> provisions of <strong>the</strong> 1961 Convention, <strong>the</strong> 1961 Convention as amended or<strong>the</strong> 1971 Convention – meaning contrary <strong>to</strong> laws or regulations Parties would berequired <strong>to</strong> adopt <strong>un</strong>der <strong>the</strong> provisions of those Conventions, or where <strong>the</strong>y relate <strong>to</strong> orinvolve <strong>the</strong> illicit cultivation, production, manufacture or use of narcotic <strong>drug</strong>s orpsychotropic substances, or <strong>the</strong> commission of offences established in accordance withArticle 3.The effect of <strong>the</strong> proposed amendments <strong>to</strong> <strong>the</strong> 1961 Convention and <strong>the</strong> 1971Convention <strong>un</strong>der Option 2, discussed above, would be that none of <strong>the</strong> actions listed inArticle 3(1)(i) or (ii) or Article 3(2) of <strong>the</strong> 1988 Convention would be contrary <strong>to</strong> <strong>the</strong>provisions of <strong>the</strong> 1961 Convention or <strong>the</strong> 1971 Convention, whe<strong>the</strong>r formedical/scientific purposes or o<strong>the</strong>r purposes, so long as <strong>the</strong>y were in compliance withany control measures that Parties would be required <strong>to</strong> apply <strong>un</strong>der <strong>the</strong> Conventions(e.g. <strong>un</strong>der Articles 23, 26 and 28-31 of <strong>the</strong> 1961 Convention, and Articles 7, 8 and 9 of<strong>the</strong> 1971 Convention). In addition, as <strong>un</strong>der Option 1, non-commercial activitiesinvolving only small quantities of <strong>drug</strong>s or substances would be exempt from <strong>the</strong>provisions of <strong>the</strong> Conventions (except that medical or scientific use of <strong>drug</strong>s orsubstances would still be subject <strong>to</strong> Article 30(2)(b) of <strong>the</strong> 1961 Convention or Articles7(a) and 9 of <strong>the</strong> 1971 Convention).Accordingly, Parties (with <strong>the</strong> possible exception of Afghanistan and Chad 228 ) would nolonger be required <strong>to</strong> make <strong>the</strong>se activities criminal offences <strong>un</strong>der Articles 3(1)(i),3(1)(ii) or 3(2) of <strong>the</strong> 1988 Convention, except where <strong>the</strong>y were o<strong>the</strong>r than in compliancewith applicable control measures, and <strong>the</strong>se activities would no longer be ‘illicit’.2281988 Commentary, p. 50.
